  1. If the USCIS claims to only hold fingerprints for 15 months, something about limited data space, one can only wonder how long they hold important data such as green cards or USC certificates? They sure recommend you make and keep copies of these important documents and want to see them in case they need to be replaced.

    Feel your friends greatest challenge is proving he is the offspring of a USC and if he does hold the evidence, all should go smooth.

    Do follow the suggestions of finding an immigration attorney, but let me add, an attorney that is part of a large immigration law firm, that makes a big difference on the tune you will get from the USCIS, they are a lot more careful and considerate in making a decision.

  3. I am writing for an amerasian friend of mine from Vietnam that is an adult who came to America in 1992. As a result of an arrest back in the early '90's(which is being contested for purposes of vacating the sentence), he has only been allowed a greencard all of these years. Recently he lost his wallet including his greencard. He applied for a replacement greencard and he was denied.

    The reason they denied it was because he is no longer in deportation hearings. That is a closed matter. Odd huh?

    He would be eligible for a green card if he was being detained but not if he wasnt. :blink:

    " Eligibility for a card while in deportation or exclusion proceedings. A person in exclusion proceedings shall be entitled to evidence of permanent resident status until ordered excluded. Such evidence shall be in the form of a temporary Form I551 issued for a period sufficient to accomplish the exclusion proceedings. A person in deportation proceedings shall be entitled to evidence of permanent resident status until ordered deported or excluded. "

    "The USCIS has no record showing that you subsequently regained lawful permanent resident status. Since you are no longer in removal proceedings, you are ineligible to receive evidence of permanent resident status. Therefore, your form I-90.... is hereby denied. There is no appeal to this decision.

    However, you may file a motion to reopen on Form I-290B.... and must state new facts."

    As a son of an american airman shouldnt he be able to petition for citizenship instead of fighting for a green card? Who will he need to contact? A lawyer? USCIS? :huh:

    He has had his DNA taken and identified. He knows the name of his father but has never been able to locate him if he still survives.

    Any help would be greatly appreciated.

  4. My step-son just got an email this past weekend saying the same thing. We sent my wife's form in 2 months before his (2008) and it's been a year since we have heard anything about the I-751 for her even.

    Is this outside of the time-frame? Do I need to contact them to ask why its taken more than a year? She has only a letter from them saying its being processed and since the letter is outdated she cant travel outside of the states. :clock:

    Hi Everyone,

    Our case got transfer from VSC to CSC on March 10, 2009. Our case got 3 touches since the CSC received it. Is this a good or a bad sign? We just hope not to get an RFE. Has anybody have their cases touches too after got transfered?

    I recently sent my I-751 to Mesquite, TX but the confirmation receipt from the post office shows that it was forwarded. See below:

  7. What would be the proper syntax to use for the cover letter for my k-2 step child. We had to send it later than my wife's for technical reasons.

    The sample cover letter said, "Enclosed also please find the following documents to verify the status of our marriage and ongoing relationship".

    Please forgive me for being so #######, but I just want it all to go perfectly.

  8. I just got back from the post office to send my I-751 off for my wife only to discover the zipcode that I copied and pasted was incorrect. :blink:

  9. Pardon me for asking basically the same question, but my wife insisted that I be double-sure. She and her son are from Thailand and they have their greencard as of a year ago. Is that all they will need to re-enter the US when they come back from Thailand? They will be gone only until July 07.

  10. Today my wife and I met a family. The husband is a naturalized american citizen and his wife came into the states illegally 6 years ago.

    They have a 3 year old son that was born here.

    They have spent thousands of dollars for lawyers trying to legalize the wife's stay here.

    As their son is an american citizen (born here) and husband is now a citizen too, what can be done to help her get legal with INS? I might also add that they have a restaurant.

    I told them that this was a real mess but that I would ask the 'visajourney' group. You all have always been so kind when helping us through the K1 visa process (my wife now has her green card after only 4 months and no interview!)

  11. OMG!! We cant believe it!

    Had I not been so excited about the Welcome letter email I would have seen an older email sent last night that says..:

    "Current Status:

    On May 15, 2006, after approving your application, we ordered you a new card. Your card will be mailed to you as soon as it is ready"

    YAY! :dance::dance:

    I called my wife at home and told her the good news. We are still in shock!! I was literally moments away from taking my lunch and sending a I-765 EAD for a work permit!! We just saved ourselves $180! YAY!

    I can't begin to tell you all how important this website has become to us. We are so thankful for all of the forms and guidelines and all the helpful individuals (strangers) that have been so gracious and helpful (even when my frustration came through in the postings). :dancing:

    This website has saved me countless hours and we didnt consult an attorney even once. My wife and son got their visas and now Green cards with no problems. Thank you thank you thank you!

    And yes, they transferred our case to California. We did it without an interview. Total time, including the request for additional information, was 16 weeks to get approved for the green card!

  12. Can someone define what this 'Welcome Letter' is? We are attempting to get an AOS.

    "Application Type: I485 , Application to Register Permanent Residence or to Adjust Status

    On May 15, 2006, a welcome notice was mailed for this case. If 30 days have passed and you have not received this notice. Please call the National Customer Service Center at (800) 375-5283 during business hours."

    Does this mean that we are near to an interview/green card? Any knowledgeable input would be greatly appreciated.

    It came from Missouri but says that they are transferring my AOS application to California. So, do I send it to the street address in California or the post box address?

    I have already filed for the AOS.

    There is a large box next to it. Is it safe to assume that they want information about the NOA since we filed for the I-485 already?
