  1. Unfortunately if you don't have a proof of legal presence in US - you can't get an ID/Driver license here. An expired 1-94 will not help either.

    If you filed for EAD, once you get it - you will qualify.

    Inky is right- NY state has very strict rules for obtaining a picture ID, the same is VA.

    Thanks, I guess we'll have to wait till he gets his EAD.

    It's frustrating because my bank said he needed the ID to be added to my account, but oh well...

  2. From what I understand NY is very strict and they may not allow him to get an ID card because his I-94 is expired.

    From their website you need " 6 points " these are items they accept for identification to obtain an ID for NY state.

    Foreign passport with your visa, I-94 card, and

    Form I-20 that is valid for at least 6 more months

    - 3 points*

    • A U.S. Social Security card that shows your

    signature - 2 points**

    • A U.S. college photo ID card and a current

    academic transcript - 2 points

    • A computer printed pay stub that shows your

    name - 1 point

    • An employee ID card that shows your name

    - 1 point

    • A health insurance card issued in the U.S.

    - 1 point

    • A utility bill (cellular phones are not considered

    utilities) - 1 point

    • A W-2 form - 1 point

    • Only one of the following items issued by a

    financial institution - 1 point

    - A bank statement.

    - A cancelled check which displays your

    pre-printed name.

    - An ATM card or a debit card that displays

    your pre-printed name and your signature.

    - A valid major U.S. credit card.

    * Foreigner nationals must present a valid passport,

    I-94 card and Form I-20 as part of their proofs of

    identification, but they will only be counted towards

    the required points if the names on all 3 are the same

    as the name on the other proofs presented.

    Yeah, it's really annoying. We tried to get it when his I-94 was not expired, but we needed one more point for proof of name. Now we have the point, but the I-94 is expired! I'm not sure what we should do...Also, my bank said they need his state ID to add him to my bank account. This is such an annoying viscous circle.

    I'm not exactly sure which forum this question should go in, so sorry if this is in the wrong place. We would like to go and get my husband's NY state ID and we are worried we will have trouble because his I-94 has expired. We tried to go earlier, but they needed our marriage certificate as more proof of his identity. Anyway, after waiting over a month for the marriage certificate we were finally able to mail in our AOS application, but now we want to get his ID and we're worried they won't give it to us because of the expired I-94.

    Any advice or experience with this?

  4. Hey, this was not in Canada, but me and my fiance had the exact same thing happen at our interview. I have been living in Honduras the past two years and the interviewer also said I should go back to the US right away to get a job, etc. She used that same stupid line " US immigration is here to bring families together". It was really frustrating and I know what you're going through. I am now back in the US and we sent the embassy a letter from my job and a few other things. But I am worried the embassy will take forever to get back to us because there is now a political crisis going on in Honduras. Just our luck.

    We are doing a K-1 visa, so it's a little different, but the NVC forwarded our case to the embassy sometime in the middle of May. Around a week later I e-mailed the embassy and they said they had received our case and our interview would be June 16th. It was a lot quicker than I thought it would be. If you haven't yet, you should e-mail the embassy and give them your case# that the NVC assigned and ask if they have received your case yet. tggiv@state.gov

    CR1-IR-1 visas Interview is assigned by NVC not the embassy

    K1 is forwarded directly to the embassy which is responsible to gather documents and give an interview date ...

    so the embassy wont be helping in his case ..only NVC cant tell him when his Interview ...

    just keep caling them ...many of us didnt get the Interview assigned yet including me ...

    As I said, the case is different since mine is K-1. But it is the same embassy and I was just pointing out that Tegucigalpa seems not to be too backed up in terms of interviews.

  7. Quick question -

    I have basically everything that we will need for the interview, but I was wondering how we should present these papers and documents. For the petition we used ACCO fasteners, for the interview should we just put everything in a big folder? I'm assuming it shouldn't be fastened so that the interviewer will be able to look through the papers more easily?

    Any answers or ideas?

  8. vermont is alive! an october and a november filer got their noa2s. now let's hope they move quickly through the people who have been waiting forever and through january.

    hello..congrat..so you did not get any email, but they mailed nao2? did i understand right? we got our noa1 on january 7th..but they did not even touch...

    right, we got no e-mail....i still haven't gotten an e-mail. just the letter in the mail.

Well, barring some people updating their timelines and adding NOA2's for the past week, I can tell you from walking back over the past year that NO time during the past *year* has there been so many days without a NOA2. Not Christmas week, July 4, memorial day, labor day, new years. The longest I saw (I looked) was i think 4 days without. This is driving me absolutely nuts!

    I see a person here and there getting NOA2, though.

    Hang in there... :)

    So it seems like they keep accepting H-1B apps. until they reach a cap, but I wonder how long that is and when "H-1B season" ends....

  10. Well, I received my NOA2 email at 9 o'clock at night eastern time, so there's always hope right up till the end of the evening! Our case also got forwarded onto NVC on a sunday which I thought was strange, but there ya go. I don't get the USCIS at all!

    that give me hope. but maybe it's a bad thing, because i would have given up for the day and done something productive, but now i will stay glued to my computer.

  11. yeah why hasn't anybody been approved since last thursday????? seeing all of those approvals gave me false hope :(

    I have no clue.. maybe they think they worked so hard putting out so many last thursday that they need a few days off..

    ok, but now it's time to start back up again!

    Just wanted you guys to know that us March filers are hoping to see more of you guys approved today too! We get excited when you are approved, it moves us closer to the goal so GO VERMONT and JANUARY!!! :D

    Thanks. I usually loose hope for the day once it hits 6ish eastern time. Does anyone know if the NOA2 emails get received at all hours or only during work hours?

  12. Anyone else notice on Igor's list that there were no approvals from Friday 5/1? Just strange, they were moving so good all week and then nothing. I wonder if they were working Friday...hmmm, oh well, let's hope this week goes well too! Good luck to all!

    I definitely noticed because I've only just become obsessive. I was fine thinking my NOA2 wouldn't come for at least a month, until I saw people who applied after me got approved. Now I cannot stop checking my email, this website, or the USCIS site. It's making the days pass a lot slower...:(
