  1. what I meant it he is approved to file a waiver but I have not done it. as far a the denial I could only think they put this becasue he said he drank on weekends and the psycho is using alcholism to deny him my question is if with the 601 waiver you need to prove hardship automatically or is it based on denial so for me just a medical report with the 601 would be enough?

    Here is the text of 212(a)(1)(A)(iii):

    who is determined (in accordance with regulations prescribed by the Secretary of Health and Human Services in consultation with the Attorney General)-

    (I) to have a physical or mental disorder and behavior associated with the disorder that may pose, or has posed, a threat to the property, safety, or welfare of the alien or others, or

    (II) to have had a physical or mental disorder and a history of behavior associated with the disorder, which behavior has posed a threat to the property, safety, or welfare of the alien or others and which behavior is likely to recur or to lead to other harmful behavior, or

    Basically, this means he either HAS a disorder (subsection I) or HAD a disorder which is likely to recur (subsection II) that poses a threat to himself or others.

    You're going to need to know precisely what disorder the psychiatrist thinks your fiance has before you can address it with evidence and an application for a waiver. You can't just guess that the psychiatrist thinks he's an alcoholic.

    You're going to need to submit a complete medical history and report for your fiance. This report will have to come from a competent medical authority (i.e., a doctor) in Mexico. If you expect to have any chance of success, the report should make it clear that your fiance either doesn't have the disorder which the consulate thinks he has, or that the disorder has been treated and will not likely recur, or that the disorder can easily be treated in the US. But before you do any of this, you need to get a copy of the psychiatrist report that the consulate based their decision on.

    The denial under 212(a)(1)(A)(iii) has nothing to do with any situation where a claim of hardship could be applied. There are no provisions to claim hardship with an I-601 submission. The only thing you need to address is the disorder which the consulate thinks your fiance has.

    thank you for the info I did not know I could get the psychiatrist report how would I do this?

    and about the harship I got it from a paper he was given with his denial where is says to call to make his waiver appt and it says about the harship to the united states citizen this is why I thought I was going to need to prove hardship but after reading the instructions for the I-601 and under that denial it does not state anything about hardship so I was confused :wacko:

    my fiance was denied :crying: his k-1 visa under 212(a)(1)(A)(iii) physical or mental disorder with associated harmful behavior on may 2009 at the cdj consulate and is approved for a waiver my question is if under these denial you need to prove extreme harship anybody else gone through this please help

    I have seen several lawyers but none of them answer my question everywhere I read it does not state anything about extreme harship but I want to make sure before I schedule the appt. :wacko:

    Regarding the payment it was indeed 1900 pesos. It is significantly less now because the dollar now is at 13,50 and a couple of months back got to be around 16.00.

    Either way. Cheers everyone and now I can finally relax.

    Did you also have to pay in pesos? How about for the medical pesos or dolllars?

  5. :dancing: :joy: we just got approved. This is the best feeling ever, no kidding. After all that waiting, I'm so excited. My fiance just got back from his interview and he texts me, "start cleaning the house" :rofl: so that means he was approved YAY!!!

    I know you must be super excited but please if you could post details on his interview expirence it would be super for us wreckballs trying to cope with all the feelings to calm us a bit Please Please ^_^

  6. stress is all I am having these days my fiance is going to his interview this week I just want an answer already so I can relax good thing it is almost here, but for right now I am just going over all the paper work mentally making sure I forgot nothing which I don't know if it is good or bad

    For my affidavit of support I just included this years tax return is that enough? or should I include previous years, How about letter from bank, or employment letter?

    I should really take a deep breath because this cannot be good for me :o

    I sent everything that alfredo would possibly need. taxes for the last 2 years, (since that is all i had filed b/c of my age), and copies of that years w2s, i got a letter from the bank to show assets, and i sent copies of my 3 titles to my vehicles as assets. i also sent a letter showing that alfredo had a job waiting here, and proof of his tax info (from his h2b visas that he had in the past), i pretty much used the exact same stuff for the paperwork i did for AOS, just fill out a different form.

    a new question has come out anybody familiar with I864-A how does it work? I want to know if my sister would fill this one out if I needed her income to qualify? what I don't understand if its going to be our income combined or does she have to qualify on her own. One more thing she has a baby so the household size would be 5 (her, her baby, me, my baby plus fiance) and both our incomes combined would have to be for 5 people? :help: please

    I have a question for you did your fiance take all the original paperwork sent with your 129F including pictures and proof of relationship plus did you sent recent proof for example recent pictures and telephone bills sorry but I am a nutcase right now trying to make all paperwork perfect and not forget nothing :blink: thanks for the help

  10. thank you so much for the fast responses am I suppose to fill out an intent to mary again because I sent one with the original package and if so does it have to be notirazed i know he is suppose to take one for himself not signed but unsure if I also sent one for me one more question he is suppose to take the orginal paper sumitted with the 129-f right plus all the proof of relationship and also include new and updated proof of relationship oh sorry forgot one more are we also suppose to sent the ds-157 because he is a male applicant ok i think thats all well for right now

  11. Hello I have a question on ds-156 on the last part where it asks if someone else prepared the form on the applicants behaf do I put myself the fiance as that person because i am filling out all forms for him and he is not present

  12. Visa Approved!! She entered at 8 a.m. and was out by 11 a.m. Waiting on DHL now. Too excited to type more. Time for a Michelada!!! I'll post a detailed report tomorrow!!!! Thanks for all of the well wishes and best of luck to all that go down this path after us!!!!
