  1. Hi everyone, Im not sure if this is the right forum but I am a little confused. My fiance entered the US on June 21st. THe first available day we could apply for SSn we went to the office (ten days after arriving). THey told us that the immigration officer had put his last name as Alves S**** instead of Alves DE S****... more or less they forgot to put the DE in his last name. So they sent an electronic request and told us to come back 4 weeks later. 4 weeks later we went back adn thy told us that they had heard nothing and that now they will manually make a request by sending all of his documntation in the mail and that once they recieve that it will take 2 weeks to process his SSN. We asked if we should come back and they said if we have heard nothing in 4 weeks we should come back. Next Thursday will be 4 more weeks, 8 weeks in total. His visa is going to expire in a month and we want to get married but the county clerk here requires a SSN to get married!! We are in Florida by the way. Any advice? thanks...

  2. Hello VJ! After only 44 days my NOA2 came and my I-129f has been approved! I was sitting in the grocery store parking lot when I recieved a very shocking text that my case has been updated!

Today was one of the days that I am sure many of you can relate to. I was sitting at a cafe drinking a coffee and pondering the days that lie ahead.

Today has been a blessing! I hope this means that all of you Vermont Service center filers will recieve your good news as soon as possible! My fiance and I are both so suprised and it truly is the best feeling to laugh and yell for joy with your fiance on the other end of the line.

Thanks to all of you and Happy Happy St. Pattys Day!!!!!!!!!

  3. I am filing a K1 this week but I know that I will be moving across town in the near future. I do not yet know my new address. Should I get a PO Box and use it for the process, or is this not acceptable? Any suggestions would be greatly appreciated.

No you are fine using the address you have now. When you get your NOA1 with your reciept/case number you can go on the USCIS website and change your address. Hope this helps!

  4. Hey let me know what happened if you could because I am in a similar situation. My fiance is from Brazil and we met in Spain three years ago. He lived in Spain for two years illegally. Now we are doing the k1 process and he is back in Brazil, but we don't really know about how to get the police certificate from there. Do you think we could call the Brazilian embassy in Spain and maybe send copies of his passport stamps? any insight into this would be greatly appreciated!!!!!!! thanks, barbara

WHOOPS! My bad i typed in the search box thinking i was returning to a different thread. I meant to post this on another one... :bonk:

  6. Hi! Thanks to all in advance who take teh time to read my question and give me any feedback. Please be considerate because as many of you know this process is very daunting and frustrating, and sometimes scary. All anxiety aside, here is my situation. My boyfriend is Brazilian and our I-129 F petition was approved in March 09. Due to problems with his family in Brazil we did not take action and now we are ready. We were dealing with the Spanish madrid consulate because he was living in spain, now he is moving back to brazil. Can we contact the Madrid consulate to see if our approved petition is still an open case? and if so would it be a problem with transferring the case to the salvador, bahia american consulate in brazil? I know that consualtes don't like any problems. The last thing I want to do is negatively affect our visa process. I know also that the petition expires in 4 months but I have read that the case will become abandoned but remain open for a year?

Would it be better to reapply for the 1-129f all over again?

More or less we are curious to see if our petition case is still open in Madrid, and if so if we could move it to Brazil. has anyone had any experience with an expired petition or with switching consulates?

    THANK YOU!!!!!

-american woman, future wife of brazilian man

  7. You had an approved K-1 visa for an Australian fiance, now you are applying for Brazilaian who is currently an illegal in Spain and was an illegal in the UK for three years?

Just my opion but I think there will be a problem with this one.

No... that is another woman. I appreciate all of your feedback , although its left me feeling a little pessimistic about this situation. this is how the system works :(

  8. Well did he try to get one in spain? Might be the first thing to do.

If he really cant get one in Spain then possibly you might consider having him, return to Brazil, have the Petition transfered to Brazil and try to get a clearance from there. But if he cant get one in Spain he might not be able to get one from Brazil either

I guess that is what he is going to try and do, and call the brazilian embassy in madrid tomorrow. Thanks

  9. Hi, I am also new to this forum, but I am desperately hoping someone can help me. My fiance is Brazilian, but he lives in Spain now illegally. He overstayed his visa there, mainly to stay with me while I was in Spain. Anyways, now I am in the US and we have applied for the K1. Our petition just got approved after 5 months. Now my dillema is that on the US embassy site in madrid it says that non spaniards living in spain illegaly can not obtain a police certificate. He needs a police certificate from Brazil and from Spain. Is there any way he can get this? Does he have to return to Brazil? Has anyone had any similar experience with a situation like this. Now I feel like he is going to recieve packet 3 and we are not going to be able to do anything without a police certificate. thanks for your help

Which country are you petitioning him from Spain or Brazil? As a practical matter it would probably be easier to get a police certificate from spain if he was petitioning from brazil.

I am a US citizen petitioning him from Spain. But he is a brazilian living there illegally. I know you have to get certificates from every place that you have lived for than 6 months since the age of 16, and he has lived in spain for more than 6 months. as i mentioned before, the problem is that on the us embassy site of madrid, they say that if you are residing illegally in spain as a non spaniard (eg.illegal brazilian) you can not obtain a police certificate. this doesnt make any sense to me because even if he was in his home country of brazil he would still need to obtain one from spain since he had lived there more than 6 months. I just dont know how he can get one :(
