    If he doesnt have any conviction and can prove he entered into the marriage in good faith then there isnt much you can do, just call uscis and talk with them, they will instruct you exactly what you need to do. if you have any proof he didnt enter into the marriage in good faith be sure to send it in with the divorce papers,

    You say he left the usa on the "9th oct 2010" correct? well hes still legally allowed to come back in the us on his active P.R card....You can't do Nothing as what states in the above.

    Now if he's stays out longer more than 6 mths but less than 1 yr then this could give him Problems at P.O.E with secondary inspection...where he must prove that he has not abbandoned his P.R Status own a home..bank accounts..blah blah blah......there at port of entry (P.O.E) they can interveiw him but "can not" take his P.R card from him..Only a immigration judge can do this....then he would have to prove, blah blah blah...

    Im not sure of why you want to go down this route of ICE ect....is he such a threat to you? if you just get a court order that he can't come within 100 yards of you....that should do the trick in most cases...

    IMHO..i would just let him burn his own bridges as what i said above....

    I asked, in this thread, who I needed to contact. The responses said ICE. That's why. If its better to just contact USCIS, I will do that. He has no ties to US. He owns no property here, has no bank account...etc. And quite honestly, I think he's a threat to himself, me, and pretty much any person he comes into contact with. He is mentally unstable(has been told this by professionals). I am fairly sure that he probably will burn his own bridges anyway, but, I want to have my bases covered because he wouldn't be coming back to the US for any GOOD reason.

  2. Unless you suspect that there was immigration fraud than there is nothing you or ICE can do. If he came to the US with intentions to marry you, he did and things just didn't work out then he is perfectly able to remove conditions without you (which may or may not be approved).

    Well, I do suspect that he used moving to the US (me) as a way to escape a "horrible" England, only to discover he thinks America is "horrible" too...(which makes him wanting to come back even more ironic...he hated it here, so he went back, and now he hates it there again I guess and wants to be back here). But, I don't have "proof" of that, and even if I did I don't think it constitutes immigration fraud...

    Keep in mind once divorce is final there is nothing from stopping a conditional green-card holder from filing I-751 with waiver of joint filing requirement claiming entered marriage in good faith. Note once divorced, the green-card holder does not need to wait until within 90 days of the card's expiration, they can file it as soon as divorce is final.

    So make your report, and then have to move on, nothing else can be done.

    I understand he can file to remove conditions immediately, which is one reason I want to make sure I let whoever needs to know, know asap. From what I have read for evidence that shows "good faith", he doesn't have access to any of those things. The only thing he could get would be our ONE joint tax return and I highly doubt he knows how to do that, since I have the paper copy.

    I just want to know that I have done everything I can. I won't stress about anything more. If I let ICE know, and then he tries to come back in on the green card, is that allowable?

  4. It has been quite awhile since I posted here, and I really never thought I would be posting in this section. My now ex-husband and I had basically a dream K-1 and AOS process..really, really fast. After he came over here though, things just got worse and worse. Eventually, through some pretty horrible experiences, it became very clear that he had some mental and emotional issues that needed to be dealt with. However, he decided that leaving me, getting a divorce, and going back to England was what he wanted instead. When he left, he said he would never be coming back to the US, but kept his green card anyway. Now, he is talking about trying to come back and basically lying to USCIS about being divorced in order to try and remove conditions. I know this wouldn't work, but I don't even want it to get to that point. I honestly am really scared about what could happen if he comes back, and want to make sure USCIS (and whoever else needs to) knows we are divorced.

    Do I just send USCIS a letter stating that we are divorced, and the divorce decree? Are there any sample letters floating around?

    Do I send this letter to where we filed for K1, AOS, or somewhere different?

    I want to let USCIS know as soon as I can, to hopefully avoid anything worse happening. I do have some posts that he made on another immigration forum stating that he doesn't want to tell USCIS about the divorce...should I include these in my letter?

    Is there anything else I need to do that I am not thinking of?

