If you wish to follow my progress just use this thread, Here are the details.

When I was about 19 I had consensual sex with my girlfriend of 6 months, unaware that she was underage. She lives in Florida and I live in Alabama. Being that we had sex in both states I was charged as a sex offender in both states (Alabama its RAPE II consensual sex with a minor, in Florida its Lewd and lascivious acts with someone under 16) I served no jail time, 3 months adult bootcamp, 3 years probation 5 year suspended sentence.

I completed probation, and all the hoops that came with it.

Now I'm 27 almost 28 years old, I married my wife in the philippines (we are the same age) and she has no kids.

I have decided to go with an immigration lawyer whom I have confided in over the past year or so. , Please no negative comments, thanks, and wish me luck, as i wish all of you luck

If you did not know your "girl-friend of 6 months" age, that is one thing. But, today to imply a minor could consent to sexual activities is unacceptable and you should try to rephrase this part in your application. It shows little regret if you suggest that the ignorance of age was the cause for your two serious convinctions.

USCIS could be faster. However, AOS took me about 70 days without any problems / delays.

Removal of conditions was done in about 5 months. The AR-11 filing was immediately acknowledged by mail, the Green Card arrived few days after approval etc. So far only their backlog has been in the way, but not their professional handling of what they actually did on my file. Regardless, I fully understand everybody who has to vent over this waiting process. I am impatient myself and know how it can feel.

A piece of advice for your sanity: You have suffered enough as is, paying back is no compensation for anything. If you are certain he will not have proof of a bona fide relationship, he will be rejected anyways (although most cases seem to get approved, even under weirdest of circumstances)

We married he applied for his adjustment, received his temporary green card, I kicked him out as he was cheating on me. Filed for divorce and divorce is now final and he has about a year remaining to file to remove conditions. The divorce was final before he started/or will start to remove conditions. He will need to apply by himself. It is my understanding that I'm still resonsible for him for 10 years.

I recently read that that the USCIS will read our divorce papers if he applies. They might question the validy of the marriage based upon things written in the papers. As I now know that his intentions were not for a bonafied marriage. I have heard that it is very difficult to prove it. I'm at a lose to attempt to prove his lack of intention as he has made threats in the past and and I have resaon to believe that he might act on it. Additionally, he left with no papers of any sort to prove that it was a bonafied relationship. I don't think that he will have the ability to gather the necessary info to apply successfully.

No wonder it takes them so long to process applications. Hundreds of sheets of paper??

I sent in the important things, reduced to the max, and about 30-40 pages.

I wonder how USCIS is supposed to prove that your intent was fraudulent.

The USCIS can ask for employer letters, to show that someone was to be expected back at work again, or rental leases or phone bills and all those other papers that may proof that the intent was originally to go back to his/her own country instead of marrying and staying as there were still ties back in the homecountry. If someone comes to the US with the intent to marry and stay here for immigration, then this person normally cannot show those documents.

Remember, the USCIS does not have to prove anything, the ones who apply for it all (such as K1 and AOS) are supposed to come with all the proof..

I agree if they had time and resources for a thorough investigation you might get those hints. However, the process of immigration is not as arbitrary as it may seem at the interview. There are many stages of decision making and it is unlikely that - in case of a legitimate marriage - they will invest their energy in this. With that said, it is not recommended nor is it legal. Still I believe they have bigger fish to fry than a VWP entry with a subsequent marriage. And as I said, I have seen it happening many times and it has never been brought up at the interviews.

Unless you invite the officer at the airport to your wedding, they have no approved mind reading techniques or crystal balls as far as I know. Not that I say it is right, but I have seen many European friends arranging it this way and it never was an issue.

However: Being from a kick-#### country like Norway , you should seriously consider moving there as well.

Thanks you all for your support. I did try to renew online. In order to crack down on illegal immigration, Texas law prohibits renewal of a driver's license without proper identification of legal immigration status. And, smart as they are, they have two memos. One says a valid and UNEXPIRED I-551 is needed. The other one says in the fine print that legal permanent residence does not expire with the document. Given that it is a conditional green card, they felt it actually is terminated unless adjudicated otherwise.

I hope somebody can teach me some patience...

Sorry for the spam: I just need to vent for a moment. If you think of any other industry, $545 for a 2 page document would warrant overnight service. What the hell takes them up to a year for a standard application? I have tried to get a renewal for my driver's license in Texas and was declined because I have no valid I-551. The extension letter made no difference, even after speaking to the local supervisor.

This makes me feel so unwelcome that I consider taking my family back home to Europe. Has anybody else had those thoughts?

I have started my journey by Filing on November 15th, NOA on November 22nd, Fingerprinting on December 6th and now I am waiting for the Vermont line to shorten. I have heard about the transfer of files from Vermont to California, so I hope that is going to accelerate the process.
