  1. Hold on now, I've got a question: You can marry within 90 days and not file for AOS until months down the road? I just got married with about two weeks left on my fiance's (now wife) K-1 visa. Now, if we send in our AOS application, how is my wife legally in the US? Do we need to carry around our marriage certificate until she gets her green card (in ~ 6 months)? Is this OK?

    Also, we got married before we applied for a social security number. Is this OK?

  2. Hello everyone, thanks for your help. We received NOA 2 in July, but I'm having trouble putting together an I-134.

    I've been living and working in Bangkok, Thailand for the last two years. I just finished a two year contract at an international school. Since then I've been freelancing via my website, and at other schools.

    I don't have an employment letter from an employer that will state current income. I'm moving into self-employment, but I don't have a lot to show for that either. I do have tax returns for the last two years, showing $18,500 and $17,800 respectively.

    I did not know at the time I applied for the K1 visa, that I wouldn't be able to use a co-sponsor at the Bangkok Embassy. have already asked my parents to joint sponsor an I-864 and they have agreed.

    When we applied for our K1 we put down my fiance's minor child on our visa. We were afraid it would be too difficult to get him on later. We do not plan on taking him abroad until we have both settled in the U.S.

    1st, Does applying for the minor child mean our household income has to be 3, even if we aren't planning on taking him? If so, can I just say 'self-employed' and send in my tax returns (which should be sufficient evidence)?

    2nd, What can I do to show the embassy that I do have income?

    3rd, Does the support of my parents mean anything in this instance? Should they write a letter? Fill out the I-864 now?

    Any ideas on what I can do? Thanks so much for your help.

    Scroll down to the figures on meeting 125% of the poverty line (The website is not updated for 2009, but you can find those numbers by searching on google). If you don't meet the income requirement, you can prove that you have assets in the amount of 3 times the difference between your income and the income level you are required to meet. The website says 5 times the difference, but I am pretty sure that in a fiance visa request, it is lowered to 3 times the difference.

    As far as whether you are working with the numbers for a household of two or three, I have no idea, since your fiance's son will not be living with you. I would try to call the USCIS and ask. Set aside 4 to 6 hours for this phone call :)

  3. I have a question, I hope this is the right place to post this. My fiancee lives in Thailand, she just went back about 3 weeks ago. She came here with the work and travel program, we ended up falling in love, and might have a baby on the way. I was wondering what is the quickest way to get her over here to the USA so we can get married? She has been looking into programs but they cost $4,000+ which we won't have for a few months, and then she will have to wait 7-8 months to be approved. I'm looking for the fastest way to get her here, we really really miss eachother, and these long-distance calls are draining my wallet. Right now we have a combined amount of $2,000 that we could drop down on visa applications, and we can quickly save up for the plane ticket. I'd do anything for this girl, please help me! Thank you.

    I'm sorry that you feel the urgency to get her over here, but most options will take some time. Perhaps she can do the "Work and travel program" again??

    But what option are you referring to that costs $4,000? Off the top of my head, I think the visa process has cost me a little over $1000 so far (various paperwork fees, medical examination, travel expenses), not counting a plane ticket.

    I use MSN chat and we both have web cameras. It's free and works good enough. For phone calls nobelcom.com isn't bad (8 1/2 cents per minute).

  4. Hi all. I am new hear and have just been reading to get info before I apply for a K1. My girl is in school now and will not be finished till May of next year I am trying to time this so that she will get her visa in June. All of the websites give a wait time of about 6 months maybe 7 but from reading hear it looks a lot longer I was going to apply in December of 09 maybe Nov but do you think that I should apply earlier? I dont want her to get this too early because as I said she will be in school. I am trying to time it so that her school will end I can fly over to BKK for a few weeks we can have a wedding party for her family and then leave together any advice.

    Welcome to VJ! Depending on the service center you file with (Vermont is taking about 45 days longer,) you are probably looking at 6 months. Look here:

    I am in California so it looks like they are a little faster now. I was just worrired because I see a lot of people on here that have taken 1 yr or more and I would hate to wait now and have to wait on the back side too knowing that I could have done it earlyer. maybe I will apply a little earlier and then we can take our time turning in the packets if need be.

    I would say you should apply pretty soon (in a month or two). If for some reason your visa process goes very quickly, you can always slow it down by waiting a bit between when your fiance receives the Packet 3 info from Bangkok and when she replies that she is ready for an interview. And then once she has the visa in hand, she has 6 months until it expires. I don't know about everybody else on here, but once I decided to prepare my materials for the I-129f, it took me about a month until I had everything prepared, collated, and copied and ready to be sent out. Including that time, it was ~7 months from the beginning until we had a visa, going through Vermont SC.

  5. I was just approved yesterday, Alan, so now I am in the final stages of finally getting her butt over here to America to marry me. I was waiting until the final, official go-ahead before I bought her a plane ticket.

