I have heard that at a certain point in the I-129F / K-1 visa process, my fiance will no longer be allowed to enter the USA on a visitor visa because USCIS doesn't want people to cheat and get married here without the visa being approved. Has anybody had any experience with this, and can you tell me about how far into the process they'll stop letting him in? He's coming in 2 weeks for a visit, but we're hesitant to plan more visits if he's just going to get turned around in Boston when he lands!! :(

    I have been to see my SO 3 times sice we filled for the K1. Each time I went thru the Buffalo NY POE it has gone something like this

    Where are You From?

    Where are You going?

    How long will you be there?

    Where did you meet?

    What do you do?

    When do you expect to return?

    What are you bringing in the country?

    When was the last time you were here?

    Because I am from Canada I dont need a vistor visa to enter the USA but I am sure if you can provide sufficient evidence that you are planning to return to your home country there is nothing to worry about. I usually bring a copy of my flight itinerary and a copy of my school schedule and they have only ever asked to see my itinerary, nothing else, Well the last time the boarder guard guy did make fun of me when I said I met my SO in World of warcraft, I loled at him because he didnt know what WoW was and said " girls play video games too" .

    So currently you are in the K-1 process and when you are at the border/immigration, do you tell the cbp officers that you are going to visit your fiance? Do you have to provide some sort of document or is it associated with your passport? I am currently considering applying for K-1 and the only thing that is upsetting me is that I won't be able to visit my fiance during the process. Do you know if they will let us visit until the process is complete?

  2. You know, when we were adjusting I was in a constant panic looking for a case of misrepresentation based solely on adjusting from a tourist visa.. I never found any. The cases I did find were always complicated by fraud (using someone else's passport) or criminal background etc.

    I'd be interested if someone did find a link. I have since stopped my search since we successfully adjusted.

    I am in the same situation with regards to experiencing constant panic. My situation is this: I am Canadain and my fiance is an American. We want to get married in the United States and then apply for AOS, as recommended by an immigration lawyer. This has been our plan all along because we were told that it is much quicker. However, since that interview I have been doing much research and have heard a lot of discussions regarding fraud and misrepresenting oneself at the POE. I mean, if I went across the border to visit my fiance and told them I was going to get married, they would not let me in the country, yet if I told them I was visiting and then we got married I would be misrepresenting myself. But how come there is paperwork that lets you adjust your status if you are not "supposed" to do it this way? How do they determine who is lying and who is not? My other concerns are that I have slowly been planing for my visit to go back and get married and therefore don't have a job. Is this going to come into play? I just had no idea until recently that there was a possibility of getting denied or banned????? for going this route? And now i am scared and uncertain as to what I should do.

    I would like to know your situation and the outcome. Did you enter as a tourist knowing you were going to get married? What was the interview like and etc.? I would really appreciate hearing your experiences because now I am not so sure that this is a good way to go but I know it is the quickest.
