  1. Just put Unemployed in any of the sections that ask...as stated above the beneficiary is not of concern.

    ok so we need to change the forms we have already filled out ,to "unemployed",eventhough as she said it look odd to her, but i guess we need to be honest and clean when giving the answers to all questions, no matter what. right guys...?

  2. beneficiary's status is not a concern... it is expected that they are emigrating so it is not uncommon for them to have terminated there employment

    thanks "payxibka" for your quick reply. i just wanted to make sure she will be fine for being unemployment when it gets to interview time. my understanding, yes, the most important is on petitioner side, my side. she is just a bit worry about her situation right now so i am here to get all your input and opinion. she worry if it will cause problem when she get to interview later.

  3. Hi everyone,

    We are in the stage of Packet 3 docs submission and then will get interview soon after, AND MY FOREIGN FIANCEE (beneficiary) got laid off due to this economy crisis. What should we do now?/

    Will being unemployment caused a problem for her at interview? like it will look BAD to the CO if she is unemployment?will it cause or affect the visa issuance ? And should we make change to the forms we already filled out on "occupation" and or "employment" section where there are questions about her employment?

    Please i need your input guys ..if there is anyone ever been in this situation or you know someone who ever been in this situation..

  4. LD, you don't have a timeline posted, so I don't know where you're at in this process. You could fax, or scan and then e-mail, your fiance' copies of your most recent paystubs which support your CURRENT higher income. As long as she can download and print them before her interview, you should be fine. IF you have time, try to obtain an updated letter from your employer which would confirm the higher income.

Iam at nOA2, yes I get my recent pay stubs which show my higher income now.I also get the letter from work that state my curent income,fulltime job status and other job details. You think it sufficient and it wont be a problem at interview..am i right.I have read some information regarding this and they said the consular officer will look very closely to CURRENT income not past income, so I believe we will be fine and my fiance will get the visa.

  5. The current income / resources is what is important for the I-134 & I-864.

    An employer letter, if wages are an income source, along with the current pay stubs shows the likelihood of ongoing earnings.

    The 134 is a short term document, it "dies" when status is adjusted. The 864 is used at AOS. Prepping for the 864 will give you all that's needed for the 134.

    Hi guys I posted a question on different thread but I came here to ask you guys for any input regarding W2. I made lower salary past years (before filing for K1) than what I make now. Therefore if I submitted my last W2s as supporting docs of I-134 for my fiancee,it will then showed what I got past years. Will it be an issue at the interview? What I make now is qualified , it is above the poverty line required.

    Will the CO only look for my current income now on making the decision or will the lower salary in the past years affected the visa issuance?

    Please guys,any input and repsond from you is highly appreciated.

  6. Hi everyone..pls I need info on W2

    My W2 does not match to what I make now, it shows a lower salary which was I got before I filed the petition.

    Now I make enough and it is above the poverty line requirement.

    Is this ok to submit the W2 for my fiance interview..as it says on Affidavit Support , the embassy need the W2 as supporting document.

    Or will it create a problem when the CO see the lower salary on my W2.

    Please if anyone in same situation like I have now, I need your input

  7. As long as you followed the rules and your trip to usa was clear without any troubles you should have no problems with the K1 visa, its completely different situation so go ahead and have no worries.

    Garry and Alla- No criminal history-nothing. So I will need to put the date of my visit in the US before? I saw on the I-129F form there is a section where they asked if "fiance(e) ever been to US before"..should I also include the date on that form?

    (I will need to learn and search a lot on how to file the K1 though)

    You do not need to put a date unless you are still in the US during the time of filing. (Section 12)

    Though the only hassle I had when visiting USA was at the airport. I was brought to a separate room and the immigration guy went thru my carry on bags and asking me questions, also checked my ticket which was a round trip ticket (of course-and though I felt a bit upset with all these because I was not lie nor doing something bad at all)

    But after all the checking and questions, he handed back my ticket and passport and told me : "Have a nice holiday in America".. and then let me get through.

    They do this because there is a lot of immigration fraud, and that paticular port probably had some try to slip in.

    They checked your baggage for documents that you would need to AOS. If your a visitor, you normally do not travel with your divorce papers/birth certs, etc...

    They look for "strong ties" back to your country, so a return ticket is used mostly.

    Nothing personal, just doing their job!

    I am not sure why did they do that because they never told me why. But anyway...this also come into thougths if this would have any affect to the K1 visa my Fiance is going to file?

    Will not effect it at all, since they didn't find anything wrong. If they did, you would of been rejected at the POE, and something stamped in your passport, so no worries!

    BL2B-Yes I met my Fiance within this last 2 year. Meeting my online friend was couple years before I met my Fiance.

    So I I think you are right ! Thank you for your advice.

  9. Hi everyone I am new in this forum.I have found this forum very informative and supportive so there I am here to find out what would the answer to my questions.

    I met someone on internet and we became friend online. Then after a year or so talking to each other he invited me for a visit in the US. So then I went to US for a holiday on B2 visa , stayed there for 2 weeks ,altough I was given more than two weeks validity visa. After 2 weeks , I returned to my home country before the visa expired. No problem at all, I was doing exactly what I suppose to be doing.

    Now I meet my Fiance and he is going to file the K1 visa for me.

    My question is:

    Will my situation create a problem when it comes to the past visa or immigration history on the background check ? Considering that I was invited by other person to visit US and now that is my Fiance who filed the K1 petition for me?

    We need to know what would be the naswer to my question here before my Fiance go forward to file the K1 petition.

    Thank you everybody I need your advice. Anyone who ever been into this situation like I just decribe now.
