  1. well ours was filed 2008... made numerous calls and sent service requests many many times....we got an email saying our case was approved last february 14, 2011, of course we rejoiced!.. but it never reached the NVC to this date...then USCIS said it went to appeals, appeals returned it to uscis as they can't do anything with an approved cases...now, uscis said the approval notice was just a PRELIMINARY DECISION although it was clearly stated there that YOUR I129F PETITION has been approved blahblahblah.follow the instructions blahblahblah... what was that, a false hope? they took it back? it really hurts!!! the approval email sent was just a preliminary approval??? and then what?? NO CLEAR ANSWER AND NO TIME FRAME, JUST WAIT...then they said it was sent to archive and will be dealt with when a GUIDELINE for adam walsh petition will be ready...yeah right, it has been almost 4 years! I myself as the beneficiary should be the very first person to know if my fiance poses risk on me, we've been together for almost 4 years... much more that i will never ever put myself at risk just for me to get to the US!

  2. summarized update of our case:

    1st email: that said apllication was approved and sent to appelate body for review

    2nd email: that IMBRA waiver has beed approved and was sent a notice telling so(5 days after 1st email)

    3rd email: that said APPROVED case was sent to Administratve Appeal Office for review( a day after 2nd email)

    4th email: that said application has been approved ( 2 days after 3rd email)

    1st NOA2 : hardcopy, as stated from the 1st email, stating case was approved and sent to listed consulate

    2nd NOA@ : hardcopy, as stated on the 4th email

    called NVC almost everyday since 2nd NOA2(feb14), no case on file yet

    called USCIS after every call from NVC, that said approved case was sent to the consulate already, but contested by the NVC that it should go there first prior to consulate

    since we didn't find any answer, we contacted AAO and was told that they sent back said APPROVED case to service center because they can't do anything with an APPROVED petiton so they were wonderin' as well why it was forwarded to them. the thing is, administrative office sent back said petition to uscis on feb 15th while on the other hand, NOA2 was dated feb14th.that is exactly the same reason why we didnt call AAO earlier coz of the NOA2 that we received so we assumed that everything was GOOD!..confused???? tell me about...so do US!

    so my fiance put a service request and was told to wait another 2 weeks for the answer...we hope and pray things wont mess up!

    Unfortunately I can only help you with question 3. I just read on this forum that all NOA2 emails say they are being sent to the consulate, but actually they do go to NVC (just like you thought).

    thank u for the reply...yeah, i read those too so i had this feeling that maybe all those who were approved on v-day had the same thing... it was the same thing also on the hard copy itself , it states there that it was forwarded to the listed consulate.

  4. so we got email from USCIS dated feb12 that said K1 is approved, then same email on feb14..NOA2 came today, and notice was dated feb 14...

    QUESTIONS:

    1. just called NVC after receiving NOA2 and was told they didn't have our file/cas yet..been really calling everyday as we need to change my address (beneficiary)...how long does it normally take for them to received file from USCIS? (vermont service center)

    2. in our NOA2, the priority date is open or blank..no date specified...is this how it really should be?

    3. it also states there at the NOA2 that said case was forwarded to listed consulate..is this possible???? i was thinking it should go to NVC first then its the NVC to forward it to the repective consulate.

    4. should the NOA2 come with anyhting like instruction or checklist? or just the NOA2 itself?

  5. hi..i'm just wondering how long does it usually take for a NOA2 (Vermont) to get to the National Visa Center?...to those who got email approval notice on feb. 14th, have u guys called NVC already if ur case is already there? we've been calling like everyday because we need to change my address (beneficiary) as i already moved...thanks!

  6. we're just really wondering why USCIS forwarded our then approved case to the ADMINISTRATIVE APPEAL OFFICE for review..isn't that office supposed to be for DENIED cases? and how could they approved our application then later on put in on hold like IT WAS A MISTAKE SENDING THE approval notice... :(

  7. should i say FORTUNATEY nobody replied..lol...coz guess what everyone??? my fiance just called USCIS and he was told that they decided to put aside the APPROVAL NOTICE and subjected our application for further review to Administrative Appeal Review and that they will inform us if a decison is made! isn't that sweet? how could they play on people's emotion like that? approve your application then take it back later on...arggggh! really hurts!!!!

