  1. My USC spouse and I were married early this year (09) and everything was going great and we loved each other more than ever.

    I was granted CR1 late May this year. We are both in the early 20s.

    I hide the fact that I wasn't doing well in school from her because I was worried I was going to lose her if she knows the truth...I made a poor judgment call that I thought was right at the time. And that is the only thing I hide from her, I have never cheated, violated the laws, etc...

    Anyhow, the roof caved in and the truth came out (my mother-in-law used her job to dig into my past) and now she wanted a divorce. She is shielded by her parents from talking to me and have told me repeatedly that it is over.

    I have tried in the past month trying to talk to her and offer to meet with a counselor, mediator, and is willing to openly talk about what does it meant to both of us. However, she seems to have no interest in the continuance of our relationship...

    I am devastated and I cannot eat, sleep, or do anything besides thinking about her - I want to be a man but it's just I love her so much that I can't seems to be able to move on. My families, priest, and close friends all told me the same thing: "if she cannot stood up for you and caved into her parents, this is bound to happen anyway, she doesn't deserve you" or "marriage is hard if she doesn't want to work it out, it won't work anyway"...but I just want to save our marriage, I just want to make everything right again. Or that she is acting like we are just dating in high school... Everyone wants me to be mad at her but I can't

    I want her to be happy, and I want to take the responsibility of my mistake by working it out and follow through my commitment to her...but she just kept shutting me down.

    She is now saying that they(her parents and her) have met with an immigration attorney and threating me with the removal preceding from USCIS if I don't get a dissolution - but I do not agree with our separation and frankly, I really don't care if I get to stay or not if I cannot spend the rest of my life with her. It hurt so much to know that she has already met with a lawyer...I thought I knew her and I can't even begin to count how many times she have told me in the last 2.5 years that she would never leave me...

    I have couple questions as to the situation

    (1) If we do get a divorce, what do I do with my CR? Do I just leave the country or I should stay to file a waiver?

    (2) The conditional PR card is valid through may of 2011, do I file the waiver then?

    (3)Any suggestions as to what should I do with my situation please do share...

    If filing a waiver would help me to stay and fight to keep our marriage, I am more than willing to stay. I believe that she will realized one day that she is manipulated by her mother - the mother that doesn't even allow her to read Cosmo the magazine.

  3. Lastly, she said, "I'm granting you a permanent residence status, but you need to apply in 2 years to remove condition. I'm going to give you a copy of this paper, but this is the only reminder you're going to get." She then asked us to sign that paper. She also said to me, "I'm stamping your passport now. You'll get your alien registration card in the mail within 6 months."

    Well, including my wife, her friend, and you, this is the third cases I know that took less than 3 months for the CIS to approve.

    USCIS must be on fire lately...I couldn't believe how much they have reduce their processing time. Both my wife and our friend filed AOS on F-1 and they've both been in the U.S. for more than 4 years, what are you adjusting from??

    Regarding with the paper she gave to you (reminder for removing the condition) , do you mind sharing it with us?

    My wife was not approved on the spot, so we weren't inform about the process what-so-ever...

    And the last, 6 MONTHS??? I sure hope that we don't have to wait for another 6 months to get a little not-even-green card?!

    Have patience, we never called or made any InfoPass appt, and in our cases (my wife, and our friends), we had no problems.

  4. So my class mate's husband is going through the same AOS processes that my wife is going through; I filed a petition for my wife and my wife in term filed for AOS, the classmate filed for her husband and her husband field the AOS vice versa.

    Now, this was back in Fedbuary when we field; and as of last week, her husband and her received the welcome letter 2 days after the interview (we receieved the AP/EAD/Interview letter approx the same time).

    I knew he was here on a F-1 visa since 2004-ish and they've been together since 2006?? And he's from Asia i believed.

    I thought the processing timeframe is about 6~18 months varies depend on your local field office (ASC), and my local office (Cincinnati)'s still listed Aug 2008 as their processing time....some body explain to me how the heck does this happen?? I can't believe they went through the whole processes in 3 months???!

    Anyone else having such good luck as well? What's your experience and take on this?

  5. So you know when you submitted AOS, you sent in the I-485 & I-130 together + AP/EAD..etc.

    If you received a notice/email saying "card production ordered" for I-485 but not an approval , and you have yet to hear anything about I-130, what exactly does it mean?

    Is that mean the I-485 is approved?

    --I am getting confused reading other posts on the forum and my buddy's wife just got the email saying her card production has been ordered, but we've got no clue what's that suppose to mean. :wacko:

  6. So my wife got her AP yesterday and we think that they made a mistake.

    They sent us a duplicate original copy of the AP document, I thought we only need one?? What's up with the 2nd one? (btw, they are exactly the same, also has the stamp)

    Checking case status online is worthless...when we check the case number on her AP, it still says " we can't find the case number" &*%^##!! :innocent:

    An advise for you people that's waiting : Chill! Don't worry about the status online, it will all be okay.

    The AP took the MSC about 68 days, may be we will get to see her EAD soon! Does the EAD come in mail or we'll have to pick it up at the field office??

    We recently got married, husband is a US citizen, I have been in the USA for over 4 years, I overstayed my J1 visa ( not a 2 year home residency requirement).

    I am currently working , I have a SNN, and I am paying taxes. I know, you will say : "what???", well, I needed to make a living .

    Now, my husband is currently unemployed and was unemployed in 2008 , too ( he does receive money from his parents, but not a monthly income).