  5. Ok everybody, even though our green card has been approved, I need some help!

    My husband (the GC holder) got a job that required us to move. Now, what do I do? I filed the AR-11 online for him only. My mom (at the time of filing, we were living with her) is our co-sponsor because I don't make enough. Do I need to also file some kind of form with them, even though we have a co-sponsor? Or does my mom need to do anything different since we aren't living with her now?

    We obviously don't have any forms pending with USCIS so that's not an issue.

  6. You need to file form AR-11 with them, and so do any sponsors that have moved address. You need to also change your address online with them. I have to do this too, but I expect things still to be sent to my previous 2 addresses, because USCIS suck.

    I doubt it, I finally got my medical to the post office on 12/18 so that should meet their deadline of getting to them by 12/30, but their tracking system says it hasn't left yet. Bah. Final cost was $303 because I needed another Tetnus/Diptheria, I had my TB skin test read at local health department and results faxed.

    Our co-sponsor filled out the i-864A because they were in the same house, but with the move..they won't be...is this a problem??

  7. This is so strange. On Dec 15th I got "On December 15, 2009, we ordered production of your new card.". THEN, the next day I got "Notice mailed welcoming the new permanent resident" and was moved from card production to Decision. And now today I get: "On December 17, 2009, we mailed you a notice that we have approved this I485 APPLICATION" Shouldn't card production come AFTER approval? Oh well, I dont care! Just as long as I'm approved and getting the card! :)

    The notice welcoming the new resident is just a letter...we got two of those on the same day, a few days after that update. After it said approval notice sent, we got the card! JimandChristy, I realized we got the GC a little after I said in the message...maybe the first week of December. My last case update was 11/27 that says they mailed the approval notice...so Maybe we got it around Dec 1st?? I actually have a touch on Dec 1 as well..

  9. USCIS rescheduled my original AOS interview. Last Saturday, I received a letter informing me that my interview was canceled and that I would be notified of a new appointment. Yesterday, I received another interview notice for a date a week later than my original interview date.

    Thought I would share this so that others who receive a similar cancelation notice do not stress. Apparently, this occurs sometimes due to scheduling issues, especially around the holiday season.

    AOS Timeline (Local Office: Columbus, OH)

    09/17/2009: Mailed I-130, I-485, I-765, I-131

    09/21/2009: Received at Chicago Lockbox

    09/28/2009: NoAs issued

    09/28/2009: Checks cashed

    10/02/2009: NoAs received in mail

    10/05/2009: Biometrics letter received (Appointment: 10/28/2009)

    10/06/2009: Biometrics completed (Walk-in at Columbus ASC)

    10/29/2009: Interview letter received (Appointment: 12/01/2009)

    10/29/2009: AP approved; EAD production ordered

    10/31/2009: Received notice of interview cancellation

    11/06/2009: Received AP

    11/07/2009: Received EAD

    11/07/2009: Received new interview letter (Appointment: 12/08/2009)

    I have heard that even if you get a reschedule letter, SHOW UP on your previously scheduled date. there have been people denied green cards for not showing up.

  10. Check cashed yesterday!! Woo Hoo!! Didn't show up on my balance until today!

    There was an MSC case # on the back, but it won't show up online at USCIS :(

    Hopefully my NOA1's will be in my mailbox soon!!

    This is all happening faster than I anticipated! I am not complaining though! :dance:

    sorry to hijack your thread..Andrea, there was a number on the back of my check too which ended up being none of my case numbers. check the numbers around that one..like the one on my check ended with 89, but my case numbers ended with 90, 92, and 93.

  11. Congrats you're approved! :dance: :dance: This is one of two emails you should receive when your Green card is approved. This email is about "Welcoming the new permanent resident" and the USCIS sends out a letter. The 2nd email which you should get later today will say "Card Production ordered" and naturally it means what it says.

    Thanks! I'm confused earlier, I thought there's something else we need to do. Anyway, I can't sleep until wee hours so I checked my case online. I woke up my husband and told him, I guess we're approved. But not so sure 'coz I am confused. :lol:

    This is so great..... Husband will stop being silly scared that I will be throw out of US. :rofl:
