  1. *sigh* tickets are booked...here is what im going to bring with me to Birghmingham:

-copy of my updated lease which started aug 1, 2009

-letters from my job with the mandatory dates that i must attend

    -return ticket itenerary

    -noa1 and noa2 copies

-dr's appointment card for sept 4, 2009 (my medication will also run out by this time so the dates are on the vials as well)

is this enough evidence? i mean, i was denied leave of entry over 4 years ago and the POE officer in Heathrow told me that if I brought all of the evidence needed (of signifigant ties to the US), I could return the very next day. Again, like I said prior, I didn't have significant ties to the US and it did look really sketchy. This time, I have money, a lease, a job to return to, appointments to get back for, bills, bank account etc AND we are filing to bring my fiance here not the other way around. I'm also 30 years old now and not 25, broke, just dropped out of school, jobless and living at home with a return ticket for 6 months after I arrived (which was the deal last time and which led me to getting denied leave of entry), so i should be ok right? Does anyone else have any experience with this, specifically at Birghmingham? Let me know please, IM PANICKED!

  2. Also carry a copy of the K1 including the notices. When I went I began by saying "visiting friends" and the officer probed further and I told him the full truth about my fiancee' and our K1 etc. I wasn't questioned any further and was allowed to pass but still its good to keep the paperwork on you.

this whole thing is making me feel kind of pukey and nervous...i hate worrying about stuff like this when i should be mega excited. im gonna bring as much evidence as i can...letters from work, bank statements, lease info...should i also get a letter from his mom saying shes gonna let me stay there?

  3. You should be OK, but do bring some proof. A letter from your employer is always a good thing.

I have the letters with the dates on letterhead in a packet that they sent....would that suffice? i also JUST renewed my lease so I have my signed lease renewal as well.

You might ask an organizer to move this to the UK forum.

Some people have had trouble getting in when they were visiting their fiance. The requirements are similar to the US, and you have a good start on the list of things you want to bring with you.

Make sure you have your return ticket and itinerary printed out, this, combined with a much shorter trip and letter from your employer mentioning dates when you are expected back should take you a long way. Likewise, bring your NOA2 (probably only a copy...in case of loss) so you can show that you are actually going through the process of him moving HERE. They also seem to be a bit more worried about cash and support while you're there, so maybe also be prepared to show that you aren't coming here completely empty handed.

Also, you may want to make sure that you are not disqualified for use on the VWP due to your previous denial. Do some reading, check your passport for any codes, and google those. Otherwise you may need to get a tourist visa. I'm not sure how the UK treat it, but if they think you don't have ties and deny you entry (but NOT because of misrepresentation) it doesn't necessarily adversely impact your future entries to the US. I'll bet a lot of others are simply assuming that this is the case going the other way, but you'll want to check just to be sure.

i was told back then by the customs officer that if i could get all the necessary "proof" that i could return the next day if i wanted to. i dont know why i would be denied on the VWP since i was not really denied a visa just refused entry, which i should have clarified.

  4. hey all,

quick backstory...i went to the uk 4 years ago to visit and was denied entry because i did not show "significant enough ties to the us" (no apartment/lease, school, job, very little money, an almost 6 month gap between arrival and departure and i was visiting an exbf but then bf). ANYWAYS, its been, like i said 4 years and my fiance and i just got our NOA2 (hardcopy arrived today) and his mum for my 30th birthday bought me a ticket to fly out to visit for 7 days at the end of august. i have a lease, job to return to, bank account, cat, car note and everything in my name but im worried that my past issue will come back to haunt me. i am the one who filed the petition for the K1 and he will be coming here to the US to get married once we get the visa. I just havent seen him in 9 months and i miss him terribly. anyone else have experience with this...should i bring a copy of my lease, my letters from work that show my orientation date (august 31) and retreat dates (sept 1, 2, 3)... stuff like that? please help!

  5. hi everyone,

we recieved our noa1 march 9 09. when i sent in the application i had -just- started working at a new job (less than 3 weeks at the job when i sent the petition out) and didnt include it on the app since it was all filled out prior to the new job (And tbh i wasnt sure i was even going to stay at it). is this going to be a snag or will i just update the info when we do the affidavit of support? i'm still going to need a co-sponsor regardless because the job is very part time lol. also, i told fh to not fly out for my graduation from college last week in fear that they would deny him entry because we have the k1 in process but im absolutely dying not seeing him (its been about 5 months since returned back to the UK). should he just come out here for a few weeks? he has been working for his fathers landscaping buisness since he returned back so he can get a letter from his dad saying that he expects him here and he has other things that he has planned like a driving license test etc. i just miss him terribly. advice?

Have a k1 currently being processed doesn't prevent a person from visiting the US. He can still come and visit you, he should bring proof of ties to home with him. I'm not sure how seriously a letter from his father would be taken I'd have back up documents prepared just in case they don't accept that, also bringing a copy your noa1 will help.

