Happy to help.Your wife obviously arrived in the US before your second year wedding anniversary, hence she got a CR visa category which means Conditional Residency.The visa pasted on her passport when she arrived in the United states is only valid for 6 months so that accounted for the expiration on her Visa.You will need to file for the "Removal of the Condition" Placed on her green card cos its only valid for 2 years under CR1 category.Try to read more on here about removing conditions on green card,after this is successful she will get 10 years green card.You must file for this by June 16th this year which will be exactly 90days to the expiration.Note:This is the Rule.I will help you out with more information later cos I have got to go now.I am very sure that other VJers will be able to help you out.Smile

    You said we have to file BY June 16th, so can we apply for the condition to be removed BEFORE June 16th? e.x. Could we do all the paperwork and send it out next week?

  2. Here is my question...

    My wife has been with me in the US since September 16,2009, her visa says it is a CR1 and at the bottom of the visa it says "IV Expires on" 19FEB2010. So, does this mean her VISA is no longer valid, and she cannot travel out of the US?

    p.s she does have a green card (permanent resident card) and a Social Security card. She has had them for quite a while now.

    Lastly, one more quick question...Her green card expires on 09/16/2011. What do we have to do now so that she can stay in the country past 09/16/2011?

    My wife has received her CR1 Visa and is now living with me in Arizona. I am really just curious what the next step is for my wife? Do i need to get her a green card? do i need to do an Adjustment of Status? get her a social security card? I want to make sure I get her all the required documents.

    If she came in September with a CR1 visa and doesn't have her green card yet, you have a problem. The same is true for the SS Card. What I'm seeing currently is both arriving within 30 days. You may have failed to check the box requesting an SSN and Card on the DS 230. Just go see the SS office near you.

    Did the CBP officer take the sealed envelope from your wife when she arrived?

    Are you sure it was a CR1 visa?

    yes, I am positive it is a CR1 visa, her passport stamp has CR1, and so does her VISA. it has only been 1.5 months since she has been here, so it may take a little longer.

    and I am positive i checked the box on the DS 230 :)

    or is the FIRST thing we have to do is get her an appointment with USCIS to do biometrics?

    or is the FIRST thing we need to do is file an Adujustment of Status form?

    First thing you need to do is just enjoy having your wife home....

    With a CR1 there is no Adjustment of Status, she was granted immigrant status at the POE. Her green card & SSN should arrive within a couple of months.

    Within 3 months before the 2 yr anniversary of her admission to the US you will want to file for "Removal of Conditions". Right now she has Conditional Legal Residency, the condition is being married to you. Once the conditions are lifted she'll be issued a 10 year Green Card.

    Our case is completed at NVC...took a total of about 3 months since i sent the I-130.....

    What can I expect now? They are going to ship the packet to the Embassy (Colombo, Sri Lanka)..and then will the Embassy assign us an interview and medical...or is that something we must do ourselves?

    My wife is from Maldives and she will be attending her interview in Colombo, Sri Lanka......

    Has anyone had experience with this Embassy? Are they pretty easy on the questions asked?

    If you have had experience with the Embassy could you tell me what sort of questions they will ask my wife, so she can be prepared and not scared to go to the interview..

  9. paid the 400 and the 70 fee.. now while still waiting for the passport of sophie what i did first is send the i864 coversheet together with the supporting docs? is it okay if i wait till we get the response from nvc first and wait till passport of sophie comes before we send the ds230 back? im so confused coz last time what we did was i864 and ds230 altogether..help

    I actually called NVC TODAY and asked that same question..they said that I can go ahead and send the DS-230 off as well....so i'm sure it is the same in your case...

    I, unfortunately can not send off the Ds-230 yet because I have to wait till ig et some documents from my wife :(...so sad for me and my wife..blahhh

    So it looks like i will have to send only two more forms...the I-864 (AOS) and then the DS-230 (Application for Immigrant Visa and Alien Registration)

    This is just getting a bit confusing to me.

    So Imaisha.....was i correct on that at this point it should take a few months longer?

    Chris, how long it takes at this stage is totally dependent on your individual position. I had all of my packages prepared and ready to go before getting to NVC and it still took 37 days for them to complete it. You'll have to do some research on how to acquire the police reports and other certificates and how long those will take. It also depends on how prepared you are financially and if you have the appropriate documentation to hand for that as well. I also don't know how long the wait for an interview in Sri Lanka will be. Some embassies are busier than others. Maybe someone else has some experience with that one in particular. Best advice, get started on preparing your packages now, you don't want to lose any more time. Best case scenario you could be done in 3-4 months. That's a best case. It could obviously take much longer...

    I sent the AOS packet to the NVC today, overnight USPS......

    Now I have to have my wife send me the birth certificate, police records and passport photos then i can send the IV packet off...

    Do you know if a certified copy of the birth certificate and Police records can be FAXED? or would that be considered photo copying?

    I think I may just take a wallet size photo of my wife and just try to enlarge it and make it like a passport photo.....its the same format as the passport photos, just smaller...

    I feel like the process is going a lot faster than i thought, I just submitted the I-130 about 2 months ago and now I am pretty much done :)

  12. Hey everyone!!

    I have been browsing the website for sometime, but never have posted yet! This is such a great website for information regarding visa's :)

    Anyway, here is my situation......

    I filed for the I-130 in March, got the process expedited (military) and it was approved by the USCIS in April (may have been May, can't really recall) and sent to the NVC.

    Now at the NVC, I am at the step where I have just paid the $70 fee and now the $400 fee....and I am just curious what the next step is going to be?

    I actually paid the $400 fee without receiving any notice in the mail, i logged into the "online payment" to check the status of my $70 payment, and then at the bottom it showed that $400 was needed, so i just went ahead and paid it, knowing that it will have to be eventually paid anyway.

    one last question, from when you pay the $400 fee, about how long until the spouse can actually enter the United States? I am thinking a few months probably? 3-5?

    This is my situation, I am a US Citizen and currently serving in the US Military and I have recently traveled to the Country of Maldives for 30 days and married my Fiancee' of 19 months.

    How in the world do I know get her to America so she can live with me? What is the fastest and easiest way to do so? I also live in North Carolina, if that makes a difference in which office I have to go to.

    Also, are things easier since I am a member of the US military?

    What forms must I fill out? and what must my wife do on her side of the world?

    oh really? hmmmm I will do that on Monday when we get back to work.....any other ideas? How did you know to contact the JAG office? Are you married to a foreign national and in the military as well?