Hi...NOA2 already received but it didnt state there that it has been forwarded to NVC...it just said that the case has been approved and is forwarded to the listed consulate...when said approval notice was sent, a few days later we received email stating that it was forwarded to ADMINISTRATIVE APPEAL OFFICE for REVIEW so we really don't know if this is good or what..we're really confused coz after the approval notice was sent here came another mail saying it will be under review again! whew...can't we just be happy for once? :crying:

    well...my fiance just called USCIS and unfortunately he was told that they decided to conduct more REVIEW on the APPROVAL NOTICE they sent us and that if a decision is made they will issue a new visa validity date...we felt like we were given false hopes :crying: this is just too much pain for us but still praying everything will be alright

I have actually posted about this at the IMBRA topic but seem that not so many people go there at that forum so i decided to post here instead... we fall under AWA, waited for almost 3 yrs...done NOID, calls, mails and everything...to cut it short, we got the NOA2 means case is approved but it didnt state there that it was forwarded to NVC but forwarded to the listed consulated (maybe to the US Consulate for me as the beneficiary which is China).. my concerns:

    1. Should the NOA2 state that said approved case is forwarded to NVC? ( coz ours, nothing stated like that and no priority date as well)

    2. After the approval notice was sent(5 days later), we received email saying that said case was forwarded to Administrative Appeal Office for REVIEW.... it's like they approved THEN take it back for REVIEW :crying: ..WHY IS THAT?

    3. I was in another country when this application was filed, then now I am home to my country for almost 7 months but didn't changed the address yet (i was hoping to go back and work)... is it still OK to change my address now said application is already approved? what should we do?

    I appreciate more inputs. especially those who personally experienced these things..thanks!!!!!!!!!!!!!

So our case fall under adam walsh, been on the file since march 2008....did this and that....after several calls and mails, we received email informing us that last week we were sent a notice that our case was certified approved and forwarded to appelate body for review ( it then fall under INITIAL REVIEW when we check our status online).. then 5 days later we received another email telling us that our case was forwarded to Administrative Appeal Office for review ( again, when we checked our status online, its now under POST-DECISION ACTIVITY)....so my fiance called again to asked for enlightenment coz we did not received the notice yet..so they made referral for our case..then just a while ago, we received another email informing us that our International Marriage Broker Act Waiver was approved...if u fall under AWA do they automatically subject you to such waiver coz we did not apply anything like that... is this a good news? we just dont understand those different opinions and email contents that they sent to us...anyone who experienced this? ur opinion is greatly appreciated!

  12. Are you checking your case online? Maybe the agent you spoke with saw the request for evidence and assumed it was denied? Half the time they dont know whats going on anyways it seems. Each person you speak to will tell you different. If its been since 2008 you should contact your congressman. Or file a lawsuit

    we fall under AWA, so it's not a surprise waiting this long, we just dont understand what's their basis of keeping on delaying the application and what kind of investigation are they doing that they can't decide yet considering it's been there for 2 years...did biometrics, submitted the noid docs, made rfe's , numerous calls and emails/letters..ALSO, we were informed our application was transferred to vermont to speed up the processing last may 2010, and yet they said it was DENIED last march 2010. why would they trasfer said application if it's already denied before the transfer? we are happy seeing others approved ahead of us, but at the same time we dont understand also what's their basis of calculating the POSE NO RISK thing...

    as to our case, we submitted the NOID january 2010 along with all those documents that you guys have submitted but unfortunately we did not hear anything yet except notifications to wait for 60 days, 6 months etc. alternately. just today, my fiance (USC/petitioner)called USCIS and he was able to talk with a supervisor. he was told then that the I129F application he filed last march2008 was DENIED last MARCH so he asked them back why he did not receive any notice or writing if that's the case. then they said it wasn't stamped with DENIED yet and it's still under further investigation. they said they saw the RFE's and calls that he made and for them, it shows we're interested and pursuing the application...that is so confusing and frustrating. they send notices to wait for 30 days 60 days 6 months etc, obviously we were told to just wait everytime he call the uscis hotline. and yet, for them WE ARE STILL INTERESTED..of course, we are!!! would that mean that if we didn't call them since we were told in the letter to wait, then we're no longer interested??? what a twist!!

  14. ok, coz in your profile it wasn't stated whether which consulate you are so now it's clear that yours is in manila...tell your parents to call the US embassy there in manila..better to be hearing the news directly from them..for sure they will accomodate your call, just list down infos that they need like your case number, name of petitioner, etc...CSPA may apply but better to have the consulate informed for you to be directed as of what is the best thing to do..you still have time, my brother only had 3 days!

    sorry can't edit my post anymore...now i see that your case is still at NVC right? and not yet forwarded to US Embassy in MAnila...but still it is better to be hearing from the NVC..tell the petitioner to follow up. i hope they will prioritized yours.

  15. how do we know whats the nearest consulate in manila? someone told me not to worry because CSPA is applicable to my case, but how do i know if its true?

    last month and this month's PD is our's.

    so i hope that NVC will expedite my papers even if one week before my birthday and i guess CSPA will help me to go to US with my parents.

    that case happened to my family(brother)..dunno if it can be applied the same to you..make your parents call the nearest US consulate and inform them about your case. they let my mom(principal beneficiary) flew with my brother a night before his 21st birthday, then the rest of the family followed a few months later..meaning, they prioritized my mom and my brother.
