  1. I would wait to book a flight. First you don't know if the visa will be approved and then you will be out more money to change the flight. Also, you do not get the visa right away, they will tell you come to come back in a few days to pick up the visa. This is my experience and it may not be the same for all. Also, if I remember correctly, the interview was set-up somewhere like a month or more in advance of the actual interview.



    When my wife went for her interview, I was not there with her. She passed on her second try, we had an RFE. When she did pass, they advised her to come back in a few days to get the visa. Once I got confirmation from her that she passed I booked a flight to Cambodia to travel back the U.S. with her. Once we had the visa in hand I started to book a flight for her to come back to the states with me on the same flight. I would suggest travelling with your significant other, especially if they have never flown before. There is no direct flight from Cambodia to the U.S. so there will be transfers from one gate to another. This can be overwhelming for someone who has never flown or speak English, as in the case of my wife. I am guessing you will have a lay over in Taiwan, Japan, or S. Korea, which are all big airports and can be very confusing going from gate to gate. Then when you arrive to Seattle, you will have to go through Customs and Immigration, depending on his proficiency with the English language, your presence would probably be very helpful to fill out the forms and deal with the agents. I brought copies of my documents for the K-1 visa with me just incase there was any problem going through Customs and Immigration.

  2. Used to live there. Just came back to the state last year. My friend is going with K-1 on May 2012.

    This laws started around March 2011, they gave me a hard time to obtain a marriage certificate (that's my case). At that time I still had my valid Cambodian passport, I had to #### off those officials and withdrew all my English documents.

    I had to teach them about laws, seriously. I am a Cambodian and my wife is too. So give me my marriage certificate.

    BTW, initially I agreed to give them several hundreds dollars so I could get it on time. But hell broke loose, and 3 days before I took off I still didn't have it.

    If you go K-1, easier in Cambodia, but harder in U.S (AOS).

    If you go CR-1, harder in Cambodia, and all set when he step in the U.S.

    You mentioned you already met him personally, you should not wait. you can file K-1 tomorrow.

    It's free, but trust me. You will get no where if you don't have a grand for them.

    I would have to agree with Chet, I do not know about the mariiage visa, but as for the Fiance visa it was pretty easy, as long as everything is good with your background and employment (income). When my wife and I were filing four documents I found that money talks over there and it helps if you know people. My wife was able to get a new passport in 3 days, by paying a fee of course and she knew somebody in the office. As for the translation, I used Pyramid in Phnom Penh, they stamp their seal on the translation, make sure to ask for multiple origianl copies and also make some extras. I am in the process of of removing my wifes conditions, and I have done all the paperwork myself, this site has been a tremendous help. Heed everybodies advise, they have been through it.   3. My wife and daughter had their Bio done Friday at the Portland, OR office. They were really busy, but very organized, the site supervisor was running the chick in and she had everything under controll, I gave her kudos for being so organized. Now we wait for the interview on the 30th and hopefully will have an answer soon afterwards. Good luck to everyone!

  4. With drug-related charges and the fact that he's been here for at least nine years, probably not a good idea to use the name BigBong when asking about overcoming the drug issues.

    When your name is BigBong and you ask about marijuana charges, people are going to make a fairly reasonable connection.

    He didn't say he has been here for 9 years, he said it happenned 9 years ago. But, I do see your point on the name. hahaha

    In his defense, Bong is a form of respect for your elders, it is what you would call anybody older than you.

    Also, I think if you are upfront with it, state what you stated here, and also being 9 years ago you should be ok, but don't quote me.

  7. I was wondering if there was a way for me to bring my wifes' niece ever here to the States. My wifes' sister and brother-in-law would be willing to sign whatever papers needed to get her here. I would and could fully support her. Our niece is about 4 yrs old. Is it possible, What would i need to do, and what is the timeline for it? Thanks for any input.

  8. If you can, try to get it translated over in Cambodia. I found it cheaper and easier to do there. Pyramid is a good company that I dealt with in Phnom Penh. While you are at it, get a couple of copies of each if you can. I got her police report, birth cert., and what ever forms you have in the Khmer language. Good luck.

  9. hey Dyna - tell your fiance that if you two marry whilst a K-1 visa is 'in process' - then the K-1 will be considered useless. If the Embassy learns you are already married, on interview day (for the K-1 visa) then that visa will be cancelled, you cannot come into the USA on 'that' visa.

