Hello,
My wife and step daughter came to America on a K1. They recieved their interview appt. K1 Visa to Perminant Resident..In the letter it states amongst many other items that we have however, for me (spouse/sponsor) to bring "Birth Ceritficate"..I have never been asked through this whole process to produce this..My US Passport was enough evidence to proveto get this far..I ordered a copy of my Passport from Philadelphia Pa. but, it will not be here on time for interview..
Any suggestions ? Can she be denied ?

I am not sure if this is the correct forum but, can someone help me..
Backround: We submitted our i-485 (Adjustment of Status) for her to become a perm US resident becasue we got married in December. I sent the package UPS overnight to Chicago Il USCIS office to be delivered by Feb 5 10am. UPS is unable to find the tracking (the package may be there) but we cannot confirm until Monday when the UPS store opens up (appearantly I have a different #) that the 1-800 UPS or online can find..
Question: Her K1 expires Feb 5, (her visa expires May 1) if the 485 application package is not there it will be late - What happens if this package is late >?

Thanks for your response...I think I understand but one..You say that I have to submit a second application for her daughter - - Does this mean that I must pay ~ $1100 for my wife, and another $1100 for her daughter ?

Hi All. We made it this far and have a couple questions regarding the I 465..
Brief History
-We recieved K1 Visa and she entered the country on November 7.
-We were married December 14.
-I am American, She is Peruvian
-She has 1 child here with us age 5
Questions:
1. Question # 6 - Police Clearances! Is this required, she had a backround check in Lima Peru prior to obtaining Visa?
2. Question # 7 - Medical Examination, It states that "When Required" does this mean we submit this only of requested. It seems this question conflicts with question # 8 that states if in USA on K1 then only vaccination docs are required. What do we submot with I 465 ?
3. Question # 17 "Derivative Status" I am an American citizren, does this apply to me ?
4. Question # 18 "Other basis of Eligibility" It gives no expalnation. What do I submot here ?
General Questions:
1. I see nowhere that it asks for our Marriage Certificate ? I am sure this required - is this tied to question #3 above ?
2. Do we have to fill out additional form for her daughter ?
3. Do I read this correctly that, If we submiot the work permit application (I 765) attached with I 456 the $340 fee is waived?
4. Is there any other forms. or documentation needed from us ? I was told that we would need proof that she is on my bank account, insurance, etc?

I had the same issue.. What I did was put all the calling cards on the kitchen floor and took a picture of them and submitted with my I129F application..In hind site, I don't think it was neccassary since all you really need is "proof of meeting each other" within the last 2 years (plane tickets, photos, hotel reciepts etc,,)
In my opinion, we look into this too deep....You just need proof that you have been together for 2 years and, physically met each other,,

Hi All. I just got NAO2 in the mail today. It states that "Pettition has been approved and forwarded to the Consulate" Based on reading some threads on VJ, it appears the NVC processes the documents and forwards to the Lima Embassy (about 3- 5 days)..But some threads say, the NVC processed very quick and some took 3-5 days..Anyway, most threads state that they should call the NVC for status ? Should I do this now or, wait a week ? Also, I have not received any requests for Tax returns, Proof of Income etc. ? Can anybody tell me when this info is requested ? Will these requests come to me or, my Fiance in Peru ? Can I view the process of NVC on-line anywhere ?
Also, during the interview that is conducted at the Lima embassy for her Visa - am I allowed to attend this interview or, do I have to wait in a waiting room while she is interviewed ?

It's been a while since I have been on VJ because it was frustrating.. My Fiance told me today that a friend of hers she met on VJ from the same town in Peru recieved her NA02 today..They had NA01 as of April 22, 2009.. Has anyone seen the prior stats ? Igors list still has 50% approval rate for March - is this typical that VSC jumps around like that..I thought they would process all of March before moving on to April..This has me a bit exited, based on this 1 couple stats, My May 1 2009 NA01 may be approved in less than 5 months..

Based on previous posts, getting married prior to recieving your K1 will cause you lots of aggravation. I read were a couple were married in India (due to local customs) while waiting on a K1 approval..When they got the K1 approval and got to the embassy for interview were denied and had to wait 3 years for a new application..They were trying to appeal it and hired a lawyer but, I am not sure how it ended up.. I would play it on the safe side and wait until you recieve the NA02 then plan your wedding..USCIS is like a machine, if you break a link - you will be back at the starting line again..They can actually deny you for up to 10 years for falsifying a federal document (i.e applying for a Fiance visa when you are already married). It's not worth the gamble

I seen some posts out there that say VSC is now at 7 months. Based on Igors list, it still appears to be shy of 6 months for VSC..Also, I seen a post out there from an April Filer from VSC that stated their timeline got pushed from late August to mid October.
My specific question is: Is there tracking of individual timelines out there ? If so, where I do I find it at ?I am still working with the 6 months for NA02 but, hoping Igor's stats are accurate and have NA02 in 5 months..
ps..I also agree with alot of folks who said they are taking a break from VJ..It really does appear to make the time move slow..

