I filed for my brother who live in India in 2001. The priority date is coming up in 3-6 months. He tried to come to US illegally before 10 years ago. He got deported once from USA. Someone told me that Mumbai Consulate requires a Waiver from USA due to deportation. The law says that 10 years, the records it will automatically be removed. Is this True? Why in the heck does Mumbai Consulate needs this stupid. They are making their own rules.
Its a 12 month process to get a waiver with $1500 just in fees.
Can anyone please help?? Its a complicated issue.

Thats crazy. Racism is everywhere. I am happy for those who are helping eachother and posting things on here. It really helped me decide the process. I am glad there is Visa Journey. I wish bribe works in Indian Passport office. they are pain in the neck to deal with. Good luck to you all that need luck.

I finally got my $400 fees paid for IV. For the question of I-864, you just have to show that you will take care of the person you are bringing to USA without gov't help for the next 2 (3?) years. Quick question for anyone who is VJ Certified. I got the Police Clearance Cert but not the Passport Clearance Cert. India (Ahmedabad office) requires the Interview Letter before getting the passport clearance. bunch of bs. I called NVC and they said that "Have India office write you a letter stating that" because according to the new rules you dont need a interview letter, just simple barcode (DS-3032 process) letter.
Question: Police Cert works for NVC (DS-230 packet) without the Passport Cert. ???
Patience is the key to success... GOOD LUCK to everyone waiting for all the NOA2s and RFE clearance.

I feel for those people that are going thru the tough times with RFEs. When NVC emails, it suppose it goes thru tons of firewalls, security systems, filters, queue system, etc... so be petient with them.
I called NVC today and they said they have a new process where they need all the originals documents (DS230 related) and they will forward on to the respecting embassays.

I wanted to remain quite, but then I changed my mind and my wife also suggested that I should put this in the forum because it can happen to anyone who is waiting for approval. NVC case# was aasigned on Friday, BUT BUT BUT they have mistakenly put our case in F21(Green card) category instaed of CR1 and AVR is saying that Visas are not available and they are working on Oct 2004 cases!!!!!!!
. Anyway, I spoke to an operator and she said you have to mail a copy of your approval notice along with copy of US passport and Naturlization Certificate and a Request that they should change the category. I just did that today with express mail. Also, I put an inquiry through a operator that our case should be reviewed by a supervisor because I filed it as a Citizen and Not as LPR.
Will keep you guys update. Please pray for us!!!!!! I would have not worried if case # hadnt been assigned for other two weeks, but this thing is pretty scary. They just do not give a damn!!!!! I am very worried now

Thanks for deciding to post this. I've been hanging out in VJ since last fall and I've never heard of this happening so it's good for everyone to know. It figures doesn't it - they screw something up and you have to go out of your way to fix it. I wish I could find a job like that.
Definitely keep as updated and we'll keep you in our thoughts. Hopefully it doesn't take them long to realize their mistake once they receive the paperwork you're sending.

I went on line to check the status of my fees for AOS. At begining it said "PAID" and now it says "REJECTED". I paid with my checking account ($70.00)
Does anyone have any ideas? Has this happen to anyone? Stupid NVC systems. They make so much money and they cant even manage it. jeezz....

Hey guys, sorry i havent posted anything with my status. Just working alot at the moment. I am happy for those who got their I-130 approved and moved to NVC.
My status:
4/21/2009- AOS Generated
4/21/2009- No I-797 notice received that says "I-130 approved and mailed to NVC"
4/21/2009- Paid AOS Fee ($70.00) online.
4/22/2009- Emailed my DS-3032 to NVC.
4/22/2009- Called NVC and they said i have to wait until they process my DS-3032 for IV fee to generate.
4/22/2009- Police Cert is getting in process.

I hear from other people on posts. lol. Here is what i have send w/cover letter etc.. This might help someone if someone is sending I-130.

Thanks for the reply back.
He was deported more than 12 years ago. The timeline is finished. But to Mumbai will still ask for the waiver? I am assuming.
Does he really need the Hardship waiver??
