I was waiting impatiently to get my biometrics appointment letter for, like, more than 3 months now. After making some phone calls and e-mails with USCIS and looong wait (they were pretty frustrating), I finally figured out that my biometrics data is "current" since I did it within the last 15 month to get my Reentry Permit. Now I just have to wait. I hope I'll get approved before my biometrics data expires

I just asked my immigration lawyer friend about this matter, and he said marrying on a tourist visa in the US, even without the intention to stay, is considered just as illegal as marrying on a tourist visa with an intention to stay (at least among immigration lawyers, and also immigration officers at the border). If OP wants to be with his fiancée as soon as possible after January without cause USCIS to have any suspicion about the case, his advice was to bring her to the US and marry her after 60days of her stay and apply AOS, though you'd have to postpone January wedding in this case. He did agree that doing it in your way might work, but it's not legal, and he cannot recommend that to his client. Also, he said revealing your intention to marry a US citizen (even without an intention to stay) on tourist visa at the border is almost a sure way to get you sent back.

I sort of agree with Brit Abroad that OP's lawyer needs to work within the law, and cannot give you advice that even borders on being illegal. I also believe that other VJ people's experiences show that you probably won't have trouble getting the greencard for your fiancée if you do it your way. But I also don't think that your lawyer is an idiot or money-sucker, at least based on the advice s/he gives you for this matter.

I think I pressed 1 (for English) + 3 + 1 + 2 to get a human on Tuesday (thanks to VJ search). Note that they will ask to speak to your husband/wife to make sure you have their permission to ask for a service request.

Today we got an email from USCIS: "... your biometrics appointment is pending due to limited capacity at your local Application Support Center (ASC). Once an appointment becomes available and you are scheduled, you will be mailed an appointment notice informing you of the date, time and location of your appointment. USCIS apologizes for the inconvenience and appreciates your patience."

So we get a backlogged service center AND a backlogged support center. What luck.

Thanks for sharing this update. I haven't received any e-mail from USCIS yet, but since we're both in NYC, I presume I'll get the same answer soon...blah!

As for the call to the national service center, since I am the applicant, they didn't ask to talk to my husband before putting the service request. But yes, when my husband called on behalf of me earlier, the officer requested to talk to me (applicant) first.

What number did you call? I am in the same boat - still no bio appointment and based out of NYC. I will be much more concerned about the delay when I see an April filer having received a VSC bio letter. At this point, it seems VSC April filers have no bio appointments.

I called the national service center, which is 1-800-375-5283. But it's a bit tricky to get a live person, because if you press the number for "I know my receipt number" or something of the sort, it just gives you an automated message. Here's what I did. Once you connect, choose language (I chose 1 for English), and then choose 2 to check the status, and then choose 6 for "I don't know my receipt number" so that you can talk with the customer representative. Once you get connected to the customer representative, s/he will take a lead and ask you bunch of questions, and will eventually put a service request for you if haven't heard anything for more than 30days after NoA came...or at least that's what my officer did for me.

I'm actually getting a bit anxious because no VSC filers in April hasn't gotten any biometrics appointment yet. It seems like VSC is taking a break from giving people biometrics appointments at the moment

I think so, too. NYC must have a large number of immigrants. Even so, I can't help but hoping they will be a bit quicker

I just called the national service center and talked with an operator. Here's how I did it:

1. Call 1-800-375-5283

2. press 1 for English

3. press 2 for check on case

4. press 6 for "I don't know receipt number" (though I did know my receipt number, it's just a way to connect to the operator. It seems like the operator didn't really know what I pressed, and started asking manual questions to figure out the reason I called. She also asked me my receipt number and I gave her one, and she wasn't like, "Liar, you indicated you don't have a receipt number!!" but more like, "OK, give me a moment to see what's going on with your case" )

I'm having the same situation -- filed in Feb, did biometrics on 3/24 in NYC, and still can't check my status online. But I already got an interview notice letter, and I've read so many people saying online status is not reliable, so I'm not too worried about it. I may call and ask after a couple of weeks.

I married my wife in early February 2009. She was here on a tourist visa so we filed the I-130 and I-485 concurrently. The NOA was dated around the 26th of Feb or so. She had her biometrics appointment in NJ on the 24th of March. It's now April 13th and still no updates on the USCIS website for either of our case numbers (the I-130 or I-485).

So my question is, what kinds of delays are people seeing these days? I read that often there are no updates until after you complete the biometrics, but that was 3 weeks ago and still nothing.

If anyone is on roughly the same schedule I'd appreciate your comments.
