  1. Hello all,

    Just wondering if someone has been in a similar situation and could offer some advice. I have my CR-1 visa in my passport and the package to take to U.S. customs at the POE. My visa is valid until December 2010. I am heading down to the U.S. this Saturday for a two week trip and was wondering when I cross the border on this trip if I am required to activate my CR-1. The reason I would like to hold off on activating it for at least another month or so is because I am waiting for some $$ to pay off my car before I export it, and I read in the 'info about your immigrant visa' handout that if you are exporting a car, it should be exported at the same time or within several weeks of entering the U.S. as a permanent resident.

  2. You already sent in DS-230 at the NVC stage which they have already, but for the interview you should bring all the copies of everything you sent to USCIS + NVC just incase. I am sending everything I sent to USCIS + NVC to my wife for her interview just to be on the safe side.

    Once you get approved, they will make you sign the 2nd part of the DS-230 which they have already with them. Goodluck on the interview :star:

    I was wondering if anyone has been in similar circumstances.

    I have my interview in Montreal on Wednesday, and in gathering the documents for the interview, I noticed that the letter by the DS-230 Part II is 'F', which according to the legend means 'this form is not necessary for this application.' Does this mean that I can expect to be denied at the interview if it's stating that the DS-230 Part II is not necessary? I'm thinking this might be the case as I am assuming that if the visa is approved at the interview, I would have to swear the bottom portion of the DS-230 Part II and therefore the DS-230 Part II would be required.

    Any insight would be greatly appreciated, as I'm stressing a bit on this point....

  4. Sorry if this question is redundant:

    If the following message comes up after trying to login to the payment page on the NVC Website:

    "Sign In Failed. - Please be advised that the case that you have attempted to access is not eligible for further processing by the National Visa Center at this time. Please click on the Contact the NVC hyperlink if you believe that you have received this message in error."

    does this message mean that the NVC is done with the case and forwarded it to the appropriate consulate or does this mean that there is a problem with the case?

    I submitted my DS-230 and civil documents March 24, '10, but still haven't received an appointment letter. Is it normal for a month to pass from case complete (if that's what the message means) without receiving an interview appointment letter?

    Any input would be greatly appreciated.

  5. Yes, you file the I-130 first. Then you file the I-129F for your K3

    Cr-1 is a FAR superior visa if you ask me! Good luck on your journey

    Thanks for all the info. Just have one more question for anyone who may have experience in this area.

    If after we are married, I go to the U.S., get a job offer, and obtain a work visa, can I stay with my husband while the CR-1/K3 is processing?

    I am in the same situation as you are. I am in Canada and my fiance is in the U.S. We want to get married in Canada and then work on moving to the U.S.

    Is your fiance just going to come up to Canada to get married then go back to the states after a few months and start filing for a K3? If so, I know from reading the guides that there has to be evidence of a bona fide marriage. I'm just wondering how easy that will be to fulfill, if your fiance like mine, is going to go back right away so we won't have a joint lease together (as usually a lease is for six months or a year). Are you just going to get sworn affidavits and open a bank account? Do you think it matters if his name is only on assets in Canada?

    For newlyweds, some pictures and evidence of visits and communication are sufficient at petition filing time. No worries there. Unless the visa can be issued in Vancouver, K3 is a poor option. I'd go the CR1 route if Montreal will do any K3 interview and maybe even either way.

    Since I live in Western Canada, I'd have to deal solely with the Vancouver office for my K3. When I file for the K3, it also defaults to filing for the CR1 too correct?

    the I-130 petition which is required to be filed first, is for the CR1... the I-129F petition for K-3 is optional

    Sorry, I am a bit confused. Since we only want to file for the K3 at this point, we have to file both forms and see what gets approved first?

    Since my fiance does not want to stay in Canada for more than a year (and therefore not start any immigration proceedings in Canada) I have heard that a non-Canadian citizen can stay six months in Canada, go back to the U.S. for a day, then come back to Canada for another six months? Is that allowed?

    Also, in order to do a direct consular filing, does the U.S. citizen have to have been resident in Canada for six months or a year?

    Your fiancee would need to have legal residence in Canada (not tourist visa) for more than 6 months at the time of filing.

    You can but you can probably get an immigrant visa faster than a work visa and you'll eventually need immigrant status anyway. If you're both living in Canada now, I'd think in terms of a Direct Consular filing for a CR1 visa. Start by clicking on the word "Guides" at the top of any page here.

    Also, do you know if while I am waiting for my K3, can I stay in the U.S. with him or do I have to return to Canada and wait. (I know I can only be in the U.S for six months during a year without any paperwork.)
