Again did the person enter the USA prior to 2001? If not then NO penitent will be assessed.
NO, she got here on 2008
-
I think i found the penalty.
Supplement A to form I-485, and the penalty it is US$1000

I have a friend that come to US with a B2 visa. She stayed over her time limit, and now she got married to an american citizen.
She is doing the paperwork to apply for the Green Card, but she understand that she will have to pay one penalty for overstaying.
WHEN she will have to pay, and HOW MUCH it is?
-
Yes, many in this situation use removal of conditions as a time to get green-card changed to married name.
Part 3 question 1 asks for "Other Names Used including Maiden Name"
Thank you
-
We did a mistake on applying first time for the Green Card, we use her maiden name.
Now that she has to apply to remove condition on her green card, should we use her married name on the application, and show her maiden name on the "Other used names" space?

My wife's GC expires July 25, but she has to go to her country next year to finish college (or she will lose all four years she had done).
Dos she has to be here to start the I-751, or I can do by my self?
She will have a school break after (days) her GC expires, how can she enter the USA?
-
We had very hard time at our interview.
The immigration office give me no chance to say anything but answer her questions. I had no chance to ask for a name change, to show my wife's married name on the green card to be made.
What do I have to do now, to have her name changed?
-
I am happy to tell everybody that we got the APPROVAL LETTER yesterday. Thank you everyone that helped us here.
-
My wife got her SS# just showing her passport and EAD, she even changed her name to her married name (showing the marriage certificate)
-
I am thinking the same, because if the GC is denied, she will need the I94 to leave the country....
I-94 is not needed to leave the country (it's supposed to be in the passport but they would not deny a person from leaving without it). (Just to clarify)
Thanks to make me more nervous, rsrsrs

We had our interview on the 6/23.
After waiting for 50 minutes we finally had our interview.
The immigration officer were an oriental women, with a strong ascent.
She requested an interpret for my wife (over the phone).
With the translation been over the phone, mistakes had been made, and I tried to fix (like my wife said a date 08/2/08 and the translator told 08/12/08), but the officer told me not to say anything.
She took my wife's AP papers, her I94, one photo of us together, copy of our joint bank account, copy of our rental lease.
Those anybody knows what that translate to? Are we approved? How long takes to know?
This may be good news

She made a lots of questions to my wife, about dates (arrival, when we met, when she moved with me, our marriage), she even questioned WHY we got married in Vegas.
On my turn, she asked about my previous marriages, and she requested the ORIGINALS of ALL my divorce papers. I didn't have those paper with my. She gave me until 12:00 pm of the next day to bring.
I did bring the papers next day, and I had to deliver the paper at the window, and had to wait. After 10 minutes the window lady returned the papers and told me that the officer accepted the paper and we should wait for her answer over the mail.
Those anybody knows what that translate to? Are we approved? How long takes to know?

It is a standard procedure. She can answer easy questions like "your name, date of birth, address".. things like that. If the questions get complicated, you will be allowed to translate and help her answer. It`s normal... Don`t worry about it. Go over Sample Interview Questions with your wife and have her prepared to answer those. They are usual questions.
Thank you very much
-
At the interview you will be asked if she needs a translator OR if YOU can translate for her if necessary. If you would like a translator, just bring one along with you.
I can act as a translator, I have done that many times at the hospital and doctors (she is pregnant), but would they accept that?, I could be answering for booth of us...

Our interview will be 6/23.
My wife speaks limited english. I am afraid, if they start asking complicated questions she would not be able to understand and answer properly, if the nervous would be enough.
Can we request a translater for the interview, and if yes, when that should be done.
-
Our interview will be on 06/23/2009.
My wife it is 15 weeks pregnant.
By June, she will be week 23 (big bally).
Dos anybody know if we get any break from the interview officer?
It is obvious that we if are having a baby, our marriage it is legit.
-
When we did all paperwork (I-130 and I-485) we used my wifes maid name (all documents had that name).
Can she now at the interview ask for a name change (adding the husband last name)?
-
My wife just got the EAD card.
Now she will apply for the SSN.
The EAD expires at 3/31/10
My question is.
Will her SS card show an expiration date (3/31/10) stamped on the card?
If the answer it is YES, what has to be done to replace the SS card after the GC has been received?

Hi ,
My fiancee arrived in the US on Saturday (April 3) and we are planning on having the civil ceremony this Thursday (April 9). We applied for the marriage license this morning, but they need proof of address that he is living with me in my apartment. Since he only just got here, he doesn't have anything that "prooves" his address is with me. How did any of the rest of you who got married quickly after your fiancee arrived get the license? What did you use for proof of address?
Thanks!
Go to Vegas, it is so simply to marry there.....

My wife has her AP approved.
She will be back on june.
Dos she need to fill up the I94 paper?
Can she go on the resident/citizen line, at the immigration entry?
-
I will scan and email to her as well.
Looks fine by me, approved before departing the country.Make a few copies before sending them.
-
My wife had to go out of the country before she got the AP.
She left the country on 04/04/2009, and I got the AP papers yesterday (04/07/09) on the mail.
On the papers, shows the approval date 04/01/09 (before she left the country).
I will send her the AP paper before she is schedule to return.
Dos anybody think she will have a problem at the immigration?
-
We received NOA(I-797) with the receipt number (MSC......).
But when I enter that receipt number on www.uscis.gov, I get "error, case not existing".
She will leave the country 4 a week before we will get the AP papers (assuming the timelines here are correct), and I will send her the paper later, she only need the papers to return.
You say the info isn't on the computer. Do you have anything, any case number on a piece of paper received by yourself? You must have had something if you went for biometrics. It is NOT illegal if your wife leaves, however she won't be able to get back into the US without her AP in hand. Here is just one of many threads where someone got expedited AP. Read through all the posts. Many of them were by myself. There is a listing of offices where you can go...you'll also note that the OP in that thread had a letter from a Doctor. Do you have that? Who says your wife is at risk for a miscarriage? Do you have this documented?
I find it incredulous that there is no clinic in your area that can help your wife out right now, and you're also saying no one will help her even though you've offered money?? My gosh!
If she HAS to get back home, then please get back into the infopass place, with your documentation, and please be assertive, not agressive in trying to get your needs met. Have your wife with you, bring your documents...make sure you have something from a Doctor here to verify this information. Have copies of reciepts, particularly letters with your case number on it, and receipts of payment for your I-131 etc.
Please get back to us with what happened.
Wishing you all the best.

hi
i just recieved my ead card today and i am so happy thank for everyone and all the members for VJ
so this card is valid for one year what i can do when is expired and if i renew this card with fee or no?
thanks
no body can help me!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
You should get approved for your Greencard before the 1 year EAD expires, once you have your greencard you no longer need a EAD.
If for some reason your are still waiting for approval of your Greencard you can apply for a renewal EAD at no cost.
thank u for your replay .i still waiting for my green card to be approved to
what time i can apply for citizenchip?
thx u so much but what u means by 3years of green card?i am married with a americane
If you are married with an american citizen, you can apply after 3 years of green card.
If are divorced, you can apply after 5 years of green card.
You have to be resident for 3 years, them you cam apply for citizenship. If you got divorced before you complete 3 years, you will have to wait for 5 years.
