  1. Wow. I cannot believe that.

You need to contact your higher ups and find out why this happened.

It just doesn't seem right. Have you found any other forums posting about something like this?

You need to narrow it down to K1's being refused at NVC because all the ones I have seen stay no longer than a week.

What did they tell you on the phone at NVC?

they wont tell us anything they just say wait for the letter from uscis which will take prolly 2 weeks..the wont tell the lawyer anything either. i already chewed out my fiance for not contacing the congressman again. by law in their own manuals it says they have 3 days to give a congressional inquiry an answer.

i have spent the entire morning scouring the foreign affairs manual, abjudicators manual and any thing else that i could find.

the only thing i found was that nvc can issue rfe's. but those are usually for CR1. and considering how many times in the last two weeks i've called nvc..their is no excuse for them not to say anything or request anything. they did not have to send the file back to california.

what i'm worried about is the fact that the ombudsmans report dated june 30 2009 states that CSC does not reabjudicate petitions. they let them expire. which is prolly why VSC is always backed up..they do reabjudicate them.

which means..i'm screwed. My fiance cannot apply for another petition..or refile, or get married while this one is active, and if we do it would require a waiver of some sort, and from what i've read those are hard to get depending on what you are asking for.

but first things first..we have to know why it was refused at Nvc.

Visa in hand as of today.. POE on the 12th of September.. O'Hare airport.

I need some Oxygen :-) Thank You VJ

    congrats Vegabond.

Sorry to hear about what is going on with your case that's bizarre ! Have you contacted the Embassy in Canada? Perhaps they have your case there. Either way please don't panic until you receive something in writing as to what's wrong if any. Hang in there in the end things will work out. Worst case just get married and file for a AOS rather than going through K1 process again. Best of luck

  2. OMG OMG OMG! (Part 2)

    NOA2 received!!!!!

Online system still says "pending" after 3 touches (and I never got an email from the system...I know it was touched only because I checked about every 4 hours!), but I have the NOA2 letter in my (shaking) hands.

I'm sure it's just coincidence that our file was sent for background checks in June but just happened to be approved 3 days after USCIS was contacted by my Congressman's aide! :bonk:

Thank you all for your support, and for any other Marchers who haven't gotten an NOA2....contact that Congressman!

Not everyone does get a touch. my case went over 4 months without one. some ppl have been married for a year and their case still says "pending" online. unfortunately their online system leaves something to be desired :(

Congratulations :) Finally! I am real happy for you and wish you best of luck the rest of the way! It's hard to believe that not all the Marchies have been approved by now. You all need to call and press your Representatives to follow up on your cases. Either way best of luck!

  3. OMG OMG OMG OMG OMG OMG

  4. I just called the NVC and they sent our case to the London embassy yesterday (August 4th)! If you're a 7-22 NOA2 like we were and you haven't called in the past couple days, you might want to give it a shot.

    Thanks for the update,

I called NVC a few minutes ago as well and they told me they sent our case to the Embassy today (August 5th). I wish for a speedy approval for the rest of the March filers.

    Rob

We have a 7/20 NOA2 and ours is still lounging around at NVC.

I just called the NVC and they sent our case to the Frankfurt embassy 07.31 (our NOA date is 07.20).

Fantastic :) Now we need to wait for the interview date to be granted !

  5. Well....

The senator called on Wed the 5th.

Got a touch today for the 5th.

Checked the website at noon to see the touch.

    Checked just now...

    AND GOT APPROVED!!!!!

    For all those still waiting.

    Contact your congressman or senators.

    Now to update my timeline

and start praying for the rest of you.

    Hang in there.

Good for you I am real happy for you best of luck the rest of the journey. To other March filers we all wish you luck and encourage you to actively push for your cases through proper channels.

  7. Well, so far nothing at NVC. I called them yesterday, and they haven't received our case yet.

Still keeping my fingers crossed and hoping for not too much AP when our file does arrive.

Any news from fellow March 2009 filers?

    --BaWa

I called NVC yesterday as well they don't have our case either. I'll try them again tomorrow and will post if there was a change.

    Rob

  8. I called the NVC on friday to see if they had my petition and they didn't have the case number in their system. Do they send you a physical letter when they forward the petition to the consulate or is it all electronic or phone calls?

Same here I called NVC on Friday as well and they didn't have our case either. My NOA2 date same as yours and I have not received and email ad our case is still pending online yet I have the hard copy of the NOA2. I'll update if situation changes.

  9. we have a lawyer ( ya i know wasn't my choice..grr) and the congressman was already asked...and i think uscis lost our paperwork but just won't give anythign to anyone in writing stating that...and no matter what options david chooses he gets bounced from real people to the automated machien so he cna't even ask if we are in some sort of ap. :(

we got our NOA2 a week after replying to the RFE :D am soo happy

Congrats..at least some ppl at CSC are working on cases still.

Sorry to hear that but there is always a silver lining I sure your case will be found and approved soon. It's hard to believe that they would lose a case. It maybe misplaced but most likely not lost. Anyway I wish you guys the best of luck and hope for speedy approval.

we got our NOA2 a week after replying to the RFE :D am soo happy

    Congratulations :)

  10. sarah's NOA2 just showed up in my mailbox! it was actually approved 7/22 but i never got any e-mails or anything, only the paper notice. i am literally crying with happiness, the worst is finally over!

I never got an email either!

    Congratulations on your approval

I didn't get an email either actually when I go to USCIS website and check the status it still says pending yet I received a hard copy of NOA2 in the mail on Sat 7/25 with approval date of 7/22. Is your case status online updated or is it still pending?

