For all other VJ folks and friends - I got my Green Card today in the mail with no errors. The expiration date is 08/26/2019 but I will be applying for US citizenship through naturalization during Aug 2012. Thank you all for your help. My answer is a NO. You must file the I751 petition. This is not an optinal step in my opinion.

Did not use an attorney. Could not afford one at that point of time. This forum is simply great. The members of Visa Journey together are an awesome storehouse of knowledge and experience. So, talked to the members here, took their advice and did it with great atention to detail. Seek help from this forum and you are more than welcome to ask me any questins that you may have. I will do my best to gude you. I cannot forget the help I got from people here.

Nope, I did not have an interview. Had one for AOS in March 2007. I am guessing my evidence was good enough for them to approve me despite being a divorce case.

Got the approval email today.
Here is my timeline
05/15/09 - I751 mailed to CSC ( Divorce Petition/Good faith marriage)
05/18/09 - Recvd at CSC
05/23/09 - NOA recvd extending CGC by 1 year
07/10/09 - Biometrics appointment
08/26/09 - Approval email

All depends on the circumstances.
Do you have a stable job right now? If yes, then is the new job offer more attractive? If no, then I would just stay in Iowa and get the GC first. However, if you do not have a job or if the new job offer is too good to miss then you need to decide your priorities.
I filed a divorce waiver petition on May 15th in the morning then went to office and by noon, i was laid off..LOL. I am still looking for a job and if i get an offer from any company I am going to accept it. If it happens, I just hope that the jurisdiction office for my case does not change ( CSC right now).This will mean that I will have to file AR11 and notify USCIS to change the address for my case if there is no decision/interview notice yet or in process.
In any case, act pragmatically and cautiously. Good luck!

My recommendation was for the situation where the I751 has been filed as a joint application, later on the couple divorces and divorce is 100% complete (divorce decree is available to be sent as evidence of divorce) and I751 has not been adjudicated. I should have clearly stated that. Sorry about that.

My recommendation is to withdraw the original petition and to refile a divorce waiver petition. Rest is upto the person who wants to take a chance. I am guessing most of the VJ folks would agree to what I have recommended.

To the best ofmy knowledge " Unemployment does not affect ROC. Unemployment Insurance/Allowance is not a means tested benefit. Your husband should be fine. My best wishes to both of you and for his job search.

Below is my interpretation
The word APPLICANT is important here.If you have already received a conditional green card then you are NOT a conditional resident APPLICANT. You are a CONDITIONAL RESIDENT. Hence, if you are applying to remove conditions by using form I751 you should get a ASC apointment letter.

If any benefit that you receive falls under the category of a means tested benefit (or whatever the term is), USCIS can ask your sponsor to pay back to the government the money charged for that benefit. Please consult other well informed people in this forum for to confirm what I have mentioned as I may be wrong.

Very normal. They want make sure that they get the $$$ before they extend the Conditional GC by a year.

First of all, I wish you all good luck with your immigration process. Now to my question, I filed my I751 application on May 15th and the application was received on May 18th at CSC. I received the NOA (processed May 18th) on May 24th. When should I receive my notice for Biometrics. It has been a month since I applied, so I am a little concerned about not receiving the biometrics appointment letter yet.
Please advise if my concerns are normal.

Same time, received NOA1 on May, 21, and no biometric yet. Also my WAC-number is not working, as it says it's not a valid number?
I encountered the same problem when I wanted to check my status online ...
Hello Silke and other friends,
1) I called USCIS this morning and informed the Customer Service Rep. about non receipt of my Biometrics notice. She then said, that she will push a service request to the local district office and I should hear something within 45 days.
2) Initially, the WAC number that is assigned to the I751 application does not work when you try to check case status online. I guess, when you get a biometrics notice, you get a different case number and that one works. I may be wrong on this, so someone who has gone through this process needs to verify.

Hello,
I am about to file my I751 with a waiver due to divorce. So on the form where I need to provide the name of the spouse, should I provide her new name or the name she had during our marriage ( i.e with my last name ). Replies will be appreciated. I do not want to make a mistake.

My US citizen wife and I have decided to divorce. I need your advice regarding hiring a lwayer to represent my I751 case/application. What are your thoughts? I have all the evidence to establish a good faith marriage. The lawyer is asking for $1500.

Per my knowledge, it could take 3 months, 6 months or even a year to get approval. I hope you get approved soon. Also, if you have received a Notice of Action, which should have a case number, then you should be able to check the status of your application online. Please call USCIS, if you cannot do so.

Hello Friends,
My company is considering layoffs given the current condition of the economy. If I am let go, will it affect my I751 application (due to File between April 20 and July 19 of 2009). I am asking with reference to the I864 that was filed with my I130/I485showing myself as the self sponsor. Does it matter now that I am Conditional Permanent resident?? Wy US citizen wife does not work currently. Please share your thoughts.

Thank you for the replies and gudiance. I am going to do it w/out a lawyer.As suggested, I will take the time to gather enough evidence which we have and present it in a way, that will hopefully make the job of the USCIS officer adjudicating our case easy.

Hi Mary,
Congratulations to both of you. I am due to apply for removing my conditions sometime between April 17 and July 17 of 2009. Can you tell me what paperwork and evidence of a good faith marriage did you file along with your I751? Did you have an interview after you filed the I751? I think, I will have to file with California Service Center since I live in Kansas. Is that corect? We would really appreciate the information and guidance.

I agree with Kathryn. I spent $37.47 to send in my I751 includin the USPS shipping fee in addition to the $545 for the application. The lawyer I know wanted $1500 as her fees for the I751. The math was pretty simple for me considering I was going to do the bulk of the work. It was a easy decision.
