I actually had to do some work these past couple of days so I have been away from VJ. Well you know can’t stay for too long. I left at p110, nothing going on over the weekend so I thought no worries, I’ll catch up. Here it is only Tues and I’m 30 pgs behind. Soooo what’s been going on???

I got a lot of catchin’ up to do but I wanted to stop and extend my condolences – Awakening_1. (Yes my condolences). This BASATRD might as well be….. with you planning a ……. it might just be…….MMMMAAAAANNN!!!!!!! I am in tears fuming with hurt and anger. Wakey, I’m still new here so I don’t know you much beyond your recent posts, but I have experienced your situation to some extent. I wasn’t married so I know I can’t completely relate. But, I remember when I was in undergrad (not even two weeks into the semester) and got a call that some female showed up at my man’s parents door talking bout she was preggo for him. His mother didn’t know what was going on ‘cause she never even seen the girl around so she called me ‘cause he was in jail and I was the only one on his visiting list that could get in to see him to get to the bottom of things. (phew!) (Yeah I know, likely story and I dealt with that later but that’s a bit beside the point right now.) I just remember how my heart sunk and the betrayal I felt. All I could do was fall to the floor and cry from the pain. Today reading your post I felt a moment of that pain again and I am so sorry you have had to experience this. It took a lot for me to get over it but sad to say it wasn’t the only time. The only thing is that when it happened the next two times (different guys, but yes two more times…all US born and raised, these fcuckin men) I was much stronger and less devastated and completely certain that the problem wasn’t my own, it was theirs. They now had to deal with their situation and the child they created in the mist. I believe that when you too have overcome the hurt, you will be stronger for it. A lot easier said then done. I pray that your healing is reached quickly.

ladies, I would be careful about how you'll throw around the word sole custody. Sole custody does not take away a parent right. I don't know any one's situation, but I think some of you are confusing sole custody with physical custody. I am not stating any of this to start a diagreement with anything that has been said on previous post, but as I sit here reading some of these comments, I just felt it was necessary to state this fact. A father, and mother have equal responsibility and rights regarding their child, unless they have SIGNED that right away. So, yes a Parent (father or mother) with the other only having physical custody, can refuse to grant permission for their child to leave their birth country.

This is true just having/proving physical custody would not work for me. They were very insistent that I had to have a court order showing that I had sole legal custody, which is why they required the official copy with the seal. I was lucky in that I knew I already had this so all I had to do was go get the official copy. If I did not I was informed that I would have had to go through the courts to have this established otherwise there was nothing they could do. Very frustrating, but there was also hope in that under the circumstances I could have requested an expedited hearing and had the matter settled in time for my vaca which was just under 3wks off.

Yeah, you sure can fight it. I had to go through this with my oldest daughter. I have sole legal custody but I did not have an official copy of the court order. The copy I had did not have the seal so I had to go to the court clerk and pay to get the official copy with the seal. Once I had that in hand and showed it to them they process it right away. They had been holding her passport so I was able to get it from them that same day. The only thing they did question as to whether I had tried to obtain his signature and they wanted to document my response with the application but I had already completed that section where it asked for an explanation if signature cannot be obtained. She read that, made a few red marks but everything was fine.

Get a Checking account with State Farm Bank, they are an online only bank.

Now you have two options:

Option 1:

Easiest, ask them two issue to DEBIT cards in your name. They will and each will have a unique number. Don't activate one and mail it to her in a birthday/holiday card.

Once she receives it go ahead and activate it then give her the PIN.

Tell State Farm Bank that one of the cards is for use in the Philippines so they don't block her withdrawls.

Option 2:

Add her as a joint to your account. This will require a W-8BEN and some work on your part plus you will have to explain to them that she can't be authenticated yet as she's not in the US. It's more work but worth it to have a joint account in the US (demonstrates comingling of financials).

Now have them issue both of you DEBIT Cards, they'll mail them to your US address. Don't active her's, mail it in the card.

Once she receives it you need to make a 3 way call with her on the line to State Farm Bank (man I love MagicJack), explain that she can't be authenticated bah blah, a little work, they'll see the notes, blah blah... The rep will agree to activate the card and she can customize the pin.

Why is State Farm Better than your bank down the street? Well they refund 100% of the ATM Fees! Since they are an Internet only bank they acknowledge your only access to cash is the ATM and refund the fees.

So there you go, Free money Transfer to PH for US!

BTW, wake a note of the card number before you sen it to her, just incase it's lost stolen or "something else" happens so you can easily cancel it.

I have never dealt with State Farm Bank do you know of any country restrictions with this account type, I would love to try it. I knew about sharing the Debit card account which saves but still the intn'l transaction fees really do add up.

I saw this in another post and thought parts might be relevant here. It seems that things may not have been personal and you were going to receive a denial regardless of the legitimacy of your own marriage. Even when taking into consideration that your husband intentions with wife #1 were genuine and there was no fraud on his behalf, there still remains the fact that he fell out of status and thus remained in this country illegally. Your marriage does not change that.

Looking at the direction you are taking it seems there may be a chance for him if the abuse allegations against wife #1 are proven. Perhaps if this is the case and your husband was honestly ignorant of the law (though not an excuse) maybe the court will sympathize and believe him to be innocent though negligent. Maybe this is the approach your atty is trying to take by having you obtain the multiple statements on the sincerity of their relationship and her criminal record. (Don’t know) The only thing I can’t see is how conspiracy got into it. That usually involves multiple perpetrators otherwise it’s just intent. So if it was not your husband involved then who, maybe that is your missing link to clearing things up in your husband’s files.

Long story...well not really. That was my real user name that I have had forever. So out of curiosity I googled it. To my surprise all of my information came up to alot of accounts that I had linked. I mean I used it for everything. With that said, you can see how I freaked out. I started changing all of my accounts to different names so it won't be so easy to get my personal information. I should have known better but I didn't think that your vj profile, ebay profile, paypal, yahoo, etc. are all posted via the serach engines for anyone to find by knowing your user name. (Of course secure site won't allow them access to your account information, but a real hacker can take enough of your profile info and narrow it down enough to do some real damage.) So no chances.