My understanding of the USCIS is that if you are in this country illeaglly, you must retuurn to your home land and applu for a K3 to be married,,That is assuming they waive the 10 year ban, What kind of wedding and, divorce did they have (was it official) ?..

It seems that the Calif. Ctr is smokin through the NA02's. They are half way through march and Vermont just started Febuary (according to Igors list)..
is this typical ? or, is there certain times of the year that 1 center is ahead of the other ?

based on all the info this site offers, my target date for NA02 is October 2009. Is there anything I should be doing to prep for the next step ? I am still a bit confused on the NVC role after the NA02 is issued from Vermont..I seen where some folks got hung up at that stage..Any way I can deflect that process ? Also. Lima (Peru) specific timelime states 2 days after interview = Visa can be picked up at DHL,
1. How and when does the Paperwork arrive in Lima ?
2, How will she know when / where to get shots / Police History etc.. Can she do this now ?
3. The BAD one..I screwed up the g-325a, I forgot to add the District ..(I had, Country, State, City. and street also, she no longer works at the place where we put in for the Phone #.
4. Is there anything I should be doing in the USA in the meantime ?

Can anyone tell me why the USCIS website changed it's timeline..Before t said dates as "6 Months" now, it says "November 28 2008,,
What does this mean ?

I noticed that USCIS updated their site to show they are now procesing apps as of March 31, 2009 and, K1 still states 6 months..Does that mean those that are processed as of March 31 will take 6 months ? or, is the 6 months from the dates NA01 recieved..
also, when an app is "touched" will it actually state on the website I registered for w/ reciept # ? and, does it state why or, what they did with it ?

I mailed my I-129F to Vermont on April 28th (regular mail from Richmond. Virginia). The check cleared my acount on May 1, 2009. On May 7th I recieved NA01 letter with an NA01 date of May 1...
My omly suggestion as to 'What happens next" is, read these Forums - I have come conclusion based on VJ stats and, Igors List that NA02 should be approved in 4-5 months...Barring no problems !!!

What exactly are you looking at to determine that the VSC is slow ? I'm a newbie with an NA01 of May 1, 2009 but, all the stats I see on VJ leads me to believe that NA02's are coming in at about 4 months - USCIS states 6 months..I think it is much better than the prior years ?

Mike, Absoloutly - but, I did not use excel I used Access..One slight flaw was i could only generate a region - it could not pinponit the available girl based on data I entered..So, I did the Venzuala, Brazil, Rio, (nott Columbia), Costa Rica truips and then finally Lima where I found the pefecet girl..
Basically is was my homegrown Match.com with international womam..25 years with an American woman - NEVER AGAIN.. A bit an ortahadox but, the sufvivani;ity of our marriage is 97%. if, my calculations are off - then a ma turning gat and moning to San Francisco.
Ps,, After these threads, I went back and reviewed my data and the Philipines was 2nd to last only to be followed bt Russia

I must say and vent my frustration. I am an american born citizen of italian decent (My grandparens came over and slaved in the coal mines of north east PA..I was married for 25 years to an american born girl and, after 25 years she did the same thing to me as you are doing to guy # 1. During the first year of my divorce - I reassesed my life and realized I dont want that to ever happen to me again.. So, I spent a year building a database extrapulted data from every dating site in anerica and around the world..To try and pinpoint what cultural girl would be perfect for me..I came up with 2 regions..They were Asia / PAC and South America..Asia was too far for me to travel, so Is spent a year in South America and found a beautiful Fiance in Lima Peru..I have been visiting her every month for 2 years and maintaing an aprtment down there for the last 18 months..
When, I seen your posting and looked back on what I went through in visits, application and support (10's of the thousands if dollars) - I find it sickening..and, based on the fact that you are Philipino - I am gald I did not visit the Asia Pac region for a wife..Did you think this was an overnight process ? Did dyou thing the US Govt doesnt have a computer and, 2 petitions would not draw a red Flag..Hey baby, this system was bulit in America not Iraq..
Your thread has been entertaitning, and I think the best advice you received is to to be honest and get 1 of the guys to to recind his petition. Becasue the folks here on VJ are very intelligent and understand the Immagration Laws (They helped me tremendously) but, what you are doing is FRAUD and, you will be banned from ever coming to the USA> What, no single guys in Manilla ?

OK, I learn something new everyday here..I have been w/ the same company for 15 years, earn plenty of money to show support and can supply paystubs and tax returns.. Is the letter from my employer a requirement ? I work for a Fortune 25 company, getting HR to supply me with anything is like dealing with the USCIS, When and whom do I need to supply this info to ?

in Bringing Family Members of Permanent Residents to America

Hello,
It's been 2 years since my wife came on a K1. She is now a permenant resident. We want to bring her 14 year old son. Initialy, he would like to visit for a month or two and return to peru. What is the best option where he can spend timne with his mother in the US and father in Peru ? What are the ups and downs of each. Do we aooky for Tourist visa ? Is the I-130 a tourist visa without the i 485 ? What is the easyist and quickest way can get him for Christmas ?>>
Any help would be much appreciated..
