  1. She right now can't send anything - her husband has to send I-130 petition for her - since he is LPR (GC holder), she will have to wait for 2-3 years for her visa (due to numerical limits).

    Until then she is accumulating overstay (illegal presence), which is forgiven only to US citizen spouses. Therefore if in those 2-3 years visa becomes available, she will be unable to adjust her status (or her AOS will be denied - someone please correct me if I am wrong here). When her husband can obtain his citizenship ?

    He did apply for his citizenship, but he did pass the test.. And some one told her , she can apply for her green card..while he's a green card holder .. What you sugest for her I mean what's better now?

Now she wants to apply for her green card or visa whatever...what she should do to do this ? Which forms she has to fill out to send to immigration? Also she does have a Tax ID but not a social security.

    Just a quick note to say that I had my interview July 31st and was approved!!! I'm so happy! Things are finally moving along. I got to celebrate the visa at the Toronto carnival where Dex and I met 4 years ago. We had a great time! I'm now back in Montreal and I need to start packing!!!! After I recover from my crazy weekend of course! Glad to see things are still moving smoothly for peole and congrats to m&m on your approval!!

  6. My husband is going on 29. Dang, he's getting old on me. I might have to trade him in for a younger model. :P

    My fiance is 23 yrs older than I am....but he did look likes his age at all....

    I am 34 yrs and he is 58 . We hold hands everywhere we go and we just love being togethe.

    He's so cute learning and practicing a little bit of english. Last night at the restaurant after asking me if it was right he said "Excuse me sir, the check please." I'm so proud of him for practicing so soon! When I was so "young" in learning Spanish I was too nervous to use it with native speakers!

    The since my fiance aply for my k1 visa ,Oct 27 2008.We got a touch so many time. After we got the RFE we had touch on march 03,04,05,06,and nothing happen,any approval at all . Just said your case is processing and resumed . From this time, today become 50 days ,after we got the RFE...So, my fiance sent the letter to VSC on april, 17 ,2009 and Him went to talk to congressman in Maryland,Rockville on manday 20, thats means yesterday. She said to him. I'll contact USCIS to know whats happenig in your case and don't to worry . I'll help you....so we got touched, April 19 and 20,2009.   9. Not sure where to post this, but I just read on the US Dept of State website that things are being handled differently than before. Our consulate is the one in Rio de Janerio Brasil. According to the website, because I filed my paperwork for my fiance here in the USA, I will be receiving my packet from NVC rather than the consulate. I am confused by this. Does it mean that I will have to submit all of my fiances paperwork such as police certificates, etc.? Or will he submit them at the interview in Brasil? I know that I can wait for instructions from NVC, but I would like to have all of the paperwork ready so it can be submitted immediately. Has anyone been through this process? Apparently the process just changed at the end of February. Also, will NVC send me a notice when they receive my file? Thank you so much for your help.

    No you will not receive nothing from NVC.The thing you 'll know if you call the NVC at this number(603)334-0700 is when they receive and sent to Rio de Janeiro your process.When the Rio de Janeiro receive the process they will contact your finace in Brasil to send the packet 4 and she has to do all the paperworks by her self ,but you can help her to fill out the forms.For the police certificates she has to go to do so here in Brazil ok .You can check the web site embaida do Rio de Janeiro and find out all the forms for fiance....hopefully this can help you... congratulations for you approval and please fillout your timeline...

  10. All of our Packet 3 is ready too except for the police certificate. My fiancée was hoping to pick it up while in Bangkok for a conference this past week. Unfortunately it was still not ready, so she is heading home and they will mail it to her next week. Perhaps I can suggest to her that she overnight Packet 3 as soon as she gets it.

    My fiancee applied for the visa k1 on 28 of outubro 2008.We got a RFE on February 24 they asking for my divorcee translated.Today is March 27 2009 & not receives swims of answer. They are investigating above the my divorcee here into the Brazil if & cool or not? Why silly delay? or maybe because I have in my passport the visa G5 validates until august of 2009? I am not by using this visa anymore ,because I am into the Brazil. My boss has said what this visa he should be canceled at the moment what I leave the coutry US.ok I come back to Brazil on December of 2008.Is possible my visa G5 was even canceled or not? Is possible some of this problems to be delay on my process k1? welcomes the responses. good luck for everyone

  11. My fiance' had his interview in Rio on March 10th and was approved...PTL!!! Still waiting on the visa to be delivered to his home. Hoping for Monday! Does anyone think it will be a problem to book a round trip ticket since it is cheaper? Will it cause issues at the POE? Thanks!

