  1. Hello

    So today is my first time returning to US since receiving my green card in April. We are flying into JFK from Heathrow airport having been here over the holidays. Checking in was smooth, which was nice to finally not have to worry about all the questioning, I am almost starting to feel like a US citizen. I hope everyone had a good holiday and a happy new year wherever your travels take you.

I am returning to US in January, I was on AOS when I left in Feb we filed for a emergency advanced parole document, which was approved for me to travel back to canada, we choose to come back for treatment here for me to be near family as we have no family in NY only my aunt. I was diagnosed with a terminal illness in NY back in february which we got the options and choose to come back to toronto for treatment to be near family as we needed full time care for our daughter while I was hospitalized for 6 months. In that time my AOS was approved, my OHIP was approved after filing for my presence while in canada for the duration of my stay I still have an address and home in Canada, my husband has been a dual citizen for over 10 years and his always still had OHIP coverage as long as he was present during that time as he travels back and forth regularly, his job was also established out of Ontario, he was an actor and lived here while filming. I am now returning which yea I will forfeit my coverage.

    Okay so I am in the process of changing my marriage name on my Canadian documents, currently my Passport with my K1 visa is still in my maiden name. I got my 10 year Green Card finally it was approved back in march after being denied last May due to some issues caused by a family member on my part. I been back in canada since Feb due to illness which I got permission to travel back for medical treatment, which is when in the process my green card was also approved after a full investigation and stokes interview. What is the process like for getting your name changed on passport? Do i apply directly to the counsalte here? or do I apply for a new passport as Passport Canada states to change yoi name you need to fill out a whole new application?

  4. I got a question, now I am thinking postively and hoping to get that green card approved soon. I had to get an imfopass AP for emergency travel back to Canada in oct it was approved and I went, I did apply for AP at the time of my AOS but got expediated approval. Now with this whole situation, they revoked it while it gets sorted. I was wondering once I get approved, in normal circumstances does the AP still count? or we can now travel back freely? is there a grace period before the card arrives in the mail that you cannot? I hope to go back to Canada for a week March 14-19 which is when I got my school spring break. I am hoping that I get a stokes by than or might see if I can get my AP back.

  5. Yea it was they said it still needs to be done because now his affidavit for paternity establishment is not valid anymore, but they are covering the cost of the test. We issued our statements and his identification so his not able to contact us or come near us, they issued a warrant for his arrest if he leaves his state, so that is reisuring. Were bringing the evidence into the stokes interview its where they will review it and he can face charges, and we got a lawyer so the charges were pressing went through and a hearing is in march. But in terms of my GC I am just relieved now that I have been more reasured.

An update since the last time I posted alot has happened, we received a letter from the US State Department, in which we were called in to talk to someone, as it happens we found out they were the reason USCIS did not approve at the interview. The US state department has been looking into our situation before the interview, they been looking into all of the leaks and everything they received to jepordize my petition since and proved it came from a falsified source, into which it put a red flag onto my process as up until now it was smooth sailing so it raised questions as to the discrepancy. They told us USCIS were directed to not approve me at the interview and just request the DNA as their request, but not tell us why. Were still going with the process the USCIS promted us too, the Paternity test is on Monday than we wait for a stokes interview.

Well that is too late, we've done evrything we could to stop him, including moving states which he knows where we live and that we've moved here, my husband does not want anything to do with him but he will not understand. It has come to the point of stalking and invasion of privacy which I can not take anymore. I found out about the letter last weekend from his daughter she read the letter she found without her dad knowing he was going to sent it. She told me what some of it said from what she got herself. His more that his against our relationship because he feels I am keeping his son away from letting him reconcile his faults and he wants to see our daughter which we deny. I understand USCIS steps towards it, and what you have mentioned however we do have other evidence that states his interference and compromising of my petition. Were most likley getting a lawyer and bringing him to court, not for the restraining order alone,I am sure stalking can account for alot more.

Some updates to my case, found out that the USCIS did infact received a letter diregarding me and such, the letter was sent by my husband's biological father to whom we've had alot of issues with for over a year now. We are very upset about this and to the point that we want to press charges, we want to bring this matter into there eyes as I assume what he did was wrong and illegal. Any advice is appriciated thank you again for all the replies and tips.

  9. This is quite mind bonking, thank you for all the replies, we dont have much choice but to go with the paternity test and the stokes interview which I assume I will have after. I am rather glad I do though, my hubby and I want to find out if it really was someone tipping them off or not. We've been having issues with his biological father wanting back in his life after he has told him countless times he wants nothing to do with him, were pretty certain he had something to do with this which we have evidence to show his been "harassing" us, we know the paternity test will be positive we have everything else so I am not worried about that at all, I am just worried about how much they need to prove or his credit whatever reason they have for wanting us to get the DNA test done.

No we didnt, he just filled the affidavit to establish paternity when we applied for her citizenship, thing is up until now they had no complaints or reason to believe its a fradulant relationship, we have enough evidence to claim that a whole folder that is we took to every interview and up till now we've even been given compliments on the amount of information we have and how prepared we were everytime. In talking to my hubby about it, he says its been on his mind all day since we left that they were pretty avoidant about it till the officer said he cannot approve me because they need one thing, which he then mentioned the test, but didnt say anything that they received any anonomys tips or anything, although he did ask that they do have record that I stayed in florida for four months while waiting for my NOA but that should not be red flag I was still in the legal six months visitation allowed for Canadian without a visa, so I wouldnt think its cause of that.

Have you filed to establish US citizenship for him? he is automatically a US citizenship born to a US parent, because he was born in Canada you need to file for a counselor of birth born abroad along with a affidavit to establish paternity if he was born out of wedlock. We applied for my daughters as soon as she was born, we got her certificate in the mail later then applief for her passport. My hubby had to aslo establish her paternity because we were not married. In my case they also found out that I stayed with my hubby in Florida for four months at the time he was living there and its where we petitioned for orginally, I went back to canada november 2009 and received my NOA2 on the 25th of that month,

  12. We got asked about this too at my interview this morning, to varify that my husband still works at the same company and if anything has changed in his employment since filling for AOS. Were above the line, of needing a co signe. His employment did change since applying he got a promotion and pay raise which he went about it himself and got a letter from his boss staying of that change and that he is currently sitll employed etc, as Vanessa said even a letter that states your still employed there and since when should be good enough as long as they know its not part of your work aggreement of set hours of work.

    In my husbands case he works 30 hours a week, which is also set in his contract that his position also has a required amount of hours put in which meets his salary rate. He sets his hours around his school scheduel to meet the required hours for his position.

    Good Luck hope they will be able to accept that condition of Wall Mart employment.
