  1. Ok so question ..Is it Possible for us to push this I130 before I129f thru NVC to Embassy ..

    Cuz i really dont want to pay for AOS or pay Ticket fair to india after two months she is here ..

    but looks like i dont have a choice .. now i am confused if i should ask her to wait till she get I130 Interview .. but she already waited 1.5 yrs cant ask her to wait 2 or 3 months ..

    so i think i should just go with AOS ..

    what is you guys think ??? what would u do ??

    Let me ask you this, Is your I-129f alread at respected embassy or consulate? How far are you into your I-130 process at NVC? Did they generate your DS3032 and AOS fee? what I did is my I-129f is already at mumbai consulate and they already received our packet 3, now we are waiting for interview date for I-129f while I am almost done with I-130 process here at NVC. Bottom line is if you have all docs ready for NVC process then you can easily get done with your I-130 process before I-129f interview date. So, its totally upto you how fast you do your paper work at NVC to complete CR1 process.

    Now i dont know if i should respond to I130 from NVC or Change of Status ..

    If I were you I would pursue both path to see which one gets me better interview. My question to you is do you really want to play the waiting with USCIS for adjust stauts? And if you respond your I-130 paper work as soon as they generate you might be able to finish your NVC process very quick.

    What i was thinking is even if i pursue the I130 they will only give her Green Card valid for 2 yrs since we are not married for more than 2 yrs. So i still have to go thru USCIS with I751 to remove the condition on Green card and i still have to pay $545 & all the delays. so was thinking why? ... let her come here early with K3 Valid for 2yrs & will deal with Adjustment of Status. Correct me if i am wrong .. i am like stuck here .. I just got the Affadavit of Support bill from NVC .. do i have to pay this if i am doing K3 & Adjustment of Status ? Let me know what you think? ..Thanks for you help..

    K3 visa is not work permit visa and if she doesnt want to work then go ahead, but I would still go for I-130 regardless since its just matter of 1 months thats just my personal opinion. Trust me dude you will be done with your I-130 process in less then 20 days if all your paper work is ready, but if you want to you can pursue k3.

    I've gotten 4 letters from NVC, all with different dates ranging from 1/9-1/15 stating that our k3 will be forwarded to the consulate "within a week" :blink:

    anyone else get multiple letters like this? just curious

    Its true, so what all paper work should be ready? i mean i am getting confused with what i have to have ready & what she have to have ready in terms of papers.. should i already send her my Bank letter & Employment letter & Affidavit of Support with Tax return Notarised to her ..Now ?

  5. Hello! I am wondering on behalf of my brother who has also gotten his approval today. His wife has been married previously and so has he. Is he to supply her divorce documents in packet 3 or just his own? Also, what should he provide as proof of marriage is this needed for packet 3 or only at the interview? He had sent pictures in when they sent in the I-130 and I-129F packages. Also, very important question: if you filed K3 and they send the I-129F package to NVC and your photos are in that package do they go to the embassy or do they stay at NVC? This is very important to know. I need to know for me and my wife what we can start doing now that we have our NOA2. She called to get hte case# and I did not talk to her yet because she is at work, but I suppose she got it from them already. Any help would be kindly appreciated!

    First of all .. K3 is what you call I130 With I129f and you dont send that to NVC you send it to your Designated service center...

    Dont send them anything unless they ask for it. Just make sure u send what is required to be sent.

    If they want to see the Dicorce Document ..they will ask.. but its better to bring it to the Interview..

    If u have the Noa2 send her the Package ..

    What to send to your Spouse once the I-129F is approved (NOA2):

    1. A copy of the entire I-129f and I-130 package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one).

    2. I-134 / I-864 Affidavit of Support form. Ensure it is notarized (by a public notary), with all required supporting evidence. Some consulates may require one or the other forms. You will need to verify with the consulate which they require. You can call or email the consulate to check ahead of time. Additionally, the consulate will notify your fiance(e) via mail correspondence which they prefer. Attempt to start collecting the required information ahead of time, as it can often take several weeks to collect it all.

    3. You will need at a minimum (for the above form) two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position. Begin collecting these asap after your NOA2 arrives. You will also probably want to include other evidence such as your banking information and other assets as required by the I-134/I-864.

    4. A copy of the NOA2 that you received in the mail.

What I mean by "both at the same time" is... you can try to fly through NVC with the Cr1, and then be interviewed for it at your k3 interview.. usually k3 interview dates are scheduled quicker, so you are simply pushing the CR1 through NVC in order to get it sent to the embassy before your k3 interview, thus "changing" your k3 interview to a CR1

    to the OP,

    since you are doing the k3...

    Im going to cut and paste from another thread that I gave the same info :) lol

    Start getting your proofs together. Go to your husband's consulate website..they usually will tell you what is needed for the k3 interview.

    I found these sites super helpful as well. I already have Y's whole packet 3 ready for him and I just need 2 more "proofs/evidence" and I'll send it to him

    The spouse of an U.S. citizen applying for a nonimmigrant visa (K-3 applicant) must have an immigrant visa petition on his/her behalf by the U.S. citizen spouse. Therefore, the spouse of the U.S. citizen (the K-3 applicant) must meet some of the requirements of an immigrant visa.

    The embassy or consulate where you, the spouse of an American citizen, will apply for a K-3 visa must be in the country where your marriage took place. Here are the procedures to apply. The embassy or consulate will let you know any additional things to do, such as where you need to go for the required medical examination.     do we both have to send the Choice of Agent?? how do we send it thru email if it have to be signed?

    I am Persuing K3, but i am thinking about doing change of status In US

    Found out was eligible to derive citizenship from mother.

    Got U.S Passport- 04-16 in 8 Days.. haha i know ..

  8. Can someone give me an idea of what is goin to happed after the letter from NVC with the MDR# till Interview?

    I mean who is going to get what? what are the actions we have to take

    like i know My wife in India is going to get packet 3 that is all i know..

    what does this packet 3 contains?

    what we have to do with Choice of agent? does both of us have to send it? how can we send it via email if it need to be signed?

    Should i send her the package of my employer letter & I134 w supporting documents notarised?

    Any help is appreciated ...

  9. I need some help with this .. If anyone can help ..especially the people holdin Indian Passport..and went thru the same situation

    I had my NOA2 Last week ..

    Got my NVC letter with MDR # this week..

    Now my wife tells me that In her passport the name is layed out wrong..

    Her name is : Julie Aleyamma Mathew ( First Middle Last)

    and in I 130 & I129F & G35A We filled it accordingly ..

    But in passport in the place of SurName it says : Aleyamma Mathew

    and in the place of GivenName : Julie

    I dont know if this is goin to be a problem at the Embassy . and in DS156 .. they asking to fill exactly the way in passport..

    and we dont have enougf time to fix this ..she lives in chennai & according to her they have to wait a month to get things fixed or a new pasport i dont want the package to get here and she dont have passport.

    Is there any solution to this?? Any Help is very appreaciated ..

    Dont worry there wont be any problem as long as her full name is correct on passport and application.
