How long ago was this? Failing the medical, I mean? Did you get an actual denial? You need to check to see if your application is still pending or denied. If it’s still pending you need to talk to them to find out what they need. If it’s a new medical and how to submit it. If it was denied then you need to start over. But you must find out what happened to this application before moving forward because you can’t apply again if the application is still pending.

I did not get a denial letter. I only know what my Dad told me.

  2. Hi,

I’m a US citizen and I applied for green card for my Dad who is in the Philippines back in 2016. Everything went well until his medical exam. He failed it due to lung issue, but He is now ok. Since then I have not done anything. Just got caught up with life, work and being a mom. Is there anyway I can request to redo his medical or do we have to start all over again?

What steps should I take from here?

    Thanks in advance!

  3. Hi,

I'll make this as brief as I can. I know your time is important. On August 21, 2015 my mom arrived in the US with immigrant visa IR5. At that time I thought after arriving in the US all we have to do it wait for her green card in the mail. I didn't really worry about it as I thought they are just delayed in issuing the card (as always) until 6 months later no green card in the mail still. I called USCIS yesterday and I was told that I have to pay the green card first before they send the card (I wish I knew then that we had to do that) so I went in and tried to pay but I'm stuck at the process m moms Alien registration number and case number is not showing up in the system. I'm not sure if there's another form I need to complete or what to do at this point. I will try to call USCIS again on Monday but I know for sure I wont be able to sleep through the weekend without knowing what to do. I hope someone here had the similar problem and I hope you can help.

    Sincerely,

    R

  4. Hi,

Any luck with this? I have the same problem. I got the email confirmation from NVC for my Dad's I-130 approval but when I log in to the website its giving me the same exact message:

    "Sign In Failed
The selected Case Number and Invoice Identification Number combination you entered do not match our records. Please try again or click on the Contact the NVC hyperlink if you have forgotten your Case Number or Invoice Identification Number."

  5. That section is about the Total Income amount, line 22 of your 1040, from your joint taxes. You do not put your individual income there. That is for the section specifically asking about your current individual annual income. Put the amount found on your joint taxes for Total Income. He signs nothing. You are simply entering your tax information there.

Thank you so much! it was really confusing. Any idea how long it'll take after I sent the updated one to NVC?

  6. Hi,

I need help. My I-864 for my mom was recently sent back to me because I apparently put an incorrect amount/doesn't match on my total income on my tax. Below is the what they said on the letter

"Part 6 Items 13.a.1. The income you enter must match the total (gross) income reported on your most recent

Federal income tax return. If you filed Form 1040EZ, use the adjusted gross income instead".

My husband and I file tax jointly and I make well above the poverty guidelines, therefore, I do not need a co-sponsor. What I had put in the form was my own total income (W-2) for 2013 and it was returned. The part that I am confused is that do I have to put both of our total income which what was reflected in our income tax return? if so, does he need to sign a form? but per I-864 instructions I will only need that if my income doesn't meet the poverty limit for a household of 4. Please help. I went to see a lawyer to seek for an advice but I was told that it'll cost $500 for that which I feel is too much. I cannot afford anymore delays. I need my mom here soon. Any advice is will be appreciated.

    Thank you All so much!

  7. Question: Part 6 AOS. "Sponsor's Income and Employment The current annual household income"

my income is 4x higher than required (as per poverty guidelines) so I'm assuming I don't need a co-sponsor. My husband and I filed joint yearly and my question is should I put whatever was reported on "our" tax returns combined/total or just mine alone? and on part 10 is "including any other household member's income". Sorry I am confused.

  8. Hi,

I paid the $120 for AOS and it was showing as paid online, now I'm kind of stuck and don't know what to do next. I guess my question is if I should submit the Affidavit of Support Documents & Financial Evidence first? It also shows that we need to pay "IV Fee"? but when I tried to hit pay now it keeps kicking me back to the log in menu. Also it says that we need to complete DS-260 but I don't see that anywhere. I'm totally lost. Any advise?

  9. On October 02 I received a approval notice for my Mom and it says that it was sent to NVC for processing. It has been over 2 months and I haven't heard anything from them and my Mom hasn't received any mail from them. I have tried to contact them but each time I call its always busy. Has anyone gone through this situation with NVC? If yes, long does it usually takes? also, what will be the next step?

