Can someone please point me in the right direction? I've tried searching but am still not cleared on what the correct answer is. I've really appreciate it anyone can shed some light. Thanks in advance.
My wife, which is now a lawful permanent resident, came here via a K1 visa a few years ago, would like to bring her unmarried, minor child to the US. He initially did not want to come here when we filed the K1 years ago, therefore we did not file for a K2.
Question is:
A. Can my wife now file to bring her child to the US by using the I-824?
OR
B. Will she have to petition him using a I-130?
Thanks again.

Just wanted to let everyone know that we've received the Green Card in the mail today! Happy holidays to you all!
-
Thanks guys for all your support! I hope everyone will get their approvals soon!
-
Just received an updated status:
On December 16, 2011, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283.
Hopefully, it is true. But I will believe it when I see the card!

I sent all ours without a coversheet and it was all fine. My opinion is that they don't even read the coversheet, but that's just my opinion and no one elses.

Hi everyone,
We have sent our AOS (I-485 +I-765) on 08/29/2009 by USPS and USPS said that the package already come to Chicago lockbox. Could anyone please so kind to let me know when they will send NOA for us because it has been one week we not yet received that if they get the pacakage or not, i am a little bit worried...
thank you so much for your kindness,
Huong
Us too! We mailed ours on 8/31 and got confirmation from usps that they delivered it on 09/01. I might be a bit anxious but they still haven't cashed our check yet. So am I just a bit too anxious?!?! I am assuming it might be due to Labor Day so a bit of a delay there???
Thanks!!!
Hi, I guess you´re right, its delayed because of the long labor day weekend...we filed our AOS on 08/31 and jut got the confirmation card from USPS back that our case was delivered on 09/02....they didn´t cash the check either....so I think I will wait another 7 or 10 days before I start getting worried.....
Hi,
Just wanted you guys to know that they have cashed my check today. Then in the mail, there was the NOAs. Therefore, for those of you that filed around my time, which is at the end of Aug, you should be getting your NOAs soon, if not already!!!

According to the Hong Kong embassy info it takes 4 working days by mail. Not sure how accurate that is because there aren't a lot of reviews of the HK embassy. You can check out the imbassy in for here
http://www.visajourney.com/consulates/inde...cty=Hong%20Kong
Good luck!!!
It is quite accurate, according to experience.

what is the real difference between the original and the "courtesy" copy... you would only submit a photocopy of it anyway
I believe he is referring to the following statement on the courtesy copy:
"This courtesy copy may not be used in lieu of official notification to demonstrate the filing or processing action taken on this case"....
I had the same situation, but fortunately enough our attorney made the "official" (his copy) of NOA-2 available to us.
Yes, thank you.

Anyone can provide some input on this, would be very helpful. Here's the thing. A lawyer was used for obtaining the K1 visa. To say the very least, I didn't have the best experience with the service. I was more stressed out with dealing with them than the K1 process itself, but that's another story. Regardless, my fiancée did obtain the visa and arrived in the US.
Now we are starting to do the AOS and this time, after finding VJ, I decided to do it myself. My understanding is that we will need our NOA2. I have attempted several times to contact the lawyer, to return my documents (NOA2, etc). But I have not received any responses. Therefore, I highly doubt that I will ever get it back.
When USCIS sent out the NOA2, the lawyer received the original and I received only a courtesy copy. Since I won't be getting back the original NOA2, I was wondering if my courtesy copy will be sufficient for the AOS?
I really appreciate any input on this.
Thanks!

Hi! Do you know someone that in the embassy interview his/her visa was denied????????
Or someone that their papers were approved in the USA and then they didnt approve it in the embassy?
Try doing a search and I bet you can find some.
-
I think you can follow the example form
-
Jeremy,
So this blue sheet is almost the same as the first blue sheet. Except this one doesn't say to submit your passport and also doesn't state that you will receive your visa upon receiving the document(s). If it is similar, then it shouldn't take months. I would suspect it would take a couple of weeks. Then if they have to reschedule for another interview, it might take another month. I think US Consulate in HK is not really that busy so they will be able to work much faster they say.
-
Jeremy,
I really am so sorry to hear the bad news. After all that you and Dora have gone through, now it is again hurry up and wait. I just feel really bad and I can understand how you feel because we all know it is so hard to wait. Please let me know if there is anything I can do to help.

