If a request for evidence was made, you needed to respond to it on time in order for the processing of your petition to continue. I guess you will need to wait to see what to find out exactly what was sent to you. But I wouldn't expect any good news. They will not continue to process your petition if they requested more evidence and you didn't respond to the request.

thats the reason that we not submit any more evidence docs as they requested cause we decide not to pursue this petition, we not expect for good news, we want that his petition will be canceled automatically since he never submit any more evidence docs requested

I received this message when I made an address change. The message was sent because they mailed out another copy of my NOA1.
Well our situation this way got RFE last March but we decided that not to submit any docs to the USCIS
the USCIS give him a month to submit till it lapsed, he never submit anything.
Then it may be something with regards to not responding to the RFE and the status of your petition.
Well we never sent any documents once we had RFE , that was Marchfirst week then they give us one month to submit those more evidence April is the deadline. We end up our relationship middle of march
how does it affects to us... if he gonna petition other woman . same to me also if someone gonna petition to me for both us in the near future?

like affidavit of how capability or disability he is on his sick
he has a leukemia every now and then chemo
and soon he gonna have his surgery for some other parts
its been complicated his health
he will move to home care April
and tomorrow March 16,2009 he will get the affidavit from his doctors and mail back to USCIS---- and together by that supporting docs , he will also attached the new address of him
my quest is how long we will know the result once they recieve our supporting docs?and is there any chances that they will aprove us?
please guide us

if we just end up our relationship coz we know theres no way to approved coz of his situation.... if we decide to end up our relationship and just be friends..... does it affect to my near future if i found someone that i meet in person and his willing to petition me...... of about what if???????

feb was nao2 but mine march " rfe"------July filers too
...just sent ours out as well couple a days ago...we all just have to sit back and try not to get over anxiousas long as your intent is true to your fiance(e) and to yourself...

OK LIKE THISWE BEEN ALMOST 4 YEARS.. BUT WE NEVER MEET IN PERSON
LAST YEAR HE FILE FOR PETITION JULY.... THEN IT JUST APPEAR THIS MARCH 2009 RFE....
WHAT DO U THINK THEY GONNA NEED FOR ADDITIONAL DOCS?
IF THEY GONNA ASK FOR EVIDENCE PICTURES, TICKETS AND ETC THAT HIS BEEN HERE... HE CANNOT COZ NEVER BEEN MEET HIM ..........
They're going to need the proof that you and your fiancee have actually met at least once before you filed the petition....if not the petition will be denied, so no need to cancel.
That it took 8 months for USCIS to issue the RFE is besides the point. You two have not met....therefore there is not basis for the I-129F, the end result is denial of the petition.

If there is no response to the RFE by the date given the petition will be considered abandoned. Good luck but personally I don't understand why he filed knowing it would be denied. -
a lot of my friends told it will deny... coz we havent meet in person...
to be honest i dont know what to do......
imagine.... he filed JULY and just march pop up that RFE... its about 8 months......
within that 8 months thats the time he also starting his chemo til now and we dont have communication by phone....
No wonder you have a RFE. One of the requirements is that the two of you have met and you have to furnish proof of your meeting. You do not have any proof.Who May File This Form I-129F.
2. You and your fiancé(e) intend to marry within 90 days of your fiancé(e) entering the United States, and are both free to marry, and have met in person within two years before your filing of this petition unless:
A. The requirement to meet your fiancé(e) in person would violate strict and long-established customs of your or your fiancé(e)'s foreign culture or social practice; or
B. It is established that the requirement to personally meet your fiancé(e) would result in extreme hardship to you.
Unless you fall under B and can prove it with your submission, then you should not have filed in the first place.
You may want to get an immigration attorney for their answer. From what I see, you should not have filed unless you submitted all the proper evidence.

well he said to me that he did enclosed letter from the doctor, and the reason why he cannot travel.....
he just filed coz he still thinking for a positive or miracle that it may happen that the petition will be approved...... i know what u mean it wil be impossible that having a approval.... coz we havent meet in real person..... as of now his in the hospital...... he havent know yet what rfe ... and what docs they gonna ask ... and for sure he cant give to them coz his really sick... still having his chemo......

Most likely the RFE is for proof of having met or proof that for the very specific reasons why you have not met in person. In your case it sounds like that would be the medical proof that he is unable to travel for medical reason, by proof I mean letters from his doctor, and ALSO proof as to why you could not come to meet him.Approval without having met in person is almost impossible to overcome and almost always will be denied. As to cancelling the petition I am not sure as you mean canceling it for now and re-filing later or ending the relationship.
To cancel the petition the petitioner must write to the office that has the case and request this.
