hello! Just curious about this case and what has happened so far. Is everything going alright after the confusion? I am also about to submit a concurrent i130 and i485 for my mother who is here in the US at the moment. I was thinking of going ahead and filing the i130 first just to get the process started and then submit the I485 when she has completed the I693 with civil surgeon. After reading this case though I dont think filing separately is a good idea anymore.

hello! I am about to file an I130 with I485 for my mom (concurrent filing). She entered the US early this year as B1/B2. She was given 6 months to stay.
Some questions:
1. Is there a need to apply for an extension of her stay while waiting for her greencard process?
2. Is this the correct place to send concurrent filing?

Hello! I am petitioning my mom and filing concurrently (I130 and I485). She is currently here in the US and entered on B1/B2. I am a USC and will be petitioning her. I just wanted to ask which box she should check for Part 2 of I485. There is no box saying that "I am the parent of a USC..." Is it Box A or Box H (Other basis of eligibility)?

A few questions about this process:
Once a parent of a US citizen is in the process of adjusting status from B2 to green card (submitted I130 and I485) while in the US, does this cancel their current (10 year) B2 visa?
In connection to this, are they allowed to travel outside the US and return using the B2 visa while I130 and I485 are being processed?

The requirement to live in the state or district is written into the law in INA 316(a). Only Congress gets to change it. Because Congress wrote it into the law clearly, no officer is going to have the authority to be lenient on that requirement. The requirement is repeated in 8 CFR 316.2(a)(5).
I'm not sure exactly what would happen if you filed before meeting that requirement. The application might be rejected right away. My guess is that it is more likely to be caught and rejected at the interview stage. A worse outcome would be if the interviewer made a mistake and didn't catch it, and you got through and took the oath, and then were later retroactively administratively denaturalized for not having met that requirement.

What can happn if one applies earlier than 3 months? Has anyone experienced this?
Also, where can I find out about which USCIS district a person belongs to? From what I understand from the above rule, a person can move to a neighboring state and still belong to the same USCIS district and therefore still apply even if he/she has not lived there for 3 months...

I applied for student loans (FAFSA) this week and received an email saying that there were some problems with my application. One issue was regarding my not registering for selective service. I entered the US in 2006 and I was already 31 so i did not have to register with selective service. I will have to call them to clear this up but I just wanted to find out if maybe anyone else has encountered this problem and can share their experience. Thanks!

How long after the oath can I get a new social security card (One that does not have the not valid to work without DHS authorization written) and a passport? What documents have to be brought?

It all depends on how current or backed up the Oath schedule for your District Office is.
Got my letter today! Oath taking will be next week June 24, please update on he list. Thanks!
Letter says I need to bring some items like green card, oath letter and "any immigration documents you may have." What documents are these!?!

Nope. She did not say anything in tagalog, so I also did not. I thought maybe theyre not suppose to.

My interview was really easy. The hardest part about it was finding and paying for parking in downtown San Diego.
I was almost an hour early so I had to wait. The waiting room was half filled. The interview started on time and the officer was Filipino. We spoke in English the whole time though and she was polite but serious. The whole interview took about 15-20 mins. The questions were easy:
1. Who wrote the declaration of independence?
2. Who is the commander in chief of the army?
3. What are the major parties in the US?
4. What is the party of the current president?
5. Name a country that borders mexico
6. Name 3 original colonies

I was just wondering if they will ask me to give up my Philippine passport during the interview for citizenship? On the checklist we are required to bring all passports.

Yes the process for the IR-5 (Parents) is the same as it is for the IR-1 (Spouse).
I am filling for my parents as soon as my citizenship is done. One thing you need to look into is the cost of medical insurance for them, it is very expensive and it increases as they age. Also be aware that if they immigrate here they then are not eligible for NHS care in the UK, so they just cant pop back to get treatment they would have to move back to the UK permanently to be able to access NHS care.
I also plan to petition my parents when I get my citizenship. The are in their 60's and will not be able to work full time when they get here. What are their options in terms of health insurance and other benefits? Will they be eligible for medicare? How about SS? Do they need to work to be elgible?

Are there any copies of documents such as tax returns, bills, bank statements, etc...we should send when filing the N400? Just wondering since every other document we have sent in the past seemed to be accompanied by these.

Hi all,
Has anyone experienced having to repeat their Biometrics appointment after a long time and with no explanation why that would be necessary?!
My wife's application at TSC has a Feb. 2007 NOA1 date and we did her Biometrics in March 2007. Her USCIS profile shows a last updated date of March '07 reflecting that some activity happened on her file (however there is no mention that Biometrics was completed).
Last week I got a surprising letter from TSC which was a REPEAT appointment letter for Biometrics! This is almost 11 months since the original appointment! The letter is almost identical to the previous appointment letter with absolutely no mention why this needs to be repeated or if there were any problems with the previous one!
I called customer service and they provided no help, basically reading some standard texts to me and saying that you need to make the 3-hour drive to the USCIS center for your appointment regardless of what has happened to the previous one and there is no way to find out what's going on!
My initial guess was that they had mixed up my N-400 application (which I filed in December '07) and its fingerprinting session with I-751's Biometrics but I was told that is probably not the case by the customer rep!
Has anyone had to repeat their Biometrics and after this long?! I wonder how long this could add to the wait!

Finally I get something from USCIS. And its a biometrics appointment for April 4!?! Why do I have to do another one? Did they lose my data from my last biometrics? What are the reasons for repeat biometrics?

Philippine marriage contract

My parents 1974 Philippine marriage contract from NSO has no signature of civil register. Is this common? Will this be an issue? If so, how do we fix this? I am sponsoring her to be permanent resident.
