  1. Mark - you need to clarify your situation.

    Did your wife just get her conditional permanent residency, or did she just remove the condition on her permanent residency?

    What's your stepson current legal status?

    By the way, a siblings are brothers and sisters. I would hope that your stepson is not also your wife's sibling. :whistle:

    Sorry about the sibling thing...Yes, my wife has just gotten her condition removed and has the permanent card. My step-son's status is still conditional permanent residency...he came here about six months after my wife. Thank you for your help!

  2. My wife has just had her approval letter received here for her permanent residence and no interview was required. We now have to soon start the procedure (I-751) for her son. My question is: Do we gather all the same materials and go about the same procedure as we did with his Mom? I understand that there is rarely an interview for the sibling, which is fine either way, but want to be sure we send immigration the correct package. Thank you very much. Mark

  3. YOUR STEP SON WILL STILL NEED TO SIGN THE 751 FORM IF HE IS OVER 18 YEARS OLD. AFTER COMPLETING HIS 751 FORM, YOU CAN SEND IT TO HIM BY OVERNIGHT EXPRESS. AFTER HE SIGNS THE FORM, LET HIM MAIL IT BACK TO YOU BY OVERNIGHT EXPRESS AND THEN YOU CAN MAIL IT TO USCIS. TO MAKE SURE ALL OF THIS, GO TO THE USCIS WEBSITE FOR INSTRUCTIONS. I AM SURE THAT IF HE IS UNDER 18 YEARS OLD, HE DOESN'T HAVE TO SIGN IT UNLESS THERE IS A CERTAIN AGE THAT HE DOES HAVE TO SIGN IT. IT COULD BE 18 YEARS OLD OR MAYBE EVEN 17 YEARS OLD THAT HE HAS TO SIGN. GO TO THE USCIS WEBSITE UNDER INSTRUCTIONS FOR 751 PACKAGE.

    Thank you so much for your reply and the time you spent...yes, he's 20 so I will do this. I suspected that he would have to sign and the USCIS does know that he's out of the country...no sense in taking chances.   4. My step son will need to start the process of his I-751 in the late spring of this year. He is scheduled to return to the US from China at the end of July, which would be a late time for him to get the needed paperwork into USCIS. Can we (me and his mom) complete his paperwork and so forth while he is still out of the country? He is in college in China and it would be hard for him to leave before his term ends. Any advice would be greatly appreciated.

  5. Do you consider your home his permanent address and he is temporarily away?

    Or do you consider him taking up residence in another country and abandoning his greencard?

    I don't really have an answer but those questions came to mind.

    Thank you Nick...you may have really gotten this one like the other guy says. Anyway, yes...he is considered permanent here in America and also owns the home of which me and his mother live. He is overseas in his native China finishing up some college there, and will return here late next spring. He is also 21 if that makes any difference. I guess I may say that he lives here? Let me know what you think. Again, I appreciate your help very much!

  6. We are filing my wife's I-751 and I am a little unsure of part 5...Her son also has a conditional green card but is out of the country on a re-entry permit. He will be back before the 90 day period of renewing "his" card and removing the conditions. My question is: Do we state that he is living with us or not...since he is not actually here now? Again, this is on part 5 of my wife's I-751 application. Thank you for any advice.

    However, you might want to go, anyway, if it's not too much of a drive for ya.

    Worst Case scenario, they'll turn you away, issue new appointment date

    Best Case Scenario - he'll get interviewed 'that' day.

    Thank you...yes, I suspect it's nothing serious but still has me worried. He is on a K2 visa, I wasn't even sure if he actually required an interview. I will call them Tuesday and hopefully be able to talk to an officer. Thanks again! Mark

About a week or so ago we received a "notice of action" for my step-son's AOS interview...and now as of today we have received another "notice of action" stating that the interview has been cancelled due to unforeseen circumstances. Has anyone had this experience before? It has us a bit nervous....any help would be appreciated as the national call center is not available until Tuesday. Thank you, Mark

  9. I have the same problem. Well, I don't have an interview date yet, but I think I need some shots. My husband wants to go to the doctor, but I think we can wait. This is very complicated, and the worst part, is that doctors want to charge a lot of money.

