  1. Are people adding their immigrant-spouse to their insurance right away? I called my insurance and they said that it would go up $40 a month for a "Foreign License" fee....should we just wait for her to get her Mass driver's license and then try to add her on then? Also they said that it would go up by 100s!! if we cant give a driving record from the native country---how have other people been getting this driving record--have people been having trouble???

    "the interview went so well and it was so fast. Everybody was really nice to me, the guards, the cashier, the document collecting person and the interview person... I really like the US Embassy. Most of the documents we prepared were not needed. They didn't even ask for photos. They only asked for the applications, my passport, civil record, family certificate and the police statement... When they asked me for the application you had to fill, I gave them your whole financial package and the document collecting guy was really amazed. Then they called me to the interview room and the person there was a nice American guy. He made me raise my right hand to swear that all the information i'm providing is the truth. The only questions he asked were: Who is filing for your visa? How did you two meet? When? When did you see each other? What does he do for a living and what do I do for a living? He then gave me a paper needed to pick my visa next wednesday at 3pm.... So we're finally there ... All the email evidence i printed, the call history, plane tickets, photos, and post mail evidence were not needed!!! They didn't even mention these things..."

  3. OK, but here is a problem with Abode

    "You are not considered to have a tax home in a foreign country for any period in which your abode is in the United States. However, your abode is not necessarily in the United States while you are temporarily in the United States. Your abode is also not necessarily in the United States merely because you maintain a dwelling in the United States, whether or not your spouse or dependents use the dwelling"

    If wifey moved here in November, she did not have a Tax Home back in foreign country anymore....thus, cannot use 2555 EZ either....

  4. Just to throw a monkey wrench in the whole issue:

    General Information

    "If you are a U.S. citizen or a U.S. resident alien living in a foreign country, you are subject to the same U.S. income tax laws..."

    Techinically, a K-1 finance who moves here, gets married, and is now together filing jointly is NOT living in a foreign country anymore, She is just a U.S. Resident Alien living here now.....

    So technically, there is no place for her to report her foreign income from before she moved here.

  5. Just married in November... My wife has not worked in the US this year. How will this effect income tax filing for 2008? Do I file jointly with her at 0 income? She has a SSN already.

    Did your wife work overseas this year? Foreign income has to be reported if you include her on your US income tax. Rin had no 2006 income tax (we married Oct 2006), so I filed "married filing jointly". If your wife had foreign income it will be have to be reported when you file (if filing "married filing jointly"), however a certain amount of foreign income may be excluded from US tax.

    Check www.irs.gov and do a search for foreign income.

    Out of curiosity:

    1. Does anyone know if the foreign spouse has to report foreign income on the STATE taxes

    2. Does the exclusion 2555 EZ work everywhere and anywhere, or only for certain countries?

  8. Ok, so she comes, and you marry. As soon as you marry, file for AOS, and with the AOS also put in the applications for Work (EAD) and for Travel Document.

    Basically, she cannot travel outside US from the moment she comes in as K-1 (1 time entry only--please dont leave) ........to the moment she gets a Travel Document.

    Once she gets the Travel Document, she can go and come as she pleases as long as its less than 1 year. She can also work with the EAD.

    Once the Green Card itself comes in, she can travel AND work as she pleases.

    After 2 years, she has to file an application to remove conditions on her green card, and the result of that would be a 10 year green card....

    On the 3rd year, She will file for Naturalization to Citizenship, so the 10 year green card will become null.
