  1. My husband currently resides in Mission B.C. but Vancouver only does the interview for K-3 and we would like to follow the I-130 route to get his visa. If the interview is in Montreal that is about a $1500 round trip ticket for us. My question, I have read that if your spouse is in the US legally you can interview in the US, can you request to interview in the US? My husband comes across the border with a I-94 card and it states the day he came and when he is required to leave, we have always followed this and been honest at the border in all they have asked, never have had a problem. My husband has been coming back and forth for almost 2 years, we have been married for almost a year. Has anyone ever asked for the interview to be in the US?

  2. I need some advice, maybe someone has had the same situation. My husband has been on Canadian pension for the last 4 to 5 years due to an on the job accident, then being diagnosed with cancer. He is in remission now and would be able to work in USA because he is fully functional, Canadian doctors want to keep him on pension because they say he is still somewhat limited. He is also a saddlemaker and does leather repair, this makes him extra income. Anyway my question, what do we list on the employment section? Do we list that he is on pension for an on the job accident or just list employment as none? Listing it as none it seems like he has done nothing for that period of time and has no income, but he does have income from his pension. Just seeking some help from those of you who have been through the process. Thank you

  3. What if you have need to list more on the form than there are lines? On the employment it states you can attach a blank sheet of paper with "Form G325A, Q: Employment last five years" written at the top of it and to note on the form that there is an attachement, can you do the same for former husbands or wives?

  4. I am somewhat confused on the G325A also. It says to include all 4 pages, but what I printed is only 1 page to fill out and 1 page of instructions for a total of 2 pages. Do you send the instruction page with it and how many copies need to be sent with the I130? Where it asks at the bottom of the page "submitted in connection with an application for:" what box do I check? Status as Permanent Resident or Other?

    Thank you for any information. I just don't want to do anything wrong on these forms and have it sent back so I am asking even stupid questions!

    I was just reading on the website of the US Department of State, a link from the US Consulate of the United States - US Consulate Montreal -- The embassy or consulate where you, the spouse of an American citizen, will apply for a K-3 visa must be in the country where your marriage took place.

    So does that mean that my husband, we are getting married July 4, 2009 will have to do his interview and everything associated with the K-3 here in the US? I thought he would be able to do everything in Vancouver, B.C. for the K-3. If he has to do all here in the US then he will just travel back here and do whatever they tell him but we were led to believe it was easier to file for the K-3 because all could be done in Vancouver. If that is not the case then it would be easier to pursue the I-130 and bypass the K-3.

    Can anyone give us insight on this? Thanks to all.

  6. My fiancee and I are getting married July 4, 2009, about 3 months away. He is in BC right now. He will be coming back here in May 2009, we will marry in July and he will go back to BC after we marry. We were told that if he applied for AOS after marriage that he could be sent back to Canada, penalized and not be allowed in the USA for up to 2 years. We don't want to take any chances. It sounds as if the CR1 is the best way to go even with travel to Montreal but everyone seems to have a different take on the CR1 and K3. I have gotten answers that say K3 is much faster and better way to go and others say CR1 is faster than K3 and better. Right now I am really confused!! Just want to do things the right way so we don't get into any trouble or penalized or denied! If going the K3 route and paying some extra to do the AOS that is fine if the K3 will be faster than the CR1. Since I have never done this before, I was simply trying to get some info from those of you who have. Thank you everyone for any and all information.

    I'm a little unsure of your current situation right now though, unless I'm reading it wrong. You married July 4th in California and your husband is still with you and hasn't returned to BC? Or you ARE getting married this July? Sorry, I just had a hard time understanding the circumstances.

    Another option, if he's just visiting now, and had no intention of marrying upon his arrival to see you, would be to marry now and adjust status while he's here as well. Move up the wedding and start the process now if this is the case. It's all about intent. If he didn't intend to come to visit and you getting married was a spur of the moment decision, then you can adjust his status after marriage while he's visiting.

    I wanted to get some information from those of you who have went through the process in Canada to immigrate to USA. My fiancee and I are marrying on July 4 in California, he will be going back to BC until we have the ok for him to move here. My question is what has worked the best for those of you in Canada, the I-130 or the K-3? If we do the K-3 he can do all in Vancouver but then we have to pay the extra $1010 for adustment, if we stick with the I-130 he must interview in Montreal which is about $800 for flight. We would love to hear from any of you and your experiences. Thank you.

  8. So he can file the K-3 in BC? I thought we had to file the K-3 in California because of being married in Calif. If he can file the k-3 himself and get the interview in Vancouver that would be much easier, also cutting down the time frame is really important to us. I guess it is to everyone trying to get their loved ones here. Thank you for taking the time to reply and all the helpful information! It seems a bit overwhelming at first but getting information I am starting to feel less overwhelmed. Once again thank you.

    You would file the I-130 with a lockbox address in Chicago, followed by the I-129F at the service center where your I-130 gets transferred. Depending on where you live, that would be California or Vermont. Since he's from BC, K3 will actually save three or more months because the interview can be in Vancouver instead of Montreal. However, K3 is not work authorized, so if working within 4 months is important, take the CR1 route. There is no filing fee for the I-129F when an I-130 is filed. The difference in cost comes later when you pay $1010 to adjust status from the K3.

    This page does a good job of laying out when fees are paid. Use the fiance visa example for K3. The difference is the initial filing fee is $100 less because you file an I-130 instead.

    Generally, the answer given is what I would say, with a primary exception being beneficiaries who live in the Vancouver Consular district. In that case, the K3 is much faster AFTER petition approval than the CR1 route, since THEY all go through Montreal.

    In what part of Canada does your fiance reside?

    My fiancee lives in British Columbia so Vancouver is only a 45 minute drive for him. We had heard the CR1 would require going to Montreal and that the wait times could be long.

  13. Is there a lot of difference with regards to the time period it takes to get a K3, as compared with K1?

    Based on visajourney timeline K1 is faster than K3 by atleast 3-4 months. Is that true ???

    So is it better to simply file the I-130 and not bother with the K-3? We are to be married in July and my husband will be immigrating from Canada. We would like to have the fastest way possible of course but also not have to pay excess fees if it will not make the wait any quicker. He is an Australian citizen with permanent residency in Canada, do you think that will hold anything up? We have received many different answers from several immigration sites and are somewhat confused. I know as soon as we are married we will file the I-130, just wondering if we really need to file for the K-3. Thank you.