    Thank you and everyone for your help. We had our interview today and it went fine and we passed. The shots that my wife had were the TD, Varicella, and MMR...the additional shot that we needed was the supplemental MMR shot, which cannot be given right after the first one anyway, there is a six month waiting period. This was all they needed for the AOS interview. My wife is 44 years old and some of the shots are age dependent. She had her medical exam about seven months ago in China, so that was fine...and the I.O. didn't ask for it anyway...only the vaccinations. Thank you again!

  10. There's no need to fill out an additional I-864. Bring a copy and the original of everything you submitted with your AOS package. Even though they should have it in their possession when you get there, I have read a few instances where the IO was missing a piece of the couple's package and asked the couple to provide the original. You'll want to bring copies in case they ask for one to keep (so you don't have to give them the original, which you wouldn't get back. During our interview our IO asked for copies of ALL evidence of a bona fide marriage that we had...better to be safe than sorry!)

  11. I am in the same boat as you are with regards to the vaccinations. Before my AOS interview I was worried about the vaccinations but I told myself not to worry coz the others are right, I shouldve gotten an RFE if they needed more.

    Last friday I just had my AOS interview (Jan 21) and everything went well. Except that they needed me to complete some supplemental vaccinations and told us to just drop it off and then the IO said he'll give us a decision (which my husband and I know we're gonna get 100% approved) Hey we already got 2 babies (lol!) and all our papers are legit and we answered all his questions. They gave us 30 days to do it. Im sure you guys will be fine!

  12. So you have an interview date set?

    If they had an issue with the vaccinations, they would of gotten them taken care of prior to making an interview.

    The shots needed are listed on the CDC website (http://www.cdc.gov/ncidod/dq/laws_regs/fed_reg/vaccine/revised-fact-sheet.pdf)

    Check your information with this and you will see if you need any shots. (note that HPV and Zoster are no longer required) - if you need some, I would recommend you get them prior to going to the interview.

    Didn't she get a vaccination card from her medical for the K-1? Did you submit a I-693 (vaccination supplement) with your AOS?

    Yes, we do have an interview appointment date...and she did get the vaccination card (yellow booklet) after receiving the shots overseas. We never heard anything or received any RFEs or requests for furthur vaccinations before the interview. I have also heard that a person's age is also a factor, but I am not positive. We also did not submit a I-693 with our AOS package, but I am also not sure of what may have been in the "brown envelope". The last doctor's office we spoke to suggested that we just go ahead to the interview, and if they want additional shots or information transcribbed to the I-693, they will simply let us know, and therefore we may not have to get unneeded shots or exams...we would just get what additional things they want and send in the paperwork to USCIS to finish the process. I just don't want any extreme issues with her interview. I appreciate your help very much!

My wife will have her interview (AOS Green Card) soon and we are confused over which shots she needs...and every civil surgeon we have talked to has a different answer, and immigration has none. She is here on the K-1 visa, and had vaccinations and a medical exam overseas in June of 2009. She was told that this is what she needed. After several calls to doctors here, we went to one located next to the local immigration center here. They were also unsure of the needed shots, if any...and suggested that we just go to the interview with her exam copy and yellow pamplet of vaccinations...and if they needed anything else, they would send us back to them for the requested shots or tests, and that this would not delay her Green card as long as we sent back the needed papers to immigration in the proper time frame, thus sending her the green card after this is done. Does this make sense or sound within reason? No one seems to have a sound, firm answer. Thank you so much.

    In the case of my wife's K-2, we are going to apply for his EAD along with the AOS documents.

    He is 2 years old and it just wouldn't be right for him to be able to obtain a SSN before he has work authorization !!!

    I mean, just because I, as a USC, was able to obtain a SSN when I was a baby does not bestow any extra priveleges upon a K-2 coming to this country.

    I think this makes perfect sense; we wouldn't want the 2 year old to start working illegally before he obtained the work authorization. That wouldn't make sense.