    Korean Air has been one of my favorites. I like their seaweed soup. Last time I flew with American Airlines and it truly was "sorry." Even to the point where the stitching seams on the seats were coming undone. That in itself doesn't bother me, but it just makes ya wonder about the capability of the plane.

    For the past four years, I've been sporadically traveling back and forth to Thailand (first to study monkeys, but then after that to visit the woman who is now my fiance). Now that my fiance has been approved at her K1 visa interview (which happened yesterday), I really need to figure out some deal where I can earn flight miles for buying plane tickets to go back and forth to Thailand for the next ~50 years. Has anybody here got some advice for how to do this/ which airline to approach about it?? I plan to buy my fiance's plane ticket this week.

  7. My fiance just had her interview in Bangkok and should get her K1 fiance visa tomorrow. We are planning for her to arrive in the US in a couple of weeks.

    A good friend of mine is getting married in mid-September in Canada... If my fiance and I get our marriage certificate before then, can she travel to Canada and back for that weekend??? Is this risky?

    I would really appreciate some advice on this subject.

  8. I have filed a K1 visa, and now I need to fill out my I-134. My 2008 tax return income level is not 125% of the poverty level, so I will need to prove that I have assets worth 5 times the difference. I do have this amount of money, but I have it invested in stocks. I also have an annuity (I think that is what it is called) where I receive a sum of money every month from a lawsuit from when I was injured as a child.

    So, my question is: What documentation do I need to prove these assets? I can just send along the most current, formal looking paperwork I have, but should it be signed or notarized or anything? Can I just print out my latest stock value report?

    The woman in the US Visa Center said I needed to contact Bangkok's US Embassy, as every country has different requirements, and the Bangkok US Embassy secretary gave me an email address to contact which, not surprisingly, has never responded to my inquiries.

  9. I had a Bangkok US Embassy K1 visa Packet 3 question that I cannot get an answer for and I was hoping someone here could help:

    I need to prove evidence of my assets because my income on my 2008 tax return is less than 125% of the poverty level. I have money in stocks (which is more than 5 times the difference of my income and 125% poverty level) and I also have an annuity (I think it's called that) where I receive money every month from a lawsuit I won when I was injured as a child.     I sent my package in Jan as well. My Check got cleared on 21-Jan-2009. However I still have not received NOA1 and I get an error message when checking the status online.

    Any advice - should I call them about NOA1? I am starting to get worried

    Is anyone out there who is experiencing same problem as me?

    If your check was cashed, then they should have you on file, so I wouldn't be worried, BUT, you should have gotten your NOA1 by now. I would (try to) call them. I have no idea how easy/difficult it is to get a person on the line at the VCS....

  11. To Bonobo: It is up to you what you would like to do. I just told you what I think is doable based on my experience. It was more than a year or so ago, so USCIS may change its rule regarding the translation. Other people with very recent experiences should be able to tell you more accurately about this matter.

    Thank you very much for the help, I really appreciate it. Our I-129F is already sent, but in the future I think we should probably get the documents translated by a third party (a third party with a stamp) just to be safe.

    2 quick questions, if you don't mind answering them:

    1) My Thai fiance did her own birth certificate translation for the I-129F... was this a bad idea? Who should we get to do translations in the future?

    2) I am in the US and she is in Thailand... Do I ever need to go to Thailand throughout this process (I-129F fiance petition for a K-1 visa)? Can she go to her interview by herself with paperwork that I send to her, or should I actually be in Bangkok for the interview?

  13. Hi everyone. I just got my NOA1 for my fiance visa request. She is from Thailand.

    It seems as if everybody on this board universally has trouble at the interview process. Is this true? Are I-129F's from Thailand more difficult than others?? What is the big problem at the interview stage? I feel pretty disheartened after reading the experiences you have all had. Has anybody got any advice?

    We speak every day either through MSN messenger (when my internet works) or I call her. We've been dating since 2005, so would it even help for her to start calling me/ addressing emails to me?

    I appreciate any advice or info anybody can give me to help us out in this process.

  14. Hi Everyone. This website has helped me out a great deal and I just got my NOA1 on January 30th, 2009. Thank you for starting this thread.

    I had two small questions:

    1) My fiance translated her own birth certificate and signed her own "Certificate of Translator" page. The rules never said that you could not translate your own materials.... Was this a bad idea?? What did other people do for the translation?

    2) Are some countries more difficult for getting a fiance visa than others? Or do all countries have the same standards which the I-129F packet has to meet?

    I had a decent packet of materials I sent in, but not as much as what some others have posted (no ring receipt). I am scared of getting an RFE, but judging by the dates I see on Igor's list, it looks like RFE's are addressed pretty quickly at the service center once you send them the extra material. And every RFE is followed by a NOA2... so that leaves me hopeful.
