My brother USC applied via i-130 for me in 2004 we have not received a NOA i-797 and have made several calls using the 800 number for a status check and we were told that they see his name on the system but not much anything else have been advised that we should reapply and they will use his SSN to link the old application with the new one in order to expedite the application as it seems that the file is lost . I am frustrated as he thinks it is best to reapply but I am skeptical as to losing my previous priority date .

Hi VJ family just need some advice I am resident in the Caribbean and my brother has filed i-130 an application was filed for both my mom and I a NOA1 was never received that was about 8 years ago .... then 4 years ago my mom was ill and died yet another application was sent for myself alone no NOA 1 was received. I questioned him about whether or not he got anything in the mail nothing was received so we started investigating two years ago the USCIS CSR took his SSR# and asked for details we were advised that she sees his record but is unable to see any other information ( could not give a Receipt # or any details ) this week we called and asked for a supervisor (gave SSN# and two previous dates of applications ) after three hours we were told that the record says active/closed and that we should reapply Please advise as to how to proceed ......... I have also gotten married now and we were advised that this is a status change and again we should reapply.

    My issue is that if we reapply the previous application dates would not be retained and that my 8 year wait is cancelled and the application date would read 2009 .. Mr brother is trusting the supervisors advise to reapply and attach a letter and copies of previous applications and pay the 355 again

    Please help

Hi just wanted to get some advice several 1-30 petitions were filed by my sibling at the vermont service centre a letter was received indicating that the application was received and is beng processed that's about four years ago called USCIS help line and the customer service rep indicated that the petitioners name was visible but no information could be given ...... I'm wondering how come we have not received a NOA1 and how long this usually takes all calls to USCIS proved futile and we were told to reapply .... Help needed

    Were the fees paid? Accepted by USCIS? Are there canceled checks? There should be some paper trail to follow.

    Reapplying may be easy but I would think its expensive & you would lose those 4 years.

    Yes more than one application was filed for the same person, yes fees were paid every single time by money Order, and copies of all the applications were kept , what should he do go to field office , send letter, schedule an infopass appt, call USCIS again??? that's the question what is the best thing to do from here .......... I'm frustrated we're in two different locations so I can't physically see the paperwork .............

    Honestly I have not seen the letter by my brother has indicated that the letter has no receipt or tracking information just says application received and is being processed i'm very frustrated we have sent more than one application within the past nine years and USCIS customer service rep says send another application it will reactivate the first petition is this true ?????

  6. You need to confirm with USCIS that a I-130 petition was actually filed in 2004. Your brother should have received a noticed from USCIS confirming receipt of the petition. If USCIS does not have a record of this, there is no way you can claim a 2004 priority date.

    Sending in another petition will not get you a 2004 priority date if USCIS has no record of the previous petition. Having copies of the original petition may help but it is not proof that it was submitted.

    I spoke with my brother and he said yes he received some correspondence after having sent the application but it has no file number or receipt number that we could use for tracking and we contacted USCIS customer service who said they see his name on the system other than that no other infor available ... how do we track from here the status of the application .. he was thinking about going to his field office whith documents is this recommended .....

I'm from the Caribbean and my brother who is a US citizen filed an i-130 in 2004 on my behalf at this time we have received no further updates on the application no NOA 1 or case number, the USCIS customer Service phoneline was contacted and they asked for his SS number they were able to "access his name" but claimed that they could see no other information .... should another application be sent.. what should we do from here ??

    another or new application does not solve your problem... it would only re-start the 10 year wait ...

    The USCIS representative on the phone should be able to give you a case #... that is what you need

    That is what I thought but they said no just send another application and the priority date would be from the first application date ... if USCIS isn't assisting much where else should we contact .. we have have applications before 2005 also frustrating

    Thanks for the information next week we will try to see if we get more information and I wasn't clear to yur last response
