  1. Greetings,

    My Wife and stepson (14) have been here in US over 3 years now and im wondering if they can file for US citizenship now. They have had there green cards and been in no trouble since being here. Also im confused about there passports as they expire soon. Not being a US citizen yet do they get a US passport or a Philippines passport? If the latter where on earth would you get that. Thank you in advance for your input.

  2. Before you ask, yes I searched and I couldn't find a solid answer. I was answered in the Canadian section in a different topic, but I just want to be totally sure, since I want to get this paperwork done ASAP.

    My fiance was terminated from his job of 6 years this past Friday.

    We're getting married on the 27th and filing as soon as we can.

    Since he has no job and that he has to mark down that he doesnt on the affidavit of support form, are we absolutly required to have a co-sponsor? And my fiance still has to fill out the form, correct?

    Sorry to hear about your job loss but i just went through the same problem. My Company closed its doors after being employed there for 33 years. (auto worker in Michigan) on the I-485 i sent in i put layed off and included 3 years of tax returns. At the AOS interview i was very worried about this problem like you. just in case We lined up a co-sponsor (sister) and brought along my unemployment pay stubs for the last 3 months. At the interview the Officer asked for passports,asked wife her mother and fathers name, My father and mothers name asked her if she knew her Social Security number, Which she knew by heart then told us he was approving our application for the green card. He did take our joint bank account and some pictures. DO NOT OFFER ANY INFORMATION UNLESS ASKED FOR IT! After being approved we thanked him and out the door we went in a flash. I pray everything go`s as smooth for you my friend. Good luck !

    I filled for AOS for Wife and Step-son K-1 K-2 after marriage and sent in my I-864 with 3 years of tax returns. Soon after the Company i worked for closed there doors after 33 years of employment there. I am now drawing unemployment and will not have a job or check stubs for the AOS appointment on Jan 19th. Im hoping to avoid any problems by bringing a I-864 Co-Sponsor (my sister is willing and makes good money) We are completing the forms as i write this. She lives elsewhere (U.S. same town) with her family also. Question i have is how to complete the I-864 for step-son. (K-2) Do we fill out the I-864 for both of them or do we photo copy from my wifes I-864 (K-1) for son? :help: Also all the supporting documentation Sister is filing do we file all that imformation with both forms? Im hoping we don`t even need this Co-Sponsor I-864 but thought it be best to have it along just in case there is a problem now with my income.

I had my interview for AOS in detroit last week.. the officer specifically asked if anything had changed since the time i submited the documentation.. some things had so I provided him with the info. I hope everything goes ok with the AOS but if its any consolation, the person I was interviewed by was super nice

    It is no consolation the person was super-nice. If your affidavit as updated is determined not to be adequate, then you will be given the opportunity to get a joint sponsor. I would line one up just in case

    Thankyou all for your imput to my question. One thing i still don`t know is can you submit copys of birth certificates. for me,wife stepson and my sister (who will be joint sponsor)? All original were submitted early in the process except for sisters (co-sponser) i-864 which i will bring to interview. Also what are best documents to bring to prove i have been a life long citizen in the good ol` USA? Salamat for all the help. :thumbs:

    Forgive me if this is posted in the wrong forum. I have a problem and need advice. My employer of 33 years (Auto Worker in Michigan) has closed the plant. When i filed the AOS package i included my last 3 years of tax returns and all other information requested. I am now collecting unemployment. I filed a K-1 K-2 for fiancee and stepson,married in the 90 day period. I am concerned that at the interview we will have problems now with my income and the interview is on January 17th. We also have a newborn little girl. All other things have gone well the authorization for employment for and the parole for travel for wife and stepson. I am thinking should i have my sister be a co-sponser for my wife and step-son? She has agreed and makes very good money. If so is it the form i-864 she needs to fill out and would that be done for both of them? 2 seperate forms? Also can you produce copys of the birth certificates as this stuff has already been submitted early in the process, Along with the medical records. Everything was going smooth untill my plant closed and now just worried sick. Thankyou for taking the time to read this and thankyou in advance for your awaited imput.

    Can we file for the AOS if wife has not recieved the medical shots yet? She was unable to get them due to her pregnancy.

    The baby will be born around May 29th. Do we need to wait till after the birth then go to civil surgeon for her medical shots then file? She has SS number in her married name already.   9. My Fiance and Son have arrived in the U.S. (Philippines K-1 K-2) Should we get the social security card for them now or wait till after marriage? Not sure what to do since we will have to go change her name after marriage on the social security card. We have not filed for AOS yet. Just begining all of this and hoping to do things right.     Fiance got here air 21 packet today. What a journey this has been and she is 6 months along with our baby. we are very thankfull for all the information we got here on VJ and i just want to open the door and yell to the world. Thanks to the Lord and never give up. This is a wonderfull day for us after recieving the 221G on January 15th 08. again thanks to all and good luck to those still waiting.