  11. We just got our NOA2 in e-mail!!!!! :energy::wub::dance:

    Application Type: I129F , PETITION FOR FIANCE(E)

    Current Status: Approval notice sent.

On July 2, 2009, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E). Please follow any instructions on the notice. If you move before you receive the notice, call customer service.

I could scarcely breathe whilst I was reading that email. I'm so excited!!

Congratulations on your approval we wish you much luck the rest of this journey!!!

  14. got another touch and an RFE :crying: :crying: :(

Sorry about the RFE I guess the silver lining is that your case is not lost and as soon as you send in the requested information they'll approve your case right away. I have heard from many individuals that their applications have been approved within a week of submitting the requested evidence. As soon as you send them the evidence you get a touch and the status will say they received the evidence and in a matter of a day or two you get an approval if the evidence was sufficient of course. Best of luck we all are pulling for you two.

  15. I feel upset... I feel guilty.

I feel like if I had assembled the package better I would have NOA2 by now.

I really do feel like crying. I researched the visas for 2 years but then when it was time to put together the petition, I did it when i was in the UK visiting my fiance and I wanted to finish it fast so I could spend time with him... I wanted to finish it fast so I could mail it off fast when I got back to the USA... maybe I just made such a weak petition I slowed everything down

Normally I feel pretty positive but today I just feel like crying. I feel like a failure, like according to this USCIS measurement system of "how much you love your fiance and how real it is" I failed and didn't put ENOUGH. It's hard to explain. I see people getting approved and it's like oh THEY did something right that I didn't. But it's not fair, it's not like my love is any less because I messed up a tiny bit of paperwork or didn't put enough pictures...

That was my venting for the day :)

I think we all have had those days, where we thought we forgot something really important in our petition. I am sure you did good. There are not even a handfull of people who have gotton approved who have a similar timeline to yours. If it helps you, you could let us know what you put in your petiton as proof of relationship and I am sure we will reassure you that you did the right thing.

    I put in our petition:

passport stamps of joint visit to croatia, his boarding pass of this trip

invitation to the wedding in Croatia

copy of my visa to the US

(for example I could have copied my ticket to Kansas City from 2007 and for some reason I didn't think of that.... :bonk: ore maybe I didn't have it anymore....see now I am all confused)

application we both signed for a dog, which he now has

    Christmas cards addressed to us

email between me and his cousin before our feb vacation to florida, I mentioned my guy in the email

group pictures of our florida trip 2008,2009 (his whole family has made this trip a tradition and I have been there all three occasions)

three more pics, one of us with a little Jayhawk on my cheek. I am hoping for a KU fan among the USCIS people, the picture was taken during the parade of the Jayhawks after their National Championship in 2008....Rock Chalk Jayhawk!

and I think that was about it. Of the two years they want to see proof for I was mostly in the US. You would think I had a lot of evidence but when you can see each other you don't have to write emails or talk on the phone or travel to see each other.

Also I have been to the US about ten time and every time except twice I landed in Kansas City. Not sure that helps to prove anything. I t really weired though that our whole relationship I had to proof that I will leave the US every time I entered and now I have to sort of prove the opposite. That's life.

when a lot of approvals came, I thought, what if everybody gets approved and mine takes forever. Then I threw this thought away, cause there's no reason to make my life more complicated than it already is.

    I hope I could help you emmaline_g.

Btw my soon to be sister in law asked me if I want to run a 1/2 marathon with her. At least I got something I can work on while waiting and a date I can look foreward to. It is October 17th. I better be in KC by then.

Alright my post is getting way too long. Have a great day everyone and lots of approvals....

    Hello there,

How you put your application together has nothing to do with how fast it's processed don't feel guilty even a bit. If your application is incomplete or missing some proof or evidence you'll get a RFE in it it will ask you to send in any specific proof or document. Until such time you need to wait. We all are in the same situation so there's no need to get upset or start to panic. Please be patient and keep your hopes high as it's matter of days before you'll hear something.

    Rob

  16. Oh no worries, I wont abandon you guys. I'm pretty much all prepared for the consulate phase, the only thing is waiting on my interview now....looks like my consulate is taking about 3 months to get you an interview from when they get your P3...pretty horrible. I'm hoping I can request an earlier date cuz of not working.

Congratulations to you Steph and of course Wes, we are happy for you hopefully the rest of us will get our approvals soon!! best of luck the rest of the way!

  17. Go read through the timeline thing on here, you're going to need to get the financial stuff for her next, and she will have to fill out the packet 3 forms, which I believe she can DL from her consulates website to give her a headstart, that way when her Packet 3 checklist arrives she can just mail it back.

Um...er...hehehehe..I am the USC...John is the foreign fiance.

-Blu_(THANK YOU FOR THE INFO THOUGH!!!)

lol oops my bad! Same thing only with hims instead of hers lol. If you need help with the paperwork let me know, I have a lot of ours filled out already for when NOA2 finally comes.

Congratulations to Lore & Oscar also Blu I'm happy for you guys best of luck during the rest of the process! Looks like CSC is starting to get back on track. We are keeping our hopes high

  18. Hello to all and a big welcome to all of the new members that have recently joined our topic group. I'm afraid there's not much good news to share as there is still a big backlog of I-129f's to be worked out. Apparently they have put us on the side for time being and they are working on other types of petitions. I have checked our status online there is no changes and no touches either. Still keeping my fingers crossed for the day that they start working on our cases. Lets hang in there and hope for the best.
