  1. For visa purposes, NVC will hang on to it for up to one year. For adjustment of status purposes with the USCIS (from K-3) you are fine.

    So my understanding is that once she was approved for the K3 we have 2 years to adjust status? Even though her I 130 was approved 11 months ago?

  2. OK, I filed the I 130 over a year ago, and it was approved. After that I filed the I 29F and was approved and my wife is now in the US on a K3 visa. So my question is, does the I 130 expire? We havent even begun the process to adjust status yet, but my wife seems to think that her I 130 expires next month. Is this true?

  3. Oh - I wouldn't posit that, at all - even that is just too harsh.

    But you know what? You've gotten prior topics here, same subject, with some responses. If I was doing it, 2 months past the last topic, I'd go back to it, and post something new in the same topic, maybe even telling the prior posters what I learned, what the results were from any immigration attornies that I visited with, any research at the divorce court in my town, etc etc and then ask again for MORE INPUT.

    My apologies if I seemed harsh about it -it was one of those 'serious spit-takes' after reading yer new topic - I had to think - wait a mo, he got answers before, even I put up some stuff in that topic, and now he's asking again? #######?

    But it's ok - come on - don't have such a strong reaction to ME, personally - I'm just sitting here at my keyboard, same as you. If we were sitting in a pub, knocking back a few, I'd be mapping this out for you on greenbar paper with blue crayon, then grabbing the yellow pages and finding a bulldog lawyer for ya, maybe even fronting the calls to vette all the lawyers I'd be talking to .. But, and alas, we're not at a pub, there's just that keyboard.

    Two months have passed, and it smells like yer still in the planning stage. IMO, that's about 6 weeks too long.

    Youre right, and I appologize. The reason Im still asking for advice is I guess I dont want to face reality and start the whole divorce process. I gave it another 2 months to see if it was going to work, but finally realised that it is over.

  4. Was she your wife at that time, then you can't sue your wife for taking care of her. If it was or is a scam then you need to think about the end rather than what you can get back from what was spent.

    You'll have a child together, so you will always be giving some kind of support to your wife for the care of the child.

    You need to talk to a lawyer, I am sorry for the hurt you are feeling right now but there is no refund of any kind, you can't sue your wife. That would be like suing yourself, finance gain and spent in a marriage belongs to the both of you.

    Let me explain one more time...This person is a fraud. Screwed me out of thousands of dollars! Told me she loved me and would spend the rest of her life with me. Spent hours gathering information for interviews, doctors appointments, travels etc.... All for her to come to the United States. Now she is here,( 4 months now ) and wants a divorce? So I basicly funded her trip to the US. And Im not entitled to ask for any of that money back?

    WOW! I didnt know that it was an issue to reopen a topic....I guess I will listen to you and not ask for advice anymore. I just thought maybe there were some new people that joined that maybe had better advice then just get an attorney...obviously I will need an attorney. Im trying to find out if anyone has gone through this or knows of someone that maybe could help...........but I guess this is the wrong place

    will you take mother away from your little daughter? have you considered how it would affect her life and how much she would hate you when she grows up and how she would leave you as soon as she turns 16? You can't act selfish when it comes to your children and not expect to face the consequences.

    on the other hand, custody may be granted to your wife, or her parents for that matter. If you are confrontational, they may do the same to you.

    Good luck though. You need a divorce lawyer, a good one.

    Why does everyone always side with the mother during custody issues! Im in my daughters life way more then she is. Just because she carried her for nine months doesnt make her a mother. Im not taking anyone away from anybody....this is HER choice! I didnt choose to screw someone over! She should of thought about that before bringing someone into this world. Grant her parents custody...are you kidding me? They cant even take care of themselves.

  7. First, seek the advise of a divorce lawyer....... Second, donot sign any more papers until you are sure what it is you want from your marriage. Third, you can not get a refund from expenses you spent on courting your wife.