Please anybody shows the employment letter at the interview for visa K1 let me figure out what information written in the employment letter? ASAP.
Thanks.
Straight from the FAQ:
Basically, your employer letter should state "To whom it may concern: (first name, last name) has been employed
full-time with the XYZ Company since 200_ as a (name of your job), and is an employee in good standing with an
annual salary of $XXXX. Signed, John Doe, Supervisor (or whatever title)" The letter should be on company
letterhead.

u said u only seem to get along when ur together, maybe when ur apart the distance is over whelming?
i dont know about anyone else on this forum but distance and the lengthy process that perviz and i are forced to deal with has lead to some pretty good fights, and its always about nothing
just stress getting in the way making us on edge maybe that is the issue with the two of u?
sara
I have to agree with sara. We're on the same boat, we dated for four months here in the philippines wayback July 2007, then he went back home
even though we keep in touch thru email and yahoo messenger, it still seem not enough and we both sometimes get frustrated with the situation.
You or she could get irritable over petty things because of not being able to do anything about ur present situation.you were so used to see each other almost EVERYDAY for six months then all of a sudden you cant even hold her hand.
you thought that the problem was your indifferences, but its actually the pressure of the moment.
Maybe both of you has to comprehend on your true emotions ; that its just that you badly miss each other and fell helpless right now and cannot do anything about the situation. Believe that it's gonna be alright, and that in Gods perfect timing, you will be together. It could be just the stress of the process. shes stressed and worried and so are you.
I hope you can still work it out.

Our Timeline
06/02/07 - Met thru a friend here in the Philippines, started texting everyday
06/07/07 - went out clubbin with him and our friends
06/09/07 - first date together, inseperable and see each other EVERYDAY for 4 months
11/10/07 - his flight back home : (
04/16/08 - flight back in Philippines and stayed for four months again : )
08/16/08 - flight back home : (
09/14/08 - proposal over chat, i said yes : ) planed to have engagement party in his homeland
before applying for a petition
12/17/08 - changed our minds, SENT I 129F, thought its wise to start asap!
12/30/08 - I-129F Received at the VSC
04/09/09 - NOA thru email
04/20/09 - NOA letter
05/06/09 - Manila Embassy Letter, eligibility for appointment
05/07/09 - I called for appointment, chose JUNE 18 09
05/18/09 - will walk in at SLMCEC for medical
06/18/09 - Interview date
What both of you mentioned seem so familiar. Sometimes we would argue on such petty things but when we are together, those things do not matter. We both know that a lot of times it is because of the frustration of not being together, not being able to control the situation, not being able to see each other, etc. This process is torturous and it affects both of us.

I did some searches on here and someone else posted a similar question. They received this answer by Nich-Nick:
Statement we used on a separate sheet of paper added to the end of the I-131:
I-131, Application for Travel Document, Part 7
Statement of circumstances that warrant issuance of advance parole
I wish to apply for advance parole and obtain the necessary permission to travel to my home country prior to receipt of permanent residency status in the event of emergency or family illness. I also have a house for sale in the United Kingdom and will need to return there to complete the sale. I do not have any specific plans to travel at this time.

Do be very careful about your non-legal ceremony. I would not include any photos or information about this ceremony...especially if you have plenty of on-going proof already. Wear no rings and do not speak about each other as 'husband/wife'. Although some people do this with no problems, we have had lots of horror stories here on VJ when couples have tried this as well.
What about engagement ring?
thats fine, if it has a huge diamond on it then don't include it because it will look like a wedding ring.... try to keep things as simple as possible,
I am not sure what you mean. Unless I've messed up, my engagement ring that I've purchased for my fiancee was a little over 1kt. I thought the engagement ring is the one with the bigger diamond?!?!
Unless I am mistaken, wedding ring/band usually are less expensive than the engagement ring?!?! If wearing a diamond engagement ring is a no no, then I better tell my fiancee before the interview.
Thanks in advance!

Congrats!!! And guess what, I was so afraid to call NVC to check on the status, I wanted to wait until someone else from this thread to call and get the good news first and then I will check also. So when I saw your post, I immediately called and my was also sent out to Hong Kong on April 13th!!!!!!!! That is so great!!! Thank God!!! Good luck to you all!!!!
-
Yes, hopefully our petition wont' be held too long and will be forwarded to our SO's consulate quickly. I just don't understand how it all works at NVC, not that I understand how CIS works or anywhere else. Anyways, I was so happy that forgot to ask for my NVC case number the first time I called so I called again and asked for it. All K1s, please process through NVC quickly!!!!!! Best of luck to us all!!!!
-
Wow, maybe they are finally back to actually working! As I've said, I will call them again, and when I did, they actually asked me to verify information. I provided my and her email address. They had my address correct, but for some reason, they got my phone number wrong?!?! So I corrected her with my correct phone number. Regardless, I asked her when they have received it, she said yesterday. The lady was not very nice, but regardless, I am happy that I finally got my petition. Thank God!!! Now I just hope it will get pass NVC quickly and on to Hong Kong. Again, good luck to us all.
-
Maybe I will get mine soon??!?! I can only hope. Let me try calling too. To those who received it, congrats, to those still waiting, good luck to us all!!!
