  1. If you choose to go for the CR1/IR1 visa, the NVC will not only process the Affidavit of Support but the DS-230 as well, which is the visa application. With the DS-230 the beneficiary will have to send a list of civil documents which include the police certificate.

    If you decide to go for the K3 visa, the NVC will only assign you a case number after the petition is approved by the USCIS and then they will forward it to the embassy. The beneficiary will then have to take their police certificate with them to the embassy the day of the interview.

    Diana, THANK YOU!!!!!!!!!!!!!!!!!! I thought I was right on it, but you reassurred me on this subject. From all the reading, I only see CR-1 mention police reports and NVC in same sentence. Its like pulling teeth trying to get docs for my love from Algeria.

  2. I have gone over and over the NVC webisite here and there, when we are approved, do we need to send the NVC a police report along with all the other reqired forms I do know about? If we apply for a K3, does NVC get a copy also of police report, or is that saved for the interview at embassy?, along with all the other required forms? I thought NVC was just delaing with the financial part of this process.

    Thank you for any assistance on this confusion.

    No one , even the president of usa can change the immigrantion system so fast.

    all the process is going through in orders. Everything takes time.

    Just let it be and rememeber there are ppl who just filed today.

    most of us already passed that stage. So let USCIS do their job.

    The biggest probelm with USCIS is the Vermont Service Center, their processing times are awful. Sometimes they crank up the wheel and spin them out, but for the most part, their wheel is broken. I went thru this once in Jan. 08 and now we are re-filing in a couple of weeks, and already dreg that our petition will be on some dusty shelf covered in cob webs waiting to be processed in 9 months or later.

  4. I know Obama has alot on his plate but in general,what do we all think his impact will be in regards with spousal immigration ?

    Will he look at it and say no married man nor woman should have to be apart for 6 months not alone a year and a half to two years in many cases ? Therefore decreasing the "waiting time" for lawfully married madly in love couples

    Will he since he is the voice and spirit of change ,make the uscis ,nvc and u.s embassys and all "buck up" to helping married couples either with kids or without instead of getting in the way and increasingly make it harder

    What IMPACT will he have,what are your thoughts and feelings ,the only thing I have read about his comments on spousal immigration is that he is somewhat open to allowing same sex couples to go through and be allowed to go through the spousal immigration process !

    I know nothing will change overnight and their has to be some laws to of course show a valid relationship and marriage but when you hear that it only normally takes uscis 15 mins to look at case the only reason the wait is so long is to put couples off ,no fraud relationships etc

    The very sad part of it all is, nobody knows how tolling this is on a person, a family, UNLESS they have go thru this process. Knowing that a family happiness lays in the hands of USCIS and the Embassy. We can not help it if our heart fell in love with a foreign national. Love is not always next door.     I need some help for a friend in the Philippines who is married to a USC and they are still waiting for NOA2 at the moment. They've been married nearly 2 yrs now and things had change recently with their relationship. Just last December the came back to the Philippines to supposedly visit the wife but he only stayed there for 2 days. He confessed to his wife that he has another girl in manila and he is no longer in love with his wife. He told her that he arrived a week early and stayed there with the girl. The wife was devastated about it but still hoping that the husband will come back to her. Anyway after he came back to the US he tried ignoring her. Just 3 days ago the husband called the wife telling her that he has a big problem. He said that she needs to sign a divorce paper because his previous marriage to his was not final when they got married in the philippines and the ex wife is filing a case to him about bigamy. Anyway, my question is : IS this possible that the divorce was not final?

    Tell him if what he says is true, he needs to finish divorcing his ex, not divorce his current wife!

    I think he is lieing.

    If the man was still married to another woman at the time of his last marriage, that marriage is not Valid. And there is no true formality to declare that last marriage invalid. He need to complete the 2nd to the last marriage to be total free to marry again.

  6. Thank you guys for the quick input. Just sad she was waiting for a year and just have such news. Another question though... IF she will not sign the divorce, what she can do about it? Can the husband file an uncontested divorce with her being the Philippines?

    yes he can.

    service by publication in the leagal section of the newspaper. He was just trying to swave the cost of doing this, by having her sign and acknowlwdge to complaint.

    Have the guy send her a copy of the complaint, but do not sign for certified mail.

    Also if she does not sign "which I would not if I was her" this divorce will cost him lots and lots of money. Since maybe this is a International divorce, posting and or publication may not be allowed in this case. Since she in there and he is in USA.

  7. Ok so far so good I have all our old emails in a folder on Yahoo. Now how do we extract these in order to print them off? Whenever I select all the emails and try to print them off, I get a message that states you can only print one at a time. Gmail was much more co-operative. In fact I have transferred to google Gmail as it is advert free and I didn't have any problems printing off old emails. Many thanks for help.

    Just print a few of the juicy ones, and print the screen showing all the emails back and forth to each other.Enclose those woth your petition.

    Dont forget to print your chat log too.

    Then later keep up with them and print a few at a time so its not so much printing later.

    I just had my love print ours, cause I did not print any and bring them with me to Paris with all the other docs I brought with me here.

