  1. Yay! We also got an interview date yesterday for September 29th.

    My husband and I were kind of shocked and not that excited at first. I think it had taken so long that we had just gotten into the mind set that we'd be here for a while (not that thats bad necessarily). But now we are excited again.

    Only problem is....I was reading the other couple (I cant remember what their name is) who's scheduled for the 29th and their dilemma with the medical. My husband and I will be returning from Paris (for a friends wedding) on the 23rd. Its kind of tight in regards to flying out to Montreal and scheduling a medical for my husband. So much to consider.

    Are their more than 1 doctor to do the medicals? Any suggestions?

    My husband and I would like to be added to the waiting list. Im so glad I found this thread because I had been starting to lose my marbles. If my memory serves me right. We sent in 1-130 in Jan 2010 and the DS-230 checklist in March 2010. No news yet. The nice thing I found out when reading this thread that I can actually call the 202-663-1225 number to find some information out. Im just not sure exactly of what to ask. Should I ask if my MTL case number has been logged into their system? This is the only place I can call to find any information on the status of our application, correct?

  3. Thanks everyone for the responses, that helps. We are interested in postponing the application in general, not just the interview. We're curious if that is possible and if so, if there is any type of penalty, financial or otherwise.

    If we can postpone an application without losing our fee then that is ideal. Does anyone know of the actual process to postpone?

    In terms of withdrawing our application, I assume the fee is lost. It is good to know that having an unfinished application does not impact future applications.

    Our situation is, we have submitted the I-130 in January of 2010 and followed up with the DS-230 and checklist in March. We are not certain where we are exactly in the process. The only communication we have received from the Montreal Consulate is the request for the DS-230 form and to gather documents. We have read about other people receiving and completing the NOA1 and NOA2 forms but we are not certain about when these steps come into play. If someone could explain to us these specific steps that would help us have a better idea of how much time we have to wait.

    Also, we are now considering staying in Canada for another year or two, but would like to know if we can withdraw or postpone our application, and if so what the implications are. If we were to withdraw and be told that we cannot reapply for 5 years, for instance, that would affect our decision.

  5. I am starting to get a little bit worried that my husband and I missed a step along the way.

    On Feb 22, 2010 we received a letter from the Montreal Consulate stating that we needed to send in our DS-230 Part 1 and 2, as well as, our checklist indicating we had obtained required documents. We also got assigned our case number. We must have sent that in a week or two later. (Unfortunately, we did not write down when we sent it or even send it in registered). Anyways, the letter states that upon receipt of these documents we will get assigned an interview for 4-6 months. We are being patient as it has only been 2 months. However, we are now nervous that the consulate didn't receive the DS-230 form and we have no way of finding out if they did or not. The other thing we are doubting is if we should have sent in the documents stated in the checklist with our DS-230 form? I have tried to read up on this on VJ and have read 2 different things. One post states that I shouldn't have sent any documents and that we should only be collecting them for when we are assigned our interview. However, in the general DCF procedures it states that I should have sent in the documents in with my DS-230 form. Which is correct?

  6. Well, if you read the instructions and the adjudicator's field manual it never actually specifically states that the Primary Sponsor can't use foreign income.

    I have only ever seen one approval based on a job offer/foreign employment - you can read the post discussing it here:

    They revamped the website here a couple of weeks ago - so replies are not separate from the original post in the older threads - tad annoying - but my response to the OP, in the post I linked, starts with "This is interesting, I have actually been thinking about this for a few weeks"

    There is one CO in Montreal that - 98% of the time, is the guy who interviews all applicants where proving reestablishing domicile is concerned. I cannot remember if Simstar got that CO, if memory serves me, she didn't - so that may be something to consider.

    That said, it does specifically state in the adjudicator's field manual that the sponsor must prove their income by submitting the 1040 and slips - with regard to foreign income it states:

    "State or foreign income tax returns are not acceptable; if submitted, they must be returned to the intending immigrant"

    So therefore one could conclude it would not be accepted as income. A job offer cannot be accepted as proof of income either, I can't seem to find the reference to that right now.

    You can use Assets instead of income/joint sponsor absolutely. For the two of you that would be 3 times 125% of the poverty guidelines (the 5 times is only if you are sponsoring someone other than your spouse).

    What does the statement above mean "For the two of you that would be 3 times 125%..." In the I-864p it states a household of 2 needs $18, 212 which is 125% above the poverty guideline. Why is it that the above statement mentioned 3 times that? My husband who is the immigrant will be continuing at his current Canadian employment and working remotely once we move, we want to make sure his salary still qualifies us for the necessary AOS.

