  2. yes, I am going to work for a state university, but they never asked me about my political affiliation during the interview or any paperwork. My major is far from politics and people are more interested in my research than anything else.

    A small point, I guess, but does your employer know of your one-time communist affiliation? If it is a state university, it would care about that because of possible political repercussions down the road. Is there any action you can take to repudiate your one-time affiliation?

    I am currently in the U.S.. If the case gets denied, I guess that means I need to leave the U.S. immediately? Is there any grace period?

    I start teaching in late August. Should I ask my university to file a H-1B for me, just on the safe side? So many things to worry about...sigh

    Anybody has any idea as to EAD card and AP if the case gets denied?

    If it's denied, the EAD and AP immediatelty become VOID. If you are outside the country at the time, they may not let you back in. I don't know if they run the AP through the system at POE to see if it's valid, but I would assume that they probably do. So it would come up as void in their system.

    My advice: have a lawyer ready and do not travel anywhere by plane. Calling the supervisors may be a good idea. Tell them that you didn't fully explain something during the interview and you want to make sure that it doesn't negatively affect your application.

    I believe you will still pass. As long as you explain honestly the mix up, shouldn't be a problem. You have to intentionally lie and continue to do so to get in trouble.

    you've been here for awhile and have an advanced degree. I highly doubt you will be denied. I would let it go for now and wait for a response. I wouldn't over react. is it na xing? patience.

  5. I just talked to a lawyer. He said, it's unlikely that the case will be outright rejected because at least I was being honest and explained the situation during the interview. It's better than I said no and later they found out that I lied. But still, he would not surprised if the case gets rejected or accepted.

    Anybody has any idea as to EAD card and AP if the case gets denied?

  6. Sigh. If I were going to lie about it, I would have done a better job covering it up. It was 10 years ago while I was in college. It never occurred to me that it was a big deal being a member of a student club.

    But you are right. I was just stupid.

    You should have not lied in the application. Remember the application line where you sign you are certifying everything is true under penalty of perjury....

    the question reads: Have you ever been a member of, or affiliated in any way with the Communist party....

    hence, you lied in your application. and like Bobby said, misrepresentation is a HUGE no no. Get an attorney.

  7. Wow, you are so good. Where did you get the numbers? I have the email address for Thomas Brownrigg because he sent us an email before about the re-scheduling thing. If we call them directly, would that upset them?.... I am very afraid that I am going to push the wrong button.

  8. On our interview notice, it says officer green? It was a lady in her 30s? I didn't get anything after the interview.

    Just curious....who interviewed you? Did you get a white piece of paper with anything checked on it after the interview?

    You are right. Sigh. We were so busy with graduating, jobhunting and relocating. We didn't sit down and review our application material carefully. We should have been more prepared.

    Get a good lawyer lined up just in case. I can't answer all of your questions, but this is serious, as you already know. I wish you well.

  9. Hi Everyone,

    We just had our initial interview this morning in Detroit. Everything went fine. The immigration officer asked for a bank statement that shows grocery purchase and other daily stuff (I guess that would be credit card statement) but we didn't have any.

    Then she asked me whether I was a member, or have been a member of, or affiliated with communist party. I was a student member of the communist party club while in college for two years but was never an official member. When I filed for the application, I didn't think it was a big deal and to avoid troubles of having to explain, I checked no. I don't know what happened to me today but I said during the interview, yes, I was once affiliated with it. Then the visa officer became very harsh on us, asking us why we did not check yes on the application. I didn't even get a chance to explain I was never an "Official" member of the party not to mention perform any serious role in the party. After that, she told us we would hear a decision from them in the new few weeks.

    Do you think we will get rejected? I am deeply worried. Other than this communist question. we have a very strong case. We are both in our late 20s. This is the first marriage for both of us and I have been a F-1 student in the U.S. for over 6 years now. I just graduated with my PhD and just got a job. Is there anything I should do now? What if our case does get rejected, can we appeal? Can I legally stay and work in the U.S. while appealing?

    I haven't experienced this before, but the best thing to do is to make an infopass as you've mentioned above. This is way more better because the office you're going to is the one will conduct the AOS interview for both of you. By doing this, you will be allayed for the worst possible outcome.     Thank you. I talked to an immigration lawyer and he said, it's not likely my case will get denied right away. So in case I don't show up at my interview and the rescheduling does not go through, I can still use advance parole card to come back. Is it true? In the worst scenario, if my 485 gets denied after my interview, can I still come back with AP? Thanks!!!!

  11. Hi, I wonder whether anybody can help us with this. We got a notice from the USCIS office today for the initial interview on April 13th, 2009, two days prior to our scheduled wedding ceremony in China. With family, friends, and over $15,000 dollars put into the wedding, rescheduling the wedding is incredibly costly at this point. We called USCIS national office as soon as we got the notice today. They said, they were going to reschedule our interview and gave us a confirmation number but we are still deeply worried about it.

    I already got AP and EAD card but I heard the horrible stories about people getting their case denied and not being able to come back to the US because the AP is invalidated. In the worst scenario, if my AP gets denied, can I come back? Can I reapply the GC?

    We made an infopass next week to go in and try to reschedule it on the spot. Does anybody have any experience with it? We won't be able to come back till April 28th. Is there anything a lawyer can do? Is there anything else we can do?
