  1. Since last Spring when they changed the I-9 requirements for employers to use to verify an individual is work authorized. The work stamp is no longer recognized as a valid document. A K-1 needs to have an actual EAD card now in order to work and an EAD card based upon the K-1 status is only valid for the same length of time as the I-94 - which means it is often expired even before it is issued. An EAD applied for with the AOS is based upon the AOS status and is valid for a year.

    My bad, still worked back in may this year.

  2. Whats your husbands point of entry? Some POE (NY) give work authorization for 90 days (till K1 is valid). This is free. It is valid only for that 90 days, if your husband will not have regular EAD by that time, he has to stop working. This is just my opinion, but I think it is not his right to receive this 90 day work permit.

    Then once you are married apply for AOS, EAD and AP. Total cost $1010. I recieved my work authorization card in mail 59 days after I mailed all paperwork to USCIS.

    Ignore this information it is outdated and incorrect when it comes to K1 visas.

    Since when they do not do it anymore?

  3. Ok, I know this is probably covered somewhere but I have been looking and seem to find different answers everywhere. I have some questions:

    When we apply for the Green Card we apply for the EAD as well right? Do we have to pay the extra $400 for the EAD or is that just automatically given if you apply for it? green card and EAD have different forms, if you filled out the EAD form and sent it in along with your green card then yes, you applied for that as well, it is not automatic and the cost of Permanent Residency, EAD and AP is $1010

    Once we are married and we have the wedding certificate in had and have applied for the green card does my (husband) have to leave the country to wait until he gets the Green card? If not, what exactly proves that he is here legally? Also, about how long does it take to get the EAD after its applied for with the green card? He does not need to leave the country, once you file I-485, you acknowledge that you have completed the requirement to marry within 90 days of arrival into the US, You should file for Permanent Residency, EAD and AP all together. After you file it takes about one ore two months to get EAD. green card might take another month or two after you get the EAD.

    I would really appreciate any kind of feed back that I can get from people that have gone through this already. I know the info is out there somewhere but I need straight answers so please don't just tell me to go look elsewhere. I'm really kind of nervous about these things. Thanks!

    Looks like you just got your NOA2, you should do more reading about the AOS stage.

    Actually, he has his visa, has a plane ticket for October 5th and we are getting married october 9th so we are just trying to figure out what we need to do after we get married. I'm just kind of #######-retentive about all this stuff and want to make sure we do everything right and get him to be able to work as soon as possible. Thanksfor the help.

  4. okay so finally today we received our interview date for Oct. 29th!!! I'm SOOOO HAPPY!! :dance:

    I just have one last question as we are getting our paper work together... we made list of people who will be attending our wedding. we have included their addresses, should we include their phone numbers too on the guest list? what do you guys suggest?

    One of the addtional documents the Embassy required of us when our case was placed on AP in '08', was the list of our engagement ceremony guests. This included their names, addresses and phone numbers as well. So yes, better to be overly prepared than under.

    Our interview (no.2) is on the 29th of october as well. :) Maybe we'll see you there.:)

  5. AP and EAD approved Sept 21, 2009 WOO HOO!!!! Now my husband can plan our trip to Canada for October!!

    Funny thing about this approval the e-mail was sent at 11:51PM....USCIS working overnight shift now.....LOL :wacko:

    lol, yeah, when I received my email for EAD it was after 9pm:) I actually recieved two emails, one was sept 14 and the second was sept 18. They were identical.

    And they never sent me email about AOS. Yesterday I received invitation for the interview for AOS in mail. I checked my case online and there it shows it havent been touched since one day after biometrics. Weird? I dunno.

    Nice!!!! I hope oct 29 will be our lucky day! (i got interview for GC:P)

    Anyways, I think that phone numbers will not hurt. I also think that it would not hurt you if you would not have them:) Make sure you got all necessary paperwork 100%.

  7. I glued tabs at the bottom for the initial petition and I saw at the interview they RIPPED them all off. Looked like sh!t!

    LOL And I thought I was perfectionalist when I sent ONLY everything what they asked for and ONLY organized all documents into order like they were mentioned in cover letter. Uff seems I got a lot to learn from you guys!!!

    Sooo...i have a tendency to worry over everything and over-prepare. I have tons of evidence documents that i could include with the 129-F package...but I'm wondering if it's ever TOO much?? Could it backfire and annoy folks, or make it take longer for them to go through my package? Should i try to show restraint and save some for the embassy interview?

    Any and all thoughts are appreciated, thanks!

    Hey,

    When me and my hubby were filing 129-F package, I was worrying about everything too. I submitted everything VJ suggested (check out K1guide) and made sure package is perfect. However, submit just reasonable amount of documents. I submitted just around 10-12 pics for example, 5-6 emails.. then on interview, you can bring some more...and for sure updated documents with the copy of 129F you sent them.

  9. ok so marriage done,a month long honeymoon done,what's next?what shall i do with the vaccination record i got from st lukes?what medical exam needed for aos?and how much did u pay guys for your aos? helpful answers are so very appreciated

    I will assume that you entered on K1 visa?

    Then you have to file AOS. With that file for EAD. Total cost for it will be $1010, and it include biometrics fee ($80).

    If you entered as K1, and have had your medical exam taken whitin 1 year, you just need to mail them copy of vaccination supplement (I received my copy of it after medical exam for K1). That should make it.

    Check out AOS guidelines here on VJ. Its pretty helpful ;)

    Our marriage certificate just shows my name as my maiden name and doesn't indicate in any way whether I am changing my name or not. But maybe that differs between states??

    So I will have to wait until I have EAD/GC to change my last name on SSN, I can't do it earlier? I asked the people at the SS office when I applied for SSN in my maiden name and they said I first have to register my new name with immigration so that they can see the new name in the computer. Whatever that means?? I guess sending in AOS but is that not enough, I have to also get EAD before I can get new SSN?

    All you have to do is put your new name on the AOS forms and go from there. There is nothing on you marriage paperwork that shows the name change at all, they always show the maiden name and are filed like that with the state. It may be different in some states but I highly doubt it. When you get your EAD go to Social Security office and change name, same with DMV.

    Yes, I agree, just fill out the forms with your new name and after receiving EAD, go to SSN and change your name with them.

    I wanted to change my name before filling for AOS and SSN would not let me because I was "out of status". I was not K1 anymore and plus my K1 would expire in 14 days... so, dont worry, just file AOS in new name and you will be just fine:)