SO was given a blue white slip 221 G asking for a new I-134 from me as i left her Son off line 10 and a new no marriage certificate from her as she is Pregnant with our child.They returned her passport to her but keep the documents. Her interview date was Jan 15th and she submitted the requested documents on Jan 29th. At that time they took her passport and told her to leave now and wait for us to contact you. She was not told to go to air21 to pay. She is 5 1/2 months pregnant now and the petition expires on the 16th of march. I have called every Tuesday and spoke to Ma`am Lorriane and she tells me not to worry about the petition expiring and the case is on the Consulars desk waiting for her decision. We dont know what to do and its very frustrating. We wish to be married before the baby is born as my insurance will cover everything. Should i write the CO and ask for a extention? Should i e-mail them? Any suggestions would be appreciated. Running out of time to fly with the baby.

    Thankyou for responding but if you read closly to what i wrote they did take her passport after she submitted the requested documents on the 29th of January. She has a Son who is part of the petition and he needed to be on line 10 as his mother on the I-134. The child she is carrying do not need to be included in the petition as he/she is not born yet. But the CO requested a new no marriage certificate because she is pregnant. Taking her passport after submitting the required documents was a good sign it is just how long will this sit on the CO desk before it gets touched as we only have 1 1/2 months before she will be unable to fly and the child will be born in the Philippines and cause undue expense for us. Also im concerned about the petition expiring on the 16th of march. I dont know if faxing them my situation will help or submitting a request to have the petition extended for 4 months as i read the CO can make that call. Do you think getting my Senator involved would speed up this process? I do appeciate you taking the time to answer this as it is frustriating not knowing whats gonna happen. I will call Ma`am Lorriane again this tuesday and ask for a status update.

  14. dont worry about it,, air21 will deliver her visa COD (cash on delivery ) like mine i was given a white slip and my visa arrived yesterday.. i paid 220.. :thumbs:

    Thankyou Ma`am for your response, Did you pay at the Embassy anything for the Air21 or fill out any paperwork for Air21? My Fiancee turned in the requested documents and they took the passports and just told her to wait we will be in contact with. Did ask if this is the correct phone number and address.

    Fiancee had interview on the 15th of January 2009 was given a blue slip and a white slip asking her to resubmit 2 documents a new no marriage certificate (she is 5 months pregnant with our child) and a new I-134 from me as i left her Son off on line 10. They keep all our documents She submitted on the day of her interview but returned her passports to her. The requested documents were submitted on January 29th 2009 and they took them and her passports and told her she can go now and we will be in contact with you. Has anybody been though this or know what will happen next. She did not fill out any papers for Air21 was just told to go now. Will she recieve the passport and Visa by AIR21? Will she have to return to the Embassy? How long untill we will hear something from them? We are just stessed about all this and wish to be married before the baby is born.     My Fiancee had interview Jan 15th and is 5 months pregnant. She said she saw approval on the paper work.but After the interview the Consular requested another I-134 from me as her Son was not on line 10 ( is on line 3 though) and a new no marriage semenar for her because of the baby to prove she is married ( this was supplied on the 15 also) She was given a blue slip and a white slip with the 2 documents requested checked. We quickly got the new requested documents and she presented to Embassy on the 29th of January. They looked at them took them and her passport and that of our Sons. Then said to wait to hear from us. We are know praying for the Visa to arrive soon so we can be married before the baby is born. We wish not to have the baby out of wedlock as my insurance will cover her and the child if we can marry at least one day before the child is born. I called Grace at the Embassy and she said everything looks good to me and i see you have supplied the affidavit of support for the child and even wrote the USCIS just after the pregnany. She said everything looks good to me and wait 7-10 days if you hear nothing call back in 1 week. it has now been 7 days and nothing yet. I will call again Ma`am Grace Tuesday and inquire about our case again as she asked me to do. She did say to me everything looks good to me but the final decision lies with the consular. Has anybody dealt with this before? Again the passports were taken so im guessing that a good sign but..........? We are still stressed as if they make us wait till baby born to come to US it is going to be costly for us and no insurance on my fiance,Although the baby is covered apon birth. I wonder how long this can drag out as she has 2 and 1/2 months to get this Visa and be able to fly here. Im wondering as they took the passport will she be required to have another interview or will they approve the documents and send her the visa? Sorry for the long letter and if anybody has been down this road before and can share with us there experinse it would be most appreciated. God bless and i look forward to reading some response`s

    My Fiance had her interview Jan 15th and was givin a white slip with 2 checks one is for the I-134 Affidafit that we submited but her Son name was on the front and not on the back in line 10. I have corrected this and send her a new one. the agency i hire put Step child in the spot and we are not married yet is this a problem? The other was a new Cemanar appointment for her as she is pregnant now with our child. She will have this on the 28th of Jan, and was told to present the 2 documents to the window 17. Will she then recieve the Visa or will there be another interview? She tells me the interview went well but the Consular was not satisfied with the I-134 and with the pregnancy. She is coming on 5 months this Feb and im praying that she,my step son and the baby will be alowed to fly to US before the birth. I dont know if the Embassy is just gonna hold things up to force us to have the baby there in Philippines and do some DNA or what. I did submit Knowledge of this pregnancy to the USCIS in Oct and a letter to the Consular that i was aware of this and wish the case to proceed and be expedited if possible. she showed to Consular.

    Any help would be appreciated on what to expect next. Salamat Po

    I don't have any advice on the visa, but I would advise against having your wife fly this close to her due date. That would be extremely risky.