    I wanted him to have a complete copy of petition now while Im there, instead of sending it to him later.

    If you were in military, you will need produce your military service record, if you did not serve in military you need a statement to this effect.

    Military record (if no military service was done an official letter stating no service was done is still required)

    This form is required for the time of your interview. Im not sure where you obtain a statement of Non military service .

    Maybe you get this form from the same place you get your police records which is also required at interview. Check out the Embassy information on this website, very much information.

  9. I couldn't take it anymore. I need to see him. I miss his family so much.

    I was trying to hold out to see if the k-3 would get approved. Then maybe I would have waited if I got an interview... BUT no such luck. Even if we get approved tomorrow, its still a six week wait for an interview. I think I would die. I'll just fly back again... I pretty much go every 6-8 weeks anyway.

    I love the excitement of flying to Costa Rica. I can't wait to see his face. Then a few days before its time to leave I get really depressed. And his family always asks me why I don't stay longer. I wish I could. Life there is so different. They are all so laid back. They lead a simple life.... so then I come back to my job, my stressful life and of course the ex-husband drama. Of course I miss my kids while I'm there. I chat with them on AOL and I use Skype to text everyone. and they call me on his cell phone.

    If you go to Costa Rica, I suggest going in December or January. It is summer time then. The kids are out of school. There is more to do because its not raining everyday. And during the rainy season its like no other rain. It pours EVERYDAY. You have to carry an umbrella everywhere you go.

    I can't wait to go in 2 weeks. OMG I just need to see his face. :wub::wub::wub::innocent:

    Hang tight esposadetucho, I understand of being apart, is difficult and so sad and depressing at times. These next 2 weeks will fly by. Focus on packing and taking care of things while your gone, the time will fly by. And of course we are all here for you. Have a safe trip. I myself is getting ready to leave for the airport to go to Paris for business and then 2 days with my Love.

  10. I live in Bucharest with my wife, she is Romanian, I'm American. we were married on the 20th of September and we both live here as of now.

    we mailed in our I-130 a couple weeks ago. I'm just a little bit confused about the whole process. Whats a K-3 visa? We got something in the mail saying they recieved out paperwork and now they are processing it. What do I do after they accept the I-130? What are the steps? How long do you think it will take before we are on a flight to America? What can I do to speed up the process or what should I have ready next so as soon as they mail me the acceptance of the I-130, and can mail them the second part? Any advice would be appreciated.

    Hello Ben, start with the Guides here at Visa Journey, they will explain the differences of a K3 and a CR-1 Visa.

    But if you now live in Bucharest, maybe you qualify for Direct Consula filing. Check the emabassy website here on VJ if Bucharest has DCF. That is faster then the traditional way of filing. But you have to meet certain requirments first to file DCF.

  11. Well the lawyer is a family law lawyer. Anyways, no my marriage was invalid, due to the fact. I found out a marriage of mine from 24 years ago was still on record when it was not suppose to be. UGH! That is another long nightmare. Anyways. Got that taken care of ASAP, but sadly it made my Nov. 2007 invalid. So we have to re-marry. I will still be a single girl when I come back at end of week, but when I leave for Paris again Feb. 10th and return Feb. 16, I will be a married lady again. I did explain this to Paris embassy when they called me, cause they called when Mohand was having the Affdavit of Absent application for a marriage license notarized, they wanted to make sure it was for real. Even asked me if we ever saw each other, and of course I replied, 3 times I have been there with him, and have shared a life 5000 miles apart for the past 2 years.

    I pray all goes well this time, I admit Im nervous of it all, refiling and the waiting. After all, this is our hearts in their hands.

  12. Yes, it is pathetic. I paid ALOT of money for the EX to be in front of HUSBAND. I am still paying the divorce lawyer off. He got most of my inheritance because he moved the money into his account and I had no access to it. He paid all his debts with my money.

    Its ok because the money I paid for my divorce was well worth it. Now I just want to know who I pay to get him off my back and out of my life. We have one daughter to raise together. He needs to learn to not be so angry and he needs to realize he's not the boss of me. HA HA !!

    Maybe he's mad because I don't pay any mind to him and I don't care what he does in his life

    Anyway, I have to go call my beautiful husband and say GOOD MORNING. He's waiting for my call.

    BEST OF ALL ... I'm flying to Costa Rica to see him on the 31st... I CAN'T WAIT !!!!

    We know we have a long journey ahead of us, but its easier to get thru it with great people here on VJ, and knowing one day this year my husband and I will be under the same roof. I know I wont sleep on the plane, but knowing I will be able to spend 2 days with him this weeks makes me get thru the next 24 hours. Plus I get one more single girl kiss from him before our marriage.

    Oh I forgot to address a question: of why file for a K3 and not a K1, due to the fact since Mohand and I were married Nov. 2007 but our marriage was invalid "i did not know this till June 2008" anyways, I took his name when I married him, drivers license, S.S. card, banking, credit cards all changed to his name. So Im afraid I will confuse USICS if I file for K1 useing his name, cause Im still useing his name, and I can, cause im not useing it for criminal or fraulent cause, "my lawyer told me that". So thats it, afraid I will confuse USCIS at time of filing. Supervisor at Paris embassy Immigrant Visa section said file under your name your useing and write a explanation letter. I'm a bit nervous doing that. Last thing we want is another delay.

