Can't say for sure but it sounds like something they would do, why not? If you sent a letter by snail mail they would put it in your file, why not an email?

I wouldnt worry about it. If you guys are questioned about it, just be honest..tell them it wasnt a registered marriage and your fiance' mis-spoke. Tell them what you told us, that you had an orfi marriage.

The only question keeping you from being granted the visa, it seems to me, is that your boyfriend has not provided the written proof that is necessary that he will be able to support the two of you. This consists of bank statements, income tax returns, a letter from his employer, and a letter from an officer of his bank, all on official paper. The instructions are quite clear. Apparently he has ignored them. You must have these original papers in your own hands when you go to the interview. Sending them by e-mail is not enough; he must ship the original papers to you by FedEx or some other mail service.

After being denied the visa twice, each time for that reason, I am observing that your boyfriend is not doing his part and may have a bad attitude about the whole thing. This is probably why the consulate advised you that he seems to have problems and maybe you should drop him.

Is there any feeling on your part that he is no longer interested in you? If he is really interested in you, then he needs to do what the U.S. requires him to do.

Your Muslim ceremony is of no interest to the consulate, since the two of you are not married yet. It enabled him to sleep with you, that's all it did.

The question is, are you legally married? Some cultures have separate civil and religious marriages, and in some consulates if the religious is complete and the legal component is imcomplete, you are not married. It really depends on the jurisdiction and the law of the country. In order to apply for a K1 visa, both of you need to be "free to be married". If that is no longer the case, make certain that you complete the legal portion of your marriage if appropriate and file for a K3 or CR1 visa. It depends very much on the laws of the country you are in and whether you are considered married at this point.

If in doubt, contact an appropriate immigration attorney and/or the local embassy.

If you were interviewed and they asked for proof of income, then this is all you need to worry about at this point. Tell your fiance to send you the proof of his income they need as they told you to do.

I think you are referring to an Orfi, correct? My fiance and I have one and he is from Egypt. We also filed for a K-1 and when asked at his interview if he has an Orfi, he will say, yes. I would say most who apply for a K-1 visa in Egypt, has an Orfi, as you can't live together without one. This is NOT a legal registered marriage.. therefore you are NOT married in the eyes of the U.S. Government.

The Embassy always knows the customs of the country they serve and Orfi Marriages are known by those who interview as an unregistered, non legal marriage. It's nothing more than a piece of paper saying you two are married, to satisfy the police.. if you were stopped while out together and the manager where you rent your apartment.

Unless you went and had your Orfi registered, you are not to worry about the email. You didn't go to your government and register it, correct? If so, i'm not sure about this as i'm only familar with unregistered Orfi's. I'm also speaking for Egypt only, as I don't know anything about the country you're going through, but "Hot Guy" i'm sure understands and can give you good advice.

Shes is afraid because they didn't give her the visa and she thinks the problem is because her fiance said they were married, but if she explained already that it was only a ceremony and is not documented she shouldn't worry. What they need is proof of income, right? so that's the only reason, they need your fiance's taxes and that's it, no big deal!.

People try to be more understanding with VJ members who can't express themselves too good in english, remember this country is made out of immigrats!, we or our ancestors all came from different places, the only legals here are the Native American Indians!

You were interviwed but were not given a visa? The e-mails were probably not put in your file since there is no way to verfy that he was the one who wrote them. What written notice were you given at the consulate? Did she mean that she needs more evidence that you two are really engaged?

I agree, I think a lot of people on here aren't sure what an islamic marriage is. Keep in mind that many embassies understand local customs so hopefully it will be ok. I would have your fiance e-mail back and explain that he misunderstood what you two went through. Good luck!