    He'll have to refile a new petition, not a K-1, but an I-130 petition, starting all over with a new timeline, new process, new forms, new everything..

    Perhaps would be better to have 'engagement party' for you two, for your family and friends, in your country, prior to you leaving ???

    Dyna, I see that you have already gone through the K1 visa process and passed the interview, congrats! When I went, my fiance also wanted to do something for her parents. I explained to her because we did a K1 we could not, so we decided to do a Juop Lieang. You need to remember that you must marry in the US and not in Cambodia or otherwise you will have to start over with the spouse Visa. Again congradulations and enjoy getting through the first hurdle. :) Dar

I went to apply for my Fiances' SSN today at our local office and was told by the officer that because my fiance has not been here for at least 10 days we could not apply for it and to came back after she has been here for at least 10 days. I hadn't heard any of this mentioned on here before, so was wondering if this is new, or a bunch of BS. :huh: The guidelines says to apply right away. I provided Origianal BC and certified Translated copy and also her Passport with I-94.

  11. I just wanted to let anybody who has to go through the Phnom Penh Embassy and gets an RFE. If you have to hand deliver the paperwork between a specific time, make sure you are there plenty early. My Fiance went to turn in our paperwork and she was like the 23 person in line. Of course they only let in the first 20 people in line and told the rest to come back the next day. This would have been good info, since my fiance had to travel 6 hours to get to Phnom Penh, and now has to stay an extra night. Just a little inconvenience, but would have been nice to know. Hope this helps someone else out.

    im doing k-1, my interview date is coming soon, i wonder what is the different from form ds-157 and form ds-3052 ?, i think i dont need form ds-3052 if i have form ds-156 and ds-157 already. but im really sure about that.

    Dyna, Form DS-3052 goes along with form ds-156. On the top of the page of the ds-3052 it states that is is to used with form ds-156. Good luck on your interview. I will be in Cambodia for the Water Festival starting Nov. 1rst.

    My fiance had her interview today and they gave her a pink slip with 2 boxes checked on it. The boxes state:

    1) The interviewing officer requests that the petitioner explain in detail the development of your relationship fromthe time you met the applicant until now.

    2)Other: (handwritten) Please explain 1996 criminal charge for "assault" in full detail. Explain any other problems with the police.

    I don't have a problem with the first box. What I would like to know is why would they ask for this if I had already sent them a certified copy of my criminal history. I am hoping they are thinking that when they asked my fiance if she knew if I had any run-ins with the law. She said yes, back in 1996. They asked if she knew what for, and she said she didn't remember for sure, but she know I got into trouble then. I was thinking since it was an assault they are wanting to make sure she is aware of my past. Hope that is all it is.

    Now the real question, should I have the letter notarized and should I also send another certified copy of my Police Report with this new packet?

    Oh, one last one, it says we can come to the embassy and turn it in any time between Mon-Wed, 1pm-3pm.

    How if anybody knows might it be before we should know if she is finally approved or not.

    Don't think of this as an RFE. It's a "denial" with an opportunity to overcome the initial denial. Take this very seriously. Obviously, your fiance was not fully informed about your assault charge. That's what IMBRA is about. The evolution of relationship request indicates the interview didn't go well. They have serious doubts the relationship is bona fide. Keep both these things in mind in your response to this denial.

Pushbrk, I was wondering about that, though the embassy had her go through the process of paying for the Visa, could it still be denied. I plan on sending everything they ask and then some. My fiance and I have spoken about this a few times, but it was early in our relationship. I have nothing to hide, as I feel it was the ex-wife trying to get the upper-hand in a child custody battle from back then, all is good now and kids live with me. Again, Thanks for your input.

    The fee is a visa application fee paid whether granted or denied. Look over the blue paper and see if you don't find the word "ineligible". Trust me, this is a 221g denial with an opportunity to "overcome" the initial denial, so you would be wise to treat it that way.

Please supply the information indicated below." It only has the 2 items checked as stated above. Then at the bottom of the page it is checked in the area to hand deliver the paperwork anytime from Mon-Wed from 1-3. Dakine, thanks, that's not a bad idea. I will have to ask her to do that.

    Ok, but I'd still take it very seriously. The letter explaining her understanding of your criminal record in detail is a great idea.

    I don't think I've said it yet, but THANKS to everybody here and this website. Without everybodies help, even when I ask stupid questions, has been great. I can always expect to get very educated answers here. Now I will try to return the deed to someone else in need. Thanks again.