    Im not asking for money spent while we were dating. Im asking if I can sue for money spent for processing her paperwork. In my eyes this was a scam, and I spent alot of money the last 2 years bringing her here.

  8. Ive brought this topic to discussion a couple of times, but need to reopen it due to alot of changes. My wife and I have been married for almost 2 years now. We have a beautiful baby girl who is almost 2 years old. We just came back from Peru after waiting there for her K3 visa to be approved. We arrived in the states in December. Her parents and sister also live in the US. She thought because this is a new country that it would be better for her to move closer to her parents, and get adjusted that way. Well that hasnt helped us at all.( Spends all her time with her parents ) Now she wants a divorce. She hasnt adjusted status yet. I try to explain to her if we divorce then she will have to leave. She then says that we should just seperate and adjust her status and then when its approved get divorced. First of all Im not going to do that. Im done throwing money away. My main concern is the kid. I want to get divorced now, but what will happen to the kid. I dont want her to leave! She is my life! If my wife takes her I back to Peru then I know I will never see her. The child has dual nationality. So what are my rights? Can she stay with me? Also when I file for divorce, can I sue her for all the money spent on the petition? Plane tickets etc....

  9. Her total family is here. She isnt missing anyone. She spends all day and night with them. I dont ever see her. And the baby is 18 months old. She just doesnt want to be with me I guess

    Ok my wife and I took the long journey ( 2 years ) getting the K3 visa for her to come here. We have a beautiful baby daughter together. Everything was great. No problems. Now a soon as she got to the states ( less than 2 months ) she now wants a divorce. I dont get it. She wont explain herself. So now what? I mean the whole process. What happens with her visa? Does she have to return to Peru? We have a child! Please if anyone knows what would happen to my wife if we get divorced can you please tell me

    I'm ready to send my affidavit but I still have a question regarding my husband's taxes. In 2007 he did not file taxes for 2006 because he was in school and he only made $1000 when he worked for a couple of months at Fridays. He was also a dependent and his mom claimed him. So what kind of letter should he write for the I-864. The I-864 says: A copy of your individual Federal income tax return, including W-2s for the most recent tax year, or a statementand/or evidence describing why you were not required to file. Has anyone ever written one of these letters?? Thank you in advance!

    I sent my affidavate of support to my wife with the tax years 2007, 2006, 2005....I didnt file in 2008 because I was in Peru the whole year. At the interview the guy just looked at my 2007, and used that for my income. Then asked if I was working now. I said yes, and that was then end of it.

    There's a packet they should be mailing her with documents she needs to fill out. I would call the embassy back and see if she can go and pick the packet up, my husband did that. The mail system is horrible and he didn't get the packet until after he had the interview.

    I'm not too familiar with the K3 visa interview, we did a K1 ... but the packet should have all the instructions in it.

  13. Ok, so it has been July since the k3 application was approved, so I decided to call the NVC and they told me that all the info was sent to the embassy on August 17th. So I called the emabassy iin Peru, and they told me my wife had an appointment for September 22! So of course I freaked out a little. Anyway the lady was really nice and asked me if my wife was ready for the interview. I said yes. So she rescheduled right over the phone. So now the new date is the 20th of this month. What does she need to take with her? Please URGENT!!!

    IV fee is NOT for K-3 but for IR/CR visa... are you sure what visa you want?

    What do you mean? I already applied for the K3 visa, and now my spouse has recieved this info by email. Saying that the AOS fee and the IV fee need to be paid. How do I find out what visa this is?

    The K-3 visa fee is paid at the consulate... the CR1/IR1 visa is paid to NVC... If you want the K-3 then ignore all the inquiries from NVC

  16. Ok I just recieved a notice that my wife's petetion for the K3 visa was approved. She will now have the interview at the embassy. My question is what do I need to show to prove that I can support her. I lived in Peru all of 2008, so I wouldnt have filed any taxes for last year. I did file for 2007, 2006, and so on. I made well over the poverty line requirements. But I just dont have the tax forms from last year. How bad will that look?
