  1. I, personally, was in the same situation.

    If your friend is out of status, he cannot adjust status to that of a resident. He would have to leave and return to his home country for consular processing. The moment he leaves the US, he will trigger the 10-year bar.

    Just Bob, is there anyway to work around in order to lift that 10 year bar? Does the waiver help in that situation? If yes, who can file a waiver for him? Your feedback will be highly appreciated !

  2. Suggest you PM Bob as he was in this situation but the answer is...he would have to leave the country for consular processing at which time he would incur a 10 year ban for which he does not qualify for a waiver.

    I don't get why people apply for DV knowing they are out of status. Not only is waste of time but also waste of someone else's opportunity to be granted stay in the US.

    I see what you exactly saying but everybody wants to take a chance regardless of what the outcome be.

    What are his chance of getting approval if he goes through his consulate?

    When you say qualifying relative for the waiver what are the requirements? Does anybody within his relative has to file for his waiver? or how does it work? Please suggest.

  4. people who are out of status aren't elegible for the GC, he will be denied if he continues the process.

    just like many immigration petitions and visas, the person has to have legal status to adjust in country.

    the DV lottery is really for people waiting in their country and once they are granted a visa, to como to live to the US. if you file in the US, you must have legal status at all times.

    if he leaves, he will trigger the 10 year ban.

    it would be a waste of time and money and it could trigger a deportation order.

    One of my friend who is living in US out of status won the DV lottery this year. He came to US in B1/B2 visa 12 or some years ago and living here since then with an expired visa. Now what happens to his DV lottery?

    1. Will his DV application be approved or denied?

    2. Does he have to go back to his country to do consular processing or he can also do AOS from here?

    Your feedback will be highly appreciated. Is there anyone who went through the similar/same situation in the past?

    So far Friday is good with the job data :star:

    Put the sell order of BRCM Jun Call at $1, setting a return of 42%. Not yet executed, but coming closer. It was down yesterday :star:

    If this order gets executed overall portfolio return will be 15% in 8 days.

    This is my plan, but plans are ALWAYS on paper :star: Once portfolio approx. doubles, withdraw all initial investment and play with the gain ONLY (Even 100% loss will wipe out only the gain!). Please bless me :star:

    Yes, as you said, timing the market is highly impossible. Set the profit margin and dump it. Is it worthwhile to look into penny stock since risk is the highest? But return is phenominal if one clicks!

    I have already an account with Scottrade, but they charge $7 for trading. When I google, I saw Optionshouse.com who charges only $3.95 per trade and free 100 trades in the first 60 days of a/c open. Anybody has any reviews of this online trader?

    Exactly, I should have set the profit margin and dump them before the price fell down. Penny stocks are very volatile these days, it's not worthwhile to load them unless you do extensive research and do day trading. BTW, I use zecco and it charges $4 for each trade. I don't have any idea about optionhouse.com though. I hope those stocks will be back in to shape again :(

    India are the new world champions for the next 4 years :star: It was a nail biting match when Sehwag and Sachin were out so cheaply! But, Gambir and Dhoni made it so easy! Congrats to India team and especially this WC is dedicated to retiring Sachin! What a final!

    I was so disappointed when both Sehwag and Sachin were out so early, but Gambhir and Virat did really good job and same was followed by Dhoni the winning captain :)

    It was nice to see team india carrying Sachin and walking in the field. Congrats to team Indea ! They made the history once again :)

    I was hoping that Sachin will score 100, but it didn't happen. You saw how lucky he was that they dropped his catches multiple times. He has put so much for his team now and this will be the last worldcup of his life and people want him to grab the Cup for second time as well :D

    Now lets see how they chase SL in the final :D

    SSN update:-

    We (my wife and I) visited SSA office this morning. I was shocked to know that they didn't have her in their system yet. The lady asked us to fill up the application form (SS-5) and we did so. She said we should be receiving her SS card within 7-10 business days now.

  10. A quick update on family front - our little princess is turing to one next week :star: My FIL will be here with us for 4 days, after his medical conference in New Orleans for 3 days to celebrate it with us.

  11. Hey everyone, been hanging around MENA lately....just an update on hubby's interview. He was denied again. For anyone that doesn't know, this is our second time through immigration. She told my hubby she doesn't believe our relationship. Interview went well too, hubby thought almost 100 percent he would be approved, when after she was done asking questions, she asked to see photos, and told him to take a seat. Called him back, and it was denied.

    That's so sad to hear Tany. I donno what to tell, but it's seriously frustrating. Didn't you have family photographs to show them to consular officers?

    I got here on the 1st of march, and just got my green card today (even though i was hoping to get my SSN cause i already had a few job interviews but i can t work yet without this stupid number).

    It s been 3 weeks today, so i guess i ll go tomorrow to the local SS office, and follow indigo advice!

    Remember those days? We were so panic and desparately waiting for NVC to complete our case and give us a interview date. Now everything is over and finally we all (almost) are with our loved ones :D

    I still have not been able to talk to anyone at DOS, to see if and Interview date is set.

    I will try again tomorrow and try to call NVC. I leave for my trip thursday, 24th,

    until 18 April. Was hoping for an Interview date. If it is after, or near April 18,

    I can change my flight dates......... :blink: .

    Bob, I suggest you to keep trying DOS line. Don't give up. Try in different day part. Good Luck :)

  13. My tax return was rejected for two reasons. 1) My wife's name and social security doesn't match. 2) Her date of birth doesn't match. I called Social Security and everything is correct. I called IRS and they said they don't have any record of my wife yet. This is will be her first time being included in an American tax return.

    Am I filling the tax return too soon after a brand new SSN? I think this is the case. I heart IRS gets a data dump from SSA once a week. So I might have to wait a week to file. Malvika, I understand your spouse got a brand new SSN card.

    Indigo, you might be right on the ground of rejection. As your wife's SS# is brand new and IRS wouldn't have record of it. BTW, I used my wife's last year ITIN to file 2010 tax. You know I filed mine on 02/22 and I still don't have my wife's SS#. Good Luck to you buddy.

    I think I got NY tax refund in 2 weeks time and Federal in 7 or 8 days time after e-filing. That's all history now :star:

    Your return has been processed. A direct deposit of your refund is scheduled to be issued on (MARCH 22, 2011). If your refund is not credited to your account within 15 days of this date, check with your bank to find out if it has been received.