    I make over the poverty line/year. Next week we will visit a lawyer also to help us out with he case.

    Do we need a co-sponsor since I already make the income? even I am not allow to work? I just want to tell the IO the truth: that I did work during my stay here.

    Please do not be mean and judge me, I just want an opinion, personal experience etc.

    I appologize if I posted the q in the wrong place, I am new here.

    Also, do I need a form or something to go to civil surgeon? Or when shoul I go? We want to file the petition for my status ASAP.

    You will be needing a co-sponsor for sure and you can print out the medical forms on the CIS's website.

    You should also consider to stop working immediately as you are violating our LAW, do know that there are consequences.

    Although I am not happy with what you are doing, I do wish you best of the lucks.

  8. My cousin is an international student who married with American citizen. She did file paperwork with USCIS and just did biometric appointment. Now she is waiting for a scheduled interview. Her old student visa and I20 will end in May. She wants to transfer to the 4 year University. The questions are

    Does she have to tell the new school that she's got married?

    Does she need to apply for new I20?

    What other steps does she need do in order to attend a new school while she is waiting for a scheduled interview?

    Appreciate your helps!

    In my understanding, she is technically still a foreign visitor until she's adjust to a new status, hence, she will still need her school official to transfer her record on the SEVIS. Unless she wants to wait a couple month, once she gets her perm. resident status, she can just apply to any school she wants (like the rest of us good old Americans! :star: ).

  9. It is risky not because she will be denied at POE, she won't,

    but they might ask some RFE's from both of you or possible second interview.

    To clarify something, since she has NOA for AOS before the I-94 expired,

    she is no longer considered as an "OVERSTAYER".

    If she really has to go, tell her to be on-call as she might be needed here.

    She had better to take 2 copies of AP, Marriage Certificate, NOA for AOS of course her passport etc....

    I concur with Cino. The only correction I would make is that she has not accrued any overstay time as the AOS application was pending prior to the expiry date of the I-94. Now, having said all that, there is always a risk with her leaving the country prior to the AOS approval. If she insists on going, hope all goes well.

    Just make sure she understands that once she left the country there is a good chance that the port inspector will deny her entry.

  10. My buddy joined Army last year after he received his permanent resident card and he is currently serving in Texas.

    He found out that he is able to apply for the US citizenship in fast track couple months back and he's really excited about it.

    He, however, is confused about the processes and whether he is a eligible candidate for the program.

    Anyone care to share? Someone told him all he needed was 6 months of active duty and he's eligible ?

  11. I guess my wife will get her EAD later this May if the current 3 months processing time don't change.

    She's wondering can she start looking for a job? ( Since we all know that it takes a while before you actually start working due to interviews, paper work, etc...)

    Have any one start looking & applying for a job prior EAD arrival/approval? :blink:

    She had her biometric done last month and she's just tired of waiting at home. I can understand the mentality and I am just worry it will somehow mess up the application processes by she sending out job applications and resumes.

  12. Okay, so my friend married a girl from Asia who was here for the last 4 years on F-1 student visa (I think, I know its F1).

    His wife came back in the country last November with a new I-20(or I-19? I-21?? the one for F1) and was upset that they gave her a hard time in the entry point (IAD).

    They decided to get married this February and had all the AOS applications /medical/ documentation prepared prior their wedding (I think she was on winter break or something, but I know she stopped going to school) and they sent the AOS package out to Chicago one day after their wedding.

    So I've been reading on VJ a lot (got a lot of useful info, thanks guys) and it seems like they may get screw since they mailed the package one day after their wedding and it may seems like fraud?? There were only 3 months between the time of marriage and her initial entry as a student.

    I am not a visa expert, but what's the possibilities that they get in trouble? I was sharing my thoughts with him and he's now really nervous (my fault). :crying:

    PS. His wife just had the biometric done.

  13. My wife had her biometric appointment done just last week and I realized that I may have made some mistake in her initial AOS application.

    First of all, I attached a copy of our "wedding license" instead of a copy of " certified marriage certificate".

    Second, I did not attached any further bona fide evidences like joint banking statement, phone bill, insurance policy, or pictures with the application.

    Is there a possibility that they have mailed us a RFE but lost in transit? How can I find out about that?

    Should I just go ahead and mail those stuffs to CIS?

    Once the biometric is done, will we hear back from them soon??

    PS. I tried calling the 1-800 help line, but it's all pre-recorded messages. :unsure:

  14. So I forgot to include the " Evidence of a Boni fide Marriage " in my I-130 petition.

    I am just wondering is there a format for Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship !

    I also have a statement from my insurance agent that my wife is included in my health policy, and a VOID check with both our name on it...anything else I should get??

  15. Here's the scoop guys,

    My wife and I does not live with each other during the week days since we don't go to the same school, however, we do spend almost every weekend together plus 3,000 minutes on the phone every month. Since she's living in a college dorm, there is no way for us to add my name into her dorm contract. My apartment lease was signed with my male roommate last year, and since it is a 2 person unit, the land lord cannot add my wife onto the lease.

    I know that during the interview for AOS, we'll have to prove that we reside together ( Knowledge I acquired from reading the awesome VisaJourney!) -- but that's impossible in my case. We do share a joint checking/saving account, health/dental insurance, auto insurance, two credit cards, and she's the beneficiaries of my public retirement fund.

    Do you think we will run into issues during the interview?

    We knew each other for 4 years now and we visited her home country last year -- we had a small wedding and lots of pictures from day one!
