Hi my friend is here on tourist visa from Indian and an he has met with people from a company that like his resume and qualifications and would like to apply for an H1B for him this April 1.  Is it possible to do that while he is still in the US? And his 6 month tourist visa time frame is until mid July...so is it okay if he is out of status until October 1 if he is H1B is approved but doesn't take effect until H1B?  He currently has a bachelors degree in business administration. 

Hi all, to close the loop on this, we did indeed receive approval on GC and received them in the mail via Priority Mail on Friday 10/28 (1 week after it said it was approved)....I guess anything is possible!

Did you file a concurrent AOS case? Those have a mandatory interview. I think something is wonky.

What do you mean concurrent AOS? We filled 485 for both parents at the same time along with 130 (Alien Petition) and 785 (Work) and 131 (Travel).

And we should be receiving a letter saying that soon and production of Green Card should be ordered and sent out to us.

BTW we did use a lawyer to help us with this application. And they originally entered the US on a tourist visa

131 (Travel):

On October 24, 2016, we terminated your Form I-131, Application For USCIS Travel Document, Receipt Number MSCXXXXXXXXXX, because the applicant or petitioner received a status or benefit through other means. We will send you a termination notice. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

BTW, don't look at my timeline on here because that is all from my wife's K1, AOS, ROC, USC journey, below it is for my in-laws.

Sent to Chicago Lockbox: 2016 8-12
Mom: AOS/EAD/AP NOA1: 8-23 (text on 8-23; received letter on 8-27)

Dad: AOS/EAD/AP NOA1: 8-24 (text on 8-24; received letter on 8-29)

Mom/Dad: Biometrics Appt: 9-22 (received 9-10)

Interview Appt: never happened!!!

Can't believe my wife's VJ is over...it's been a long process but the support of this community has made it bearable over the past.

Please update the timeline for her Oath date was 4 October.

Hi guys -

For those of you still reading this, I wanted to update you on our journey. My wife had her interview today at 26 Federal Plaza in Manhattan. ITw as scheduled for 8am and she arrived there on time at 7th floor. A few minutes later her name was called and she was given a yellow sheet and asked to go to room 800. Once she checked in she gave them the yellow sheet and was given a ticket number 511. They were not calling people in order as she said it went 506, 503, 513, then her 511. She got called at 9:50.

She met with an officer who asked first her Passport and Green Card. Then she test her on 6 questions (which she got write) and asked her write Thanksgiving is November. She asked her other questions like do you guys file taxes together, and where do you live, etc. Then she said since this was a marriage based application she would need to submit more documents and given and RFE yellow letter and document that the Officer made check marks on what she needed to resend by September 16th. The interview lasted about 20 minutes.

So now we need to send in the following and the address is actually not the USCIS offices nationally but locally where she interviewed.

1. Joint Account "2x Statements" for 2010-present Not sure if this means 2 copies of each month's statement or 2 random months...any thoughts?

2. Health Insurance Policy showing coverage of spouse

3. Copy of Deed (I'll send this in but it's only in my name since, I bought our condo before we were married)

4. Marriage Certificate

5. Her birth certificate (which I thought was odd)

6. Tax Transcripts for 2010,2011,2012.

Now I've requested the 2012 IRS transcript (had 2009,2010,2011 - ordered before) and we are good to send in everything. Hopefully it comes in the 5-10 days they said on the phone.

It's strange as all the above was already in our application and my wife had it with her but they said to resend just this info. The officer didn't ask to see my passport or anything else.

We've never had any RFE throughout our Journey so hope to send everything in as soon as the 2012 transcript arrives.

At the 90 day point (On July 8) from when my wife was placed in line for an interview we called USCIS. They told us they would follow up and we should expect an update within 15 days, and on July 10th the website showed Interview was scheduled and we just received the letter last week scheduled on 14 August.

Hoping now for a quick remaining journey...so jealous many of you guys are done!

My wife is still waiting for her interview. We have called USCIS to follow up and they said we have to wait 90 days from the time she was put in line for interview (April 5th) before escalating this and they said NYC was still processing August, but then I see others in NYC having theirs.

My wife's status still says..."

On April 5, 2013, your N400, APPLICATION FOR NATURALIZATION was placed in line for interview scheduling.

Any thoughts on what we should do?

My wife was put in line for interview on 5 April. She didn't receive a text or email though, I just happened to check today on the USCIS website. Have others received text/emails?

My wife didn't get a chance to do her Bio early so just went on Tuesday when it was scheduled, she was in and out within 15 mins at the Varick Street location in Manhattan.

Did you guys receive a text or anything afterwards? The USCIS website also only shows the old notices saying on Feb 14 the mailed her a fingerprints letter.

I've been down with a severe cold lately, so haven't been updating. Our package reached on Thursday 2/7, we received a text and email on Tuesday 2/12 say it's being processed and then noticed our check was cashed on 2/12 as well. checked online and found that the case as under initial review when we typed in the case number as "NBC*000000000"

My wife's package was delivered today according the USPS website at 11:18 (less that 22 hours from when it left the Rockefeller Center post office)! We went with the USPS Express Mail route which cost about $19. I chose to waive signature since it was a PO Box.

Fixed CorinaN - Dallas, TX.

Sent mine today via Express Mail USPS - to the PO Box 660060 Dallas, TX 75266 address, should be there tomorrow at noon.

Yes we applied for ROC and she received her 10 year GC on 12/10/12. We received our Conditional Green Card dated 5/5/10 and I see that ScienceNerd had received it the day before, so we are just behind them. Sending ours on 6th - Wednesday.

I think it has to be 3 years since she became LPR... On the forms the question states "at least 3 years". I'll let more experienced folks correct me if I am wrong.

May be a silly question, but you guys lifted her conditions, right? Your timeline seems rather short at first glance.
