Call or visit the Embassy and ask, more than likely they will accept your I-130 petition without a problem.

Live Where? USA or Peru?
If Peru, why not marry in Peru and study, if you are in Peru for 6 months of longer you could file the I-130 for a CR-1 directly to the US consulate, this is MUCH faster than the other options.
http://www.visajourney.com/forums/index.ph...om&page=dcf
In any case the CR-1 is the best option, it takes about the same time to get, it costs much less than a K-Visa when you consider Adjustment of status. CR-1 gets a green-card upon entry to the USA allowing work and travel. K-Visas needs EAD inoder to work, EAD can take 90 days or longer to get.
currently i (the us citizen) am in peru. we both are. 6 months in peru is the requirment for filing the i-130 and cr-1 dcf? i don't think peru does dcf anymore...i don't find anything on the website.
i've read the doing the cr-1 is easier if the us citizen petitions from the states. will being here in peru complicate all that if dcf isn't an option?
thanks again!

my partner and i having some trouble figuring out if we should get married in peru, go with a k3 or cr1 visa, or go with a fiance k1 visa and get married in the states. we want to live there, as i plan on going back to school.
not to be a bother, but i was hoping to get some advice on why you chose to do cr1 and how it's going?

not to be a bother, but i was hoping to get some advice on why you chose to do k1 and how it's going? how's the affidavit of support? basically, since i've been living in and volunteering in peru for the past year +, i don't have a job or income in the states. i'm planning on going back to grad school in fall 2010(which provides tuition and living stipends, but i don't think that can be included on the i-864) and my partner plans on joining me (assuming all the visa things go well). my parents have agreed to cosign. i also have assets....given all this information, would it be a good idea for me to go back to the states and work awhile before the next tax filing season so that i can put my income, etc on the form (assuming i petition after april 2010)?
basically, i want to find a way that we won't get turned down based on the affidavit of support...but also a way that keeps us from being separated for long periods of time.
also. what is the 125% poverty level now-a-days?
any advice?
thanks so much!

If you've lived in Peru for more than 6 months you can do a DCF. You have to marry tho. He'll end up with a CR-1.
i've been in and out since the end of oct 2007 as a volunteer. i don't have residency. can i still do dcf? have to marry in peru? do i find that on the us embassy in peru page?
thanks again!

also.. what about k-3?

hello all!
i'm new to visa journey. my partner and i are having a hard time making a decision about how best to go the the states (to live). i'm only at the beginning this bureacratic headache of figuring it all out. i'm a us citizen, and he's peruvian (from lima). we both currently live in cusco. i was hoping i could get some advice on k1 and cr1 visas. if you decided to do a k1, why? if cr1, why? people say it's a hassle to get married in peru. what are your thoughts?
thanks so much!
i-864 joint filing question
in IR-1 / CR-1 Spouse Visa Process & Procedures
Posted
hi all.
so. since i have insufficient funds for the i-864, my parent(s) will also be filing the i-864. the asked me, since they've still been filing me as a dependent, is it necessary that they stop for the cr-1 (for this year's returns)? my parents can provide tax returns, but is it necessary that i claim my own deductions. i don't think i earned enough (as i'm an intern/volunteer in peru!) to be considered an independent....
basically, if they don't claim me...what happens? b/ci don't have any reportable income from 2008...so what's the advantage of them not claiming me? do they have NOT claim me?
thanks... tax things boggle my mind