  10. Just take more paperwork proving strong ties to your home country. Like letters from employers, any property she owns that are not easily movable to the US like land rights or home ownership. One of my friends had the same problem. Her mother was denied a visa because she has one green card holder daughter and one potential green card holder daughter. But she showed that she had another married child back in India, a sick husband , land and property. She got her visa the second time round. Sometimes they do make up their minds beforehand but sometimes you can change their minds.

She has all the evidence if only the consular checked what she has then she will have an idea that my moms only intent is to see me and her first grandson. My mom owns a house and few other things in her name. My dad and my 3 siblings, 2 grand daughters that she adores so much and a good job I don't think she will leave all that just to take care of my son.

  11. Its kinda weird you do not have any petition and yet CO said there was a petition in her name.

Exactly! I did not file any petition for my mom because I am just a green card holder. the DS 160 is the first. I don't know why the Consular Agent said that " just wait for her petition" when I did not apply for petition yet. I can apply for my citizenship in January of 2014. until then I cannot petition her.

  12. I'm a green card holder and has been living in the united state since 2009, and my husband is a US citizen. Me and my husband works full time and making 3x the poverty guidelines. I just gave birth with our first Baby a month ago and currently on maternity leave. My husband and I invited my mom here in the US we spent months (and a little fortune) gathering documentation to apply for my mom's visa so she could come visit me and her first grandson. My mom works at the hospital as a house keeping supervisor. Yesterday my mom went to the US Embassy to have her visa interview and the visa was denied. I'll skip the whole "hours of standing in line outside under the sun" thing and go straight to the point: The interview didn't last 5 minutes.

The Consular Agent started asking the reason for her trip and she said "I want to be there to see my daughter and my grandson". Then she asked what else, my mom then added "to see the US'' then she was silent reading her computer screen for a long while. She then asked "for how long has your daughter been there?" my mom says "5 years". The she asked where does she works, how many children. Then the Consular Agent said I cant give you your visa right now just wait for your petition in a few months. My mom started crying and said "I have a letter from my son in law and my daughter here that might explain" but she didn't even bother to look at the letter or documents we sent her. Then my mom asked why she just said " just wait for your petition" then she just said next. My Mom was sobbing as we talked on the phone. I've been through this process and know exactly how humiliating it can be even though my visas were never denies. It was terrible hearing her crying through the phone and not being able to hold her tight.

Any idea why her visa got denied? I feel its not fair and the consular agent didn't even give my mom a chance, she didn't even bother to look at the documents she has.

  13. The best way for you to find out is to call the USCIS. In my case since my medical is more than a year I called the USCIS and verify if I need to get another medical exam and they said I need to get a new one. They will help you find a dr. that is USCIS certified to perform the exam. I contacted the dr. and set up an appointment (he will tell you what to bring). I was expecting to spend a lot of money for it but I was surprise when I showed my vaccination record and he said I dont need any vaccination because mine is complete. So he did physical exam, he sent me to do a blood work for HIV etc, x-ray. I pent $320 in total.

    Then got my result after 1 week. You should bring your vaccination record from St. Lukes, passport, and I-693 form. And oh this will be helpful;

I-693, Medical Examination of Aliens Seeking Adjustment of Status. If you are a K-1, K-2, K-3 or K-4 visa holder the I-693 instructions state that you are not required to have another medical examination as long as your Form I-485 is filed within one year of your overseas medical examination. Only if your DS-3025 is marked "incomplete" is a I-693 required to be completed. If it is marked as such (incomplete) you are required to complete certain portions of the I-693 and have a Civil Surgeon certify the form (and seal it in an evelope). Specifically, you will complete Part 1 (Information about you) of the I-693 and provide both the form and your DS-3025 (if you have it, proving your vaccination history) and any proof of required vaccinations that were completed prior to entering the US. If you do not have a copy of your DS-3025 you will need to provide sufficient evidence of your vaccination history to the Civil Surgeon (talk to the civil surgeon's office to discuss what vaccination records they accept as proof). If you do not have proof of your vaccination history the Civil Surgeon may insist on re-administering all the required vaccinations prior to completing the I-693. Once the Civil Surgeon has has verified that all required vaccinations have been performed, they will complete form I-693 Part 2 (the vaccination section) and Part 5 (the Civil Surgeon's Certification). They will then seal the form in an envelope and return it to you