    They sure don't make this easy on us. Wow!

    I currently have an American address (my aunt's house) that I have used to file my taxes while I have been in Canada. This address is a Maryland address. However, my husband and I plan on moving to California, so our employment and lease will show California address'. Do you think that this might rise concern? I'm sure I could also find my registered voter card from Maryland somewhere. I am not registered in California. Also, when I switched over my car to be registered in Nova Scotia, they made me give up my Maryland drivers license so now I don't have that either.

  8. Wow. That was wonderfully helpful.

    My other question is....should I be sending any of this information to the Montreal office now or should I just be collecting them for when we are assigned an interview? It would be easier to collect the proof of re-establishing domicile if I had an interview date so that I had a ballpark date to tell my Canadian employer I am leaving and US employer I will be starting, etc.

    In case I didnt mention it, the last step we did was to send D-230 form and the checklist stating we had certain documents.

    I have a follow up question about my husband and my situation. We are also filing DCF through Montreal. He is the Canadian citizen. Last step we did was file the form D230 (I believe that's the right form). We also returned the checklist demonstrating which documents we have ready for the interview. According to the letter, it said that we should now wait for our interview date and continue to collect those documents on the checklist. Proving domicile is quite difficult for me. We are planning on moving down together. We both have been looking for jobs however, employers seem unimpressed when we tell them that we have NO IDEA when we could be available to start. So they always say, get back to us with a start date in mind. So how do I get a job offer, to prove domicile, if I dont have an interview date or any idea of when we'll be moving down? We have collected a moving quote, we have a bank account with both of our names on it in the US, I could easily get my tax information from 2009, and I could get a letter from my sister saying we will stay with her until we find out own place. How are others finding jobs? Thanks.

    Im new to VJ, posted on a general forum and was recommended to post on the DCF forum.

    Im American and my boyfriend is Canadian. We've been together for 6 years now, back and forth between the States and Canada. To our knowledge we've done everything legal up to this point.

    Currently, we are living in Halifax. Ive been here since August on a visitor visa and then working legally on a NAFTA visa since Dec 26. Ive been reading that I should be in Canada 6 months before applying DCF. Would I be eligible with a visitors visa? Or would the 6 months be from the date I got my work permit?

    In a couple of weeks we'll be going down to visit my sister in CA and we're stopping by Vegas. We're thinking its about time we tie the knot.

    Once back in Canada, we'd like to begin the process of filing for our DCF visa. People have mentioned this is the fastest way to go. Does anyone have an average idea of when we would be able to move back to the States for work? Is there a time restraint between when your are finally done with the DCF paperwork and to when you must move back to the States? Is it true he gets his Green Card when crossing the border?

    Does anyone have feedback on the advice you receive from FREE CONSULTATIONS over the phone. I spoke to someone yesterday and they said the best thing to do would be to wait to get married. My boyfriend would need to get a job offer and apply for a TN or NAFTA work permit for the States. Move to the States. Get married once in the States. Then apply for change of status from a TN/NAFTA to a CR1 visa? Should I trust this opinion as the most convenient to our situation....

    Its tough to know who to trust?

  11. Thanks to everyones replies. We truly appreciate it. All that government/legal jargon is enough to make someone feel the only answer is to pack up their stuff and go live in Antartica. :blink: This website has really brought hope back into our lives. :dance:

    Im sorry if Im not posting in the right place Im new to the website and as a member....Im so thankful for having found these forums!!!!

    I have a beginners question...

    Im American and my boyfriend is Canadian. We've been together for 6 years now, back and forth between the States and Canada. To our knowledge we've done everything legal up to this point.

    Currently, we are living in Canada while he finishes up school. Im here in Canada legally working on a work permit.

    In a couple of weeks we'll be going down to visit my sister in CA and we're stopping by Vegas. We're thinking its about time we tie the knot.

    We're wondering if we get married in the US during our vacation, will I be allowed back into Canada and continue to work on my work permit?

    Once back in Cananda, we'd like to begin the process of filing for our K3 visa in hopes that come September or October we can move back to the US to find employment. Can we apply for the K3 visa if we are both in Canada? And if anyone recommends we do the CR1 visa (sorry im new to this, I can't remember if thats the correct name for the visa) instead of the K3, speak your mind.
