  1. Expiration is not visa expiration, it is the date that you would be in an over-stay situation. July 2010.

    Apply for AP document (I-131) this will allow re-entry, NO visa renewal needed. NOTE: AP may be needed anyway, only a few visas like K-3 will preserve AOS status if you leave the USA while AOS is processing.

    Moving to AOS from Work/Visitor/Student visa.

  2. Hi Folks,

    I am completing my I-485 form. One of the items is Current USCIS status, and then they ask for "Expires on". I am on a H1B visa. My status on an H1B expires on July 2010, but my VISA expires on June 2009 ( I would have to just go to the consulate and stamp another visa valid for another year). On the VISA, is state Expiration date on June 2009, but then there is a PED 30July2010. (which would be the actual date of my USCIS status expiration).

    Which of the 2 dates should I put on the I485 form, where they ask for USCIS status expiration???

    Two questions:

    1) I´ve heard that when submitting the forms (I-130, 485, etc) that they should be submitted in 3 copies, being the original one in a white paper, and 2 other copies, in blue and yellow paper, anyone know anything about it??

    2) Also, I´ve heard that doing all the paperwork without a lawyer can be pretty hardcore and that there are a lot of details that are missed? What´s your experience with it? I think most people here did it without lawyers right? Some assurance will be welcome!

  4. Hey Folks, I have a question.

    My wife is the US citizen sponsoring my green card. When filing for I-130, she has to send in her W2. The thing is that she changed the spelling of her first name when registering with her job, so the spelling of her first name in the W2 is different than the one in her passport or birth certificate. Would that be a problem? (the name still sounds the same, just the spelling is different, from Marsha to Marcia). Should she attach a letter explaining that, or shouldn´t we mention anything and they will probably think it was a typo?

  5. we passed in a notarized affidavit from our past landlord. in our case it made a difference because the officer actually called our former landlord to confirm the affidavit. make sure to include the address, occupation, and phone number on the affidavit.

    Great, this was helpful! Thanks. Actually, my apt is owned by the company I work for, so the letter is from their real state management department, on a company letterhead. I am going to submit the original one. I hope it works!!

  6. Most filing for a visa simply provide affidavits from friends and family attesting to relationship.

    No, I am filing for the AOS actually, I have to change it in my profile, I haven´t filed it yet.

  7. Would a letter from the landlord suffice as evidence of joint tenancy/bonafide marriage? We´ve been living together for a couple of months already, but I cannot change my lease to include her in it, since my apt is owned by the company I work for, and only the employee can be listed in the lease. INstead, I added her as a legal occupant. The landlord issued a Letterhead stating that she moved in with me, and has been living in the same apartment since September 2008.

    Would that have similar value as an actual Lease Contract?

  8. Hi people, this site has been really helpful! Thanks for the tips.

    My question is, I already live in the US, on an H1b Visa (been living here for almost 2 years now). I will be travelling back to Brazil for vacation with my fiancée (who is an US born citizen), and we plan to get married right after we come back (like 2 weeks later), and file for AOS the following week. Since I will be reentering the country, and will be sending that I-94 with my application (showing that I reentered the country 2 weeks before my wedding), would that be a problem with USCIS (like they might think is a marriage fraud), or do they usually count the time of entry in the us to wedding from the first time I came here on the H1b Visa (which would be about 2 years ago)?

  9. HI, I have a quick question, having the wedding date set already, is it fine to have the medical exam for immigration done BEFORE the wedding date as to speed up the processing? Or would USCIS frown upon it, saying that I did the medical exam prior to the wedding, so I was only getting married for immigration purposes?? Do I have to have the medical exam done only AFTER the wedding?
