  1. I don't think he can 'take' his father with him to the states as he isn't qualified to do so. His dad will need to apply for the visitor visa and be able to show sufficient ties like you said but if this is his first visitor visa, am not sure they will issue him with a 10 year visa, very unlikely. The first step is to apply for a 6 month visitor visa. I doubt there is any way around it until his son becomes a US citizen, others more knowledgeable might be able to shed more light.

    Agreed. There is no basis in immigration law for him to take his father with him. His father would have to qualify for a visitor visa based on his own circumstances and the length of the visa will be dependent upon the evaluation by the local US Embassy which has complete discretion.

    Thanks aniomaman and aaron2020, one more query .. is it ture that if he get 10 years visitors visa , and on POE he get 3 months visa to stay , after 3 months he has to returned to his home counrty (india ) then again he could not go to US for 6 months , bottomline is he has to stay in india back for double the period he stayed in USA on his last visit .

    No. The immigration officer at the POE can alter the amount of time the visitor visa is valid and can even revoke it. Once a person leaves the US upon expiration of the visa, there is no set time as to when that person can apply for another. The local US Embassy will have a record of all visas issued and may determine that someone visits the US too much and is more like an illegal resident than a visitor.

    yes, for eg. if i have 10 years visitor visa , first time i visit USA and at POE they grant me stay for 6 moths , after 6 months i returned to my home country that is india , next before going to USA (since i have 10 years visa ) do i need to stay in my home country atleast 12 months ( double the period of my last stay in USA ) is it true ?.

    one of my friend has got immigration visa , his petition was under F4 catagory which his sister in law has filed for his wife , so he is moving to USA with his family, his only concern is his father , since he is the only chield of his father , he is worried about him keeping him alone in india, my question is :- is there any other way he can take his father with him , if his father gets visitor visa for 10 years , he is ready to do that , his father has sufficent ties with india to prove that he will come back after his visa period is over .. why he want 10 years visa because he can visit his son in USA whenever he willing to do so, is there any other way .. please suggest

    i am a citizen of india and my case is as under

    my mother has filed my petition under Family based immigration category F3 in Feb 2005 , Earlier to this

    my mother went to USA on F4 visa which her brother had filed in 1986 and she got her visa in Dec 98 , i was also included in that petition and so i had submitted my finger prints and other document with my mother , but when my mother had received her visa call in Oct98 i had just completed 21 years and 1day so i was not included in that Visa interview call and i could not appeared for the visa interview , after that i got married in india and my mother went to USA in Feb 99 , she become USA citizen in 2005 and filed my petition under F3 including my husband and my 2 children ,

    my question is since in Oct 98 i just missed my VISA interview due to i was 21 year older by one day and i had finished finger print submission also , can i request for the faster processing of my F3 petition which is filed by my mother in Feb 2005 ?

    if so , what is the process for the same and what kind of documents i have to submit to prioritized my case .

    anybody know any process please advice

    The new petition for you can not retain the prior priority date. You did not qualify in 1998. That's the end of that petition for you. You have a new petition for you in 2005 and that is now your priority date. Sorry.

    yes aaron2020 , you are right but is it any way i can request USIC to accelerate the processing of my Nov 05 F3 petition , since i just missed earlier in petition due to ageout

  7. can anyone give idea about what is priority date and cut of date , as per visa bulletin for may 09 , cut of date for F3 india is Sept 2000 , does it mean that only those cases filed on or before sept. 2000 have been issued visas ? because one of my friend whose father had filed his petition under F3 in jan 2001 had received visa call in march 09, she gave her visa interview at bombay consulte office and she has got the visa. so i am little confused with the logic of priority date and cut of date. please anyone can explain

  8. why F3 catagory is not moving ? anyone can give idea

    Currently only 23,400 visas are allocated annually for the F3 category. There are probably 200,000 people waiting for visas in this category. During good economic times, more people apply for their kids; the US economy was really strong from 1998-2001. Also the number of visas allocated each year has not increased since at least 2003 (may be longer, I could only find info for the 2003 bulletins). This creates a backlog so the PD does not move in sync with the calender. Too much demand + limited supply = longer waiting time and a slow movement in the F3 category.

    my mother has filled my petition under family F3 catagory in Nov 2004 , and they received I-797

    (1) i have not received any communication from USIC to directly me in india , now it is almost 4.5 years how can i know the status of my case ? my friend whose case is the same but his petition was filled in jan 07 has got NVC number to his residence in india .

    (2) dose USIC has alloted my NVC case numer ? if so from where i can get that number

    anyone please help me
