  1. I'm thinking of making a service request for expedited processing due to serious financial hardship due to K1 delay (university fees that need to get paid to keep the enrollment). How hard is the burden of proof and what if CO decides it's not good enough - could there be more delays? Any successful experience with this?

    I agree with the earlier post that the best bet would be to try and deal with the university to get a credit. There are so many potentials for delays that you really can't plan anything. From RFEs to getting stuck in FBI name checks there is never any way to really gauge how long approval will take. The USCIS is incredibly unlikely to expidite based on university fees. In fact the consulates tell the beneficiary straight out not to make any plans at all, quit their jobs or sell anything until they are approved.

    Furthermore, he may need to check and see at what point he is eligable to take accredited courses coming over with a K-1. Just in case you were approved in time and he started school before you are married and have your other paperwork filed. I had a relative who tried to do that before and was unable to take any accredited courses until he either had his AOS filed or received his EAD and social ?, I don't remember which one it was but it's worth checking in to.

  2. i do not understand what a waiting period would have to do with it because by the time it is approved it takes more then three months so the state where it would be filed would be ok. i was divorced january 20th and i sent it in february 20th. it is now may 11th so the three months would be over so why would that be a problem?

    USCIS goes by the date you filed, not the date after your file sat on some clerk's desk for 3 months collecting dust. With that being said I didn't think that a waiting period was an issue, but rather as long as both parties were completely free to marry at the time of the application (i.e. no pending divorce proceedings).

    Wow, that really sucks to have such a delay due to having to refile. I filed the K-1 for my fiance 3 days after I received my final divorce decree (obviously I left my ex-husband for my fiance). But I am lucky in that my state there is no waiting period for remarraige after divorce so we are eligable to marry at the time of the filing.

  3. When packet 4 arrives is an interview date already assigned to you or do they instruct you to set up the interview date yourself? Just wondering because I am trying to guage how soon the interview will be and I have seen a wide variety in the dates they are set for after recieving Packet 4 on the k-1 visa timelines for Frankfurt, Germany.

  4. Ok I am really struggling already at the thought of being seperated for maybe 6 more months :( We have not even sent anything away yet.. and I am already waking up in the mornings crying! I just dont think I am strong enough to go through this. So I started considering going back to visit before we get it all sent off.. but I am really scared to do that as well because I only just left the US on 18th Feb after being there for 89 days! If I go again in May will they most likely deny me entry? also I was there for 2 weeks in May last year. How many times have people visited before being told its the last time or whatever? has anyone actually been denied? I just dont know how im going to last another 6 months or more withuot seeing them! any advice on how to cope? or if I should go back to visit one last time?

    I doubt that you will have any trouble at POE. Just bring a lease agreement or employment letter showing you have something to go back to just in case any questions arise, which most likely will not. As for the wait, I was devestated at the thought of having to wait 6+ months but after just 2 months of filing the USCIS moved so fast that my fiance just received packet 3 today and should be here early June by my estimates, depending on how soon an interview is set. The USCIS is moving fast these days as you can see on Igor's List, depending of course on if you are using the Califoria vs. Vermont Service Center. If you are in California's district is will most likely go fast.

    I would highly recommemd that your fiance file the K-1 as soon as possible to get things rolling along even before you visit. I know the wait is terrible, any lentgh of wait is. I was just in Germany in January and am already going back in 2 weeks, even though he should have his visa and be here in June, because I just can't stand to be away from him any longer. It's hard and it doesn't get easier but I guess you can say that you get accustomed to the waiting. What has helped us get through as others mentioned is using Skype for hours every day.

    Called tonight 20 minutes ago and FINALLY its received. What a nightmare. Good luck to all. My prayers & thoughts go with you for getting out of NVC ASAP.

  6. I'm starting to think IF NVC not receiving our case has something to do with our case not being updated on the USCIS WEBSITE...our case is still showing PENDING.... last touched 2/24/2009. Although we have received our NOA 2 notice date: 3/20/2009.

    Just wondering, for those of you, NVC haven't received your case, has your online status been updated?

    I recieved hard copy of NOA2 Approval Notice dated March 19th. I am still not updated in system and my status shows at last touch on Feb 19th and still pending. The NVC hasn't recieved our case yet. NVC said average time is 2-4 weeks for them to recieve cases from USCIS after NOA2 is issued but that it could take up to 90 days :bonk: ! I called USCIS and was told it could take 60 days for them to update their database but that as long as I have the hardcopy NOA2 not to worry. The NVC was supposed to be the quick part so I'm incredibly frustrated. Looks like a new trend is starting here.

    I am hoping that the NVC has recieved our cases but just hasn't updated their system yet (like USCIS). There is no telling but I hope we all get our cases in and out of the NVC as soon as possible. Good Luck to all!

  7. I sent a package to the USCIS Service Center at a P.O. Box via USPS Express on Saturady. I was in such a hurry getting the package sent out ASAP that I didn't notice USPS Express Mail requires a signature. I tracked the package and an attempted delivery was made to the P.O. Box but since it required asignature of course it couldn't be delivered. So a notice was left for USCIS by the postman and my package is being held at the post office until USCIS picks it up, schedules redelivery or has it forwarded. I am really kicking myself now for not noticing the signature was required for delivery and I'm a little aggravated that the postal serivce didn't mention that either when I paid $50 for express mail to a P.O. Box. Has anyone else ever sent a certified or Express mail via USPS to a USCIS P.O. Box and had it delivered?
