  1. Yes. LPRs MUST file tax returns.

    No. YOu can attach a copy of the amended return with all schedules and attachments. You do not need a transcript.

    OK so I have form 1040X all filled out by accountant with all schedules and attachments, can I just make a copy of this and send it with the transcripts for 2010 and 2011? as in the visa journey guide it says:

    Internal Revenue Service (IRS)-certified copies of the income tax forms that you both filed for the past three years, or

    An IRS tax return transcript for the last three years.

    Before I mail the amended return in I just want to make sure?

  2. I found out that the amended processing time is 8 to 12 weeks, do I have to wait until the amended return is processed until I can file the N-400?

    or is there some kind of proof I can send with the N-400 that shows we have filed for the amendment?

    I was planning on filing the N-400 May 15th until I found out about the 3 previous year tax returns I needed to send.

  3. O.K. Your wife could have gotten a bigger refund if you had filed married filing jointly :). You could sent a letter saying that you weren't aware of this. You could also do a 2009 tax amendment to show the correct filing status and you would possible get extra money that would off set the fees for doing the amendment. Then you could send a letter with an explanation that you have just filed an amendment for 2009 taxes.

    I would prefer not to do a 2009 tax amendment as we just want to get the N-400 filed and done with. Just making sure should the letter say that we were unaware that we were supposed to file married jointly or that I just didn't file because I had no income?

    I arrived in the US on May 24th 2009

    Received my green card on August 10th 2009

    Started working April 2010.

    I made no income during 2009.

    The instructions say that we should include IRS tax returns for the previous 3 years, but I (the non US citizen) did not file any taxes for 2009. My wife (US citizen) filed for 2009 individually and then for 2010 and 2011 we filed jointly.

    Should I include a letter saying that I made no income during 2009 and did not file or do I need to file now for 2009?

    if anyone knows what I should do in this situation please let me know.

    i applied for AOS last month and today I got two yellow letters in the same envelope each headed "request for initial eveidence (I-485)"

    the first letter sheet says that the household member needs to submit all federal income tax returns for the most resent tax year. when i send the AOS pacakge i sent last years tax returns because he has not yet filled the most recent years. do I have to get him to file and then send the most recent years tax returns? also the second sheet says that he does not meet the poverty line, but he earns way way more, did they just say this because of the tax returns?

  6. Father can provide an I-864A OR I-864

    She only counts herself, and you on her I-864, and any dependents like her children if she has any.

    You are counted as IMMIGRANT, NOT SPOUSE.

    but which is better I-864A or I-864?

    the I-864A is much shorter but is it better to fill in all the extra details on a I-864 for him?

    also question 21 g says "If you have siblings, parents, or adult children withthe same principal residence who are combining their incomewith yours by submitting Form I-864A, enter the number here" so i said 1 for her father which makes a total of 3 not 2?

    this form is a little confusing for me

    ok i am in the middle of completing the AOS forms but I have a question:

    I am the immigrant and my new wife is the US citizen, she is a college student and makes no money, her father is gong to be the co sponsor. now we all live in the same house so am I correct in saying she fills out the I-864 and her father fills out the I-864A form?

    also for question 21 on the I-864 does will part h "total household size" equal 3, me, her and her father?

    so I have a kinda big problem - my interview is next week on tuesday morning and I was supposed to get my co sponsors documents today but all he sent were his i-134 form, a copy of his passport page and a letter from his emplyer stating how much he earns (its way more than needed) but no tax returns!!!

    am i in serious trouble? what happens when i go to the interview on tuesday without the tax returns, im going to tell him to order them today but the irs website says it takes 10 working days :-(

    I received my packet 3 letter today, atleast i think its the packet 3 letter, it was just one piece of paper with the following website link:

    so im getting a bit confused at just wanted to clarify what i have to send them?

    i send DS-230 Form Part I, Form DS-156, Form DS-157 and Form DS-156-K? do i need to send 2 copies of the last 3 to them? and also do I sign them cause i think i read somewhere that im not supposed to sign the forms when i send them as i need to sign them at the interview?

    then this form "IV-15K Form and check list" i send at the same time or seperatly?

    i have all the documents required here and ready

    My fiancee and I are in the process of filling out the I-134 form. she(US citizen) is a currently a student so her father is going to be the co sponsor, my questons are:

    1) what does she write for question 7 about employment - should she write "student" and give the address of the college?

    2) for question 11 what should she write? on the example form it says "N/A ( K1 visa process for permanent residence )" I just wanted to make sure she should write that? (sorry if im being silly)

    3) what will her father have to include with his form as prove of income?