    I called back tonight and she said that our case was just put in today, and I should call back next friday to see if it has been sent yet. Then she gave me the LND #. I asked her about the case number and she said london would give him all of that. I was hoping for the case number so he could go ahead and get his medical appointment. I heard it would take at least 30 days to get his appointment. Has anyone else got their appointment yet? And if so how long was the wait? :wacko:

    You may want to call back before next friday. NVC also told me to wait 1-2 weeks to call back but I called back

    and 2 days later the case had been sent :thumbs:

    I am not sure what the average is for medical appointments in London. I know that there is a United Kingdom

    We were lucky-our wait was quite short for the medical but there does not seem to be many Swedes coming

    to the US. In fact the Doctor told my fiance that he performed very few visa medicals.

    On fev.24.09 we got the RFE. On fev.28.09 we Sent back to VSC the RFE.On March.03.09 they received the doc.and contact us by e-mail.Since March 03.09 our case got touch MARCH, 03,04,05,06.So I'm so excited ,nervous,and.............yous know all rigth....I don't know what this means....

    I believe this is uncessary, as you had already established the legal citizenship of the Petitioner back at USCIS with either a copy of your birth certificate, passport, etc. No need to send this, or even a copy (though I had inadvertently did with the I-129F duplicate), as a Cosulate Officer shall not ask your fiancé to prove your American citizenship.

    I have read, and I wish I had a link for you all, that the CO can ask for any of the originals of things sent in as copies with the I-129F packet. I had written on my birth certificate, name change order (I changed my name before the divorce went through to get my passport, start a new school year as my maiden name, etc.) and divorce decree the whole blurb about "This is a copy and I can provide the original if requested by any CO or official" or whatever.

    Unless Consulate-specific, they are asked for, I am unaware of the beneficiary needing to produce the original of these, though I do understand the value in having a copy at least, and I do recall an aditional copy being required for AOS.

    The rest of the list is very much aligned with mine, as well as other filers, minding that there are some Consulate specific nuances. How close are you to having it ready to send?

    With Grace ours shall be ready in about three weeks time, so we can send immediately to the Consulate. An interview date sometime in April would work for us, and then it's just waiting till the summer to see each other. This very well could be the best summer vacation I have ever had.

    As far as this, my plan is to compile the notebook and bring it over with me when I go April 9th. So technically I have about 5 weeks, but really the only thing lacking is getting the tax transcripts from the IRS, which should be here in about a week, and the letter from my boss. The bank thing I may not even worry about, but I probably will print the March statement of my savings account, only because I'm putting how much I have on the I-134.

    The embassy emailed Josue today and told him that the interview would probably be in May or June. Bummer, I'd really love for him to come back with me April 19th. Which is why I just wrote (with the help of Josue's native Spanish) an email BEGGING and PLEADING with them to schedule an appointment during the week of the 13-17, as the 9th and 10th they are closed for holiday. If not, it was worth a shot. But we emailed them Saturday and heard back today right around 4-ish, so hopefully they will get back with us soon. Who knows, maybe they'll surprise us with their "compassion." If not, like you said, ThaitoUSA, at least we'll be together for summer. This will definitely be the best summer vacation I've ever had...with a close second being last summer when I met him and fell head-over-heels in love! :wub:

    Oh, I did not think that the consulate needed my original birth certificate. Precisely for the reason that Thaitousa

    stated. Also, it was not listed in the "Interview" checklist from the consulate. Hmmm. I guess I will double check

    on that one.

    I know that the NOA2 is required for the consulate. But again, it was my understanding that only a copy is

    needed. I know that a copy is also needed for AOS. I have read on VJ that if for example you lose your

    NOA2 it is very expensive to get a "new" original from USCIS.

    Also, I know that the civil surgeon made a copy of Johan's vaccination record so that we can use it for aos, so

    that is something to consider when the medical is done.

    I'm not sure, everywhere I look it just says "birth certificate," doesn't say anything about whose. I hope you are assuming safely, I just thought better safe than sorry since I have seen that the originals need to be provided at the interview.

    Thanks for the heads up on the vaccination record! Hadn't thought about asking for a separate copy, I just imagined we would get the results after the interview. Good idea, because you do need that for AOS.

    I need a help,please...

    When we filled out our I129 application form, I was in the US and gave the USCIS my address in the US. Now I noticed that I did not provide the USCIS with my address in Brazil. Do you know if I should notify the USCIS of my address in Brazil? I know that they are first going to contact my fiance to let us know of the second NOA and I am wondering if at that time he can give them my address in Brazil.
