I called at the USCIS support(1-800) Number , the women on the other side read the same thing which i already see on USCIS website .

She said May 3 cases are getting processed , so you have to wait for 25 more days to put service request .

Hi all,

I had my AOS interview yesterday, 08/17/2009 at 1:30 PM, in Atlanta. My wife and I got there around 1:15 PM, went through the security scan in the first floor and were directed to the second floor. There we had to show our appointment letter at the counter where the lady, after verifying the letter, told us to wait in the AOS waiting room in the third floor. I thought we may have to wait for at least half an hour, as is usually the case, but my name was called in ten minutes. Our interviewer was a middle-aged black lady who seemed friendly. She led us the way to her room, and after asking us to raise our right hands and swear, made us sit down. She began by asking both of us for our IDs and passports. She then asked me my full name and DOB, aliases (if any). She asked my wife the same questions, asked her to verify her signature on the petition form, and then asked her how we met and how our relationship progressed. As my wife was narrating the story, the interviewer was jotting down points on the form. After that, she asked if we had any evidence of what my wife said. We said yes, we had tons of pictures as well as records of phone calls. She asked us to submit whatever we could. So we submitted a few photos, phone call records, copies of joint lease, joint bank account, credit cards, car insurance as well as flight itinerary and hotel booking details of our honeymoon. After that, she went thro all the Yes/No questions on the I-485 form to which, of course, I said No to all of them. Then she told us about the conditional nature of green card (as we were not married for 2 years) and that we had to apply 90 days prior to the expiry of 2 years to remove these conditions. She then congratulated us and said our card will be mailed to us in the next 60 days. WOOHOO, we did it!!! It was not even 2 PM by the time we got back to our car. I checked my case status today and it says my card will be mailed in 30 days. We are so happy now, thanks to the Almighty and thanks to all your help.

I have some question about my parents I-485,I-130 and I-864,I-765

1. Do I have to pay fee for EAD when i am filling all together like all abover mentioned files?

2.I know for I-484 the filing fee is $1010, for I-130 it is $377 and no fee for G-325a,I-864 and what about I-765?

3. for the Form I-765 what i have to write in section 16 for my parents they are in USA on B1/B2 visa. i mean to say in the form they have written read in the instruction but i really don't understand that?

During our AOS interview, My wife the the USC citizen didn't have a birth Certificate either. The IO asked if she had a Passport or Naturalizartion certificate to prove her birth Date, which we showed him. He was satisfied. The benificiary MUST show the Original along with translation.

I think now in 2-3 weeks AP approval will come,

There is nothing i can do , but we can just send snail mails only with proper reply. May be USCIS will become everything online one day.

Therefore, we have rejected your case and returned it to you with all supporting materials, along with the fee. Please follow the instructions on the notice to submit the case with correct fee.

There is no fees for EAD, I donno why i got that notice.

For 1-485, AP and I-130 i got NOA's and completed my biometrics also today.

Something is going with some high school fail Visa officer , that he/she dont understand , that EAD doesnt have any fees if you file it with I-485.

They are good at wasting time .

Actually the Total Money i put was:-

$1010:- AOS package

$355:- I-130 on my Wife's name.

Thats it,

I dont know why they said , they want EAD fees , The notice of rejection for EAD was incorrect/ No fees specified,

I replied back to that notice, saying EAD and AP are benefits of AOS , we dont need to pay fees for them.

USCIS sometimes behaves like poorly trained people.

Mine case is AOS from H1B.

I completed my Biometrics today(06/11/2009) for I-485,

I havent received my NOA for I-765 because they rejected it earlier saying incorrect fees, But i replied back with receipts of I-485 and Other receipts of I-130, I- 131,

I dont know why they rejected it saying incorrect fees, As there is no fees fro EAD and AP when you apply together with AOS form.

Now my question is do i have to go for another Biometrics for EAD also after i get NOA for EAD. I am waiting for NOA for EAD .

I have one more question. Since we are marrying in july, and will travel outside US for honeymoon.

The only problem is H1B stamping which is not done yet.

So can i do court marriage and apply for EAD and AP before our real ceremony . Do we need same address while filing, because she definately will stay with me after ceremony , but just rite now as she is with family , and in our culture girls usually cant stay with guy before marriage ceremony.

I mean to say court marriage rite now with different addresses will create problem in processing of application.

Or in worst case either one of us will change address before applying.

I do not have an answer to your question, but unless you have any reason which necessitate you to apply GC as soon as possible (such as your job is in jeopardy), I think the best course of action in your case would be to obtain H1b visa stamp prior to the honeymoon. You can reenter to the US using H1b visa, and apply GC after returning from the honeymoon (after the lapse of reasonable amount of time from such return). This way, you do not need to be flustrated while awaiting the approval of AP or possible conflicts between honeymoon periods and AOS interview date.

Since you will get 3-year H1b visa stamp, you can even wait to apply for adjustment of status until a few month before the 2nd anniversary of marriage so that you can get 10-year GC, rather than 2-year conditional GC.

About job Scenario i cannot comment, as so far i am fine , but the rate at which firing is going on in my company, I am worried .

And about H1B visa stamping , they are so strict (as such i dont have any problem), I read somewhere in forums , the way people especially indians are stuck due to additional administratice processing.

So visa stamping plans i have cancelled. Even if i loose my job , i will look for another and will transfer my H1B there.

I am just seeing all my options before taking any step.

I think the solution to my problem is to apply for AOS and AP by changing either her or my address after doing court marriage before real ceremony.

So that going out of country is not a hassle.

The only reason i am marrying earlier(Court Marriage) is :-

1. I am worried about my job

2. I need to travel outside US after ceremony which is in July and i dont have H1B stamped.