The i129f asks you to list all jobs that you've held in the last 5 years, I have no idea how that is going to affect your application in essence you lied. If you make it to the afiidavit of support without any questions being asked about your current job then yes definatly include it on your affidavit of support.

lol oh god i didnt LIE. I hadn't even gotten a paycheck nor was all my paperwork processed for the job. it was a second job anyways and i put my primary current job that i had been at for 4 years on there and the date that it said the form was completed was PRIOR to me even starting the job.

i swear some people can be so dramatic.

and to the poster that informed me that it will not be a snag, thank you

  7. An NOA-1 is a great thing, it means our petitions didn't get lost in the mail, LOL! Can you imagine?!!

Hi ellabee! I'm a Feb. 2009 K-1 filer myself! It's been since December 2 since my Honey and I have seen each other and we're past due for a cuddle, so he's coming here in May (I was going to go to him in England, but have to postpone the trip due to work). We agonized over the decision, but ultimately felt that a letter from his employer (stating his employment and intent to return), his mortgage note (he pays the mortgage on his mother's home) and a return ticket will do the trick!

Good luck, congrats on your graduation, and welcome from one newbie to another!

thank u for all the well wishes yall

carmie our timelines sound so similar :D last time i saw my bebe was dec 13 and mine also wants to come out in may for my graduation....he works for his father at the moment so i dont know if that is going to cause a problem or look suspicious to the POE officer...he also has bank stuff and we are hoping that the K1 might play into our favor by showing that we intend to do things the right way, IF IT COMES UP, but he is not going to offer that information up. he is gonna get a letter from his dad, and poss poss his driving instructor in regards to his next lesson date and stuff, just to show that he has plans to go back...im nervous to have him fly out here but i really want to see him!

i figured i should just tell the truth and put down that i was working as a nanny, because regardless if i was paying taxes or even had to, i was still employed by these people. i also put this down on my FASFA (for financial aid) and i also have letters written by my parents when they were supporting me (when I filed for social service assistance a few years ago). basically, i had a mental breakdown and my parents supported me for a few years until i got on my feet. is ths going to count against me?

They do not do credit checks. They will not know about a mental breakdown and if you have a co-sponsor your finances and job are not important.

Always best to tell the truth

so i did the right thing then? i read someone elses post where someone had a similar situation and a reply-er was like OMG U DONT WANT TO OPEN THAT CAN OF WORMS OMG UR GONNA GET INTO SO MUCH TROUBLE and it seemed a bit far fetched to me,anyways, that USCIS has the time to not only backtrack your job history but to go running and tell on u to the IRS if something seemed off.

  10. the last "official" job prior to the one i have been for 2 months, was in 2007 and i had been working on and off as a nanny (not making much at all) and my parents helping me out, prior to me reentering school in 2007/2008. prior to my job i have now, i was also living off of financial aid money. i never made an exorbitant amount of money nannying. regardless for the last 2 months i have been working a paid, on the books job. i put down on my g325 my employment as a nanny, even though there would be no tax documents to support it because i didnt make enough to necessitate filing any tax papers. i am currently, and have been since 08, a student as well but i did not put this on my g325 because i was technically working...is this going to cause a problem or will it only be once i do the 134? my mother has already said she would co-sponsor for me (and she and my stepdad make way above the 125%).

  11. Ok so question!!

I just got my 1-797c notice of action...All it said was receipt notice...is this a good thing? no request for more info or anything? what is this document? does it mean we are moving on to the next phase?

It's your NOA1 basically USCIS acknowledging that it received your case.

    Good Luck.

So what happens now? and thanks :)

so its a good thing that they didnt ask for additional information or would that not happen yet?

No any RFE would not happen until USCIS actually starts adjudicating your case. You are looking at at least a few months wait.

:crying: and here i thought this was a good thing boooo lol.

  13. good luck to your USCIS Journey!

thank you!! to be honest, im really nervous!! :crying: i dont know why...no reason in particular either. i have a joint sponsor, all of papers are in order, he got his police report (too early...might expire before his interview) and its clean, we actually MET lol, etc etc. i just get really anxious with things like this! any tips for staying sane?!

    Congrats and welcome.

The K-1 process will not prevent him from visiting you, as long as he can show strong ties to return. A return ticket in his case will probably suffice.

Toss in a letter from his boss (father) and he is gold.

I would not think Wales would be considered a high fraud area!

Thanks, I will mention this to him. It would mean the world to me (and him) for him to be present at my graduation :)

  14. Greetings all,

I just sent my I-129F off today in the mail, certified :). Background info on me and my FH; We met online in 2002, but things didnt get serious until 2008. He flew out here to meet me and go on holiday with his dad and we hit it off great and he extended his stay (within his visa time restriction, of course) and proposed in November, much to the delight of my family and friends...and me :D. We began filling out the paperwork while he was here and after he left we had to wait on some more documents and to get the money together. My mother is going to be my joint sponsor when the time comes. I'm just incredibly nervous and excited all at the same time. I am processing through the Vermont Service Center...any experiences with them good or bad? I would love for him to come back in May 09' for my graduation but I am nervous that the K-1 being in process might mess things up. He works for his father and is living at home with his mother. He has strong family ties to Wales but not employment/uni ties. He also does his banking there, so I suppose he has some financial ties to the UK? Any experience in this as well? I found my way here from the British Expats community, but it will be nice getting different opinions from both boards. Thanks everyone in advance and good luck with your journeys as well!