  14. Not only it being the weekend, and I will be packing for my hooneymoon in Paris in less then 3 weeks, I just found out I'm on a plane to Paris Monday night for 2 days for business, so...... I get to spend a bit of time with my love before I leave for Paris for honeymoon. "We are being married Feb. 10th via proxy." Now that is the kind of good news to start the weekend. Almost as good as a approval. Enjoy your weekend.

    Here is my situation, I am a divorced man. The last two year I have been going back and forth to Vietnam and met my current wife. She is currently pregnant with my first kid. Due to money reason, I have not doing the paperwork, getting marriage license and everything. Anyway, I'm planning to sponsor my wife and my child here to US but I don't know what kind of papers i need to bring with me to Vietnam for marriage. I have the divorce decree from the judge, but someone told my i need to get a Certified Divorce Decree in order to get a marriage license in Vietnam. Please let me know if you can help.     Well, get the marriage lince 1st, then start from there.

    I thought the applying for the K3 allowed you the option to choose to pursue the K3 OR the CR-1

    Please help me wrap my head around this?

    The K3 is indeed an option if you're married to a USC. As for us, we're going with K3 since both petitions have been approved. There are advantages to having your GC as soon as you step in the US, but we got burned out with waiting for the approval alone. Lesser fee for AOS with CR1 isn't worth it (the stress that is, for me) if it means waiting some more and wondering about the status of our paper without my husband by my side. Sure I won't have the GC as soon as I get there, and I will still have to deal with AOS and all and pay a much bigger amount, but at least I'm with my husband already. But if you can haggle both petitions and get an interview soon as well, the better. I'm just tired of filing stuff for now away from him. We'll rest for a while and deal with it again when i get home.

  18. It's because they're the government and they can do whatever they want.

    Then if you call them, they ask "did you look at the timeline on the website?"

    Total waste of time and only serves to raise my blood pressure.

    Meanwhile, we wait wait wait wait wait and are resigned to the fact that it may well be after our first wedding anniversary before she and my stepdaughter are allowed to come here. Instead, I'll just take trips to see them when I can afford it, since it only takes a week to get a visa to visit Russia.

    At least we have a sense of humor about it. When it came time to get married, we were able to cut through the Russian red tape and arrange everything in the space of a month, rather than the 8 months that is standard. But here in the good old U S of A, land of the free.... we can't even get a straight answer out of them. My wife enjoys teasing me about this.

    It is very important to keep your sence of humor. Dont give it, it will happen when your not expecting it!!!

  19. Change of administration, and several holidays and not to mention that they are not really all that accurate..

    I wonder in our new petition should I include the past 2 years of emails, and phone bills,and internet chats?, or just the marriage cert. joint banking, joint Master card, life insurance information on us along with pics and wedding anouncement? Oh also will enclose proof of my last three trips there, and include my trip Feb. 11th to see him along with those receipts, boarding passes and passport stamps to show I was there after marriage ceremony.

My husband called CSC today to see how far they are with our case, and he was told it could take up to 80 days from transfer until approval- and if we haven´t heard from them before the 80 days are up, we should call back. They gots to be kidding!!!. Do these people realize the amount of heartache and stress all the couples are undergoing while waiting for the NOA2 :angry: ?!.

    Im sorry to hear that, its night right to wait so long for your loved ones to join you. Not fair at all. I dont think VSC or CSC has any idea of how hard this is to deal with, especially with children.

    May I ask, how did your I-130 petition for your husband get approved so quickly?? WOW!! That is a receord for VSC.

    It´s not fair at all to anyone- This waiting has turned into a headache .

    My husband is the USC. Honestly, I have no idea how my petition was approved as quickly as it was. We didn´t get any touches and we was prepared for it to take months, but very pleasantly surprised that it was approved as fast as it was- which also is a bit confusing when the petition for my son has taken this long. You´d think if mine was approved it wouldn´t take much for them to approve my childs petition, but I guess we´ve learned something new. We haven´t started on my NVC case because we were advised by the embassy out here to wait for the NOA2 for my son, so we could do NVC, the medical exams and interview together.

    How far along are you on your journey???.

    Well my dear, Im starting all over. Ive been thru this before Jan. 2008 and cancelled petitions June of 2008, long nightmare of a story. But

    Feb. 10th 2009 my "husband" and I are getting married again, and after honeymoon, sending in the petition. Its ready to go, just need to throw in marriage cert. and honeymoon pics and proof of honeymoon. due to proxy marriage. UGH! so here we go again and VSC will process. this time all problems are gone, and starting with a nice new slate. Wish us luck. I hope sons petition is processed ASAP and will bring your family together once again.

    Thank you, atleast I know what is ahead of ourselves. And the best part I get to see my husand again Feb. 11th in Paris. I last saw him when I was there just last month. We went almost a whole year not seeing each other except on web cameras when we chat. Not the same as seeing his wonderful handsome face in person.
