  1. hi all , hope someone can help me !!

    im looking for some moroccans who already passed the CR1 interview , i need some advices

    here is my case : im 24 , my husband is moroccan but US CITIZEN , we have a kid he'll be 2 years next month , now we are in the last step with NVC , my husband just sent the last documents (police reports , birth certificate , marriage certificate , photocopy of passports ....)

    1 : is it the last step so my case will be complete?

    2 : how many weeks or months does it take to get the interview letter from us consulate ?

    im just so stressed about my interview !! because we dont have a lot of prove i have just : marriage pictures , birth certificate of our son including our names , familiy book (hala madaniya) , one letter , some old email , marriage certificate !!!

    NVC is the last step before they can send your file to the us consulate in casablanca. once NVC review all the documents they will schedule in interview for you guys. so just relax !!! you guys will be both contacter by mail

    and sent you an appointement letter. in meantime try to collect as much evidence of your marriage relationship

    in case they asked for it. marriage pictures and emails are good evidences , other evidences may also be accepted

  2. Hi Everyone,

    Im an American citizen living in Morocco with my husband and I have a few questions. First of all, I am considering whether to do Direct Consular Filing or Service Center Filing, so I would like to get some opinions on which method might be more efficient. I am also here with a child so I really dont want to be obligated to travel back and forth for visits or the interview. In other words Id rather stay here until the interview is complete and then if everything goes well, we leave together. I still have 4 months to go in order to meet the 6 month residency requirement. Would it be quicker just to mail everything to the US to file at a Service Center? Service Center processing times seem to vary now with some reporting their applications being adjudicated in as little as 2 months, while others are saying 6 months or more. Also, I know the Affidavit of Support is necessary for the CR1 because it is an immigrant green card, but is it also necessary for the K3 since it is a visa? Thanks in Advance.

    sent i-130 : nov 16 2008

    noa1 recieved : nov 24 2008

    transf :jan 13 2009

    noa2 recieved : feb 19 2009

    case recieved by nvc :mar 10 2009

    case completed : may 24 2009

    interview date :jun 11 2009 at casablanca

    interview questions are very simple

    your husband`s name ?

    when did you meet each other ?

    how did you meet ?

    when was his late visit to you?

    when did you get married ?

    he didn`t even ask her for e mail or photo ....

    and that`s yet

    do worry every thing is going to be ok inchalah and good luch to both of you

  4. to any one from morocco please my wife had her ir1 visa interview last thursday 11 and everything went fine except she need original marriage certificate . she brought it next day and she gave it to them with her passport and they ask her for cellphone number so they will call her when the visa is ready and it`s been a week now and no call from them is that normal ? ths

    call them and find out about your wife visa. i found these information for you to contact them :

    usually an immigrant visa is issued next day after interview

    i've been told that cases are processed on first come first serve. i dont khow :unsure:

    My husband called USCIS a week ago, after I was crying for an hour that other I-130's have been approved for such a short period and people who filed after us already got their NOA2's. After my husband asked them if they were approving the cases in the order they were received, the USCIS rep told my husband that this is not correct - every case is different and what could take for some people 10 days could take for others 10 months!!! :crying::angry:

  6. The consular officer didnt explain the reason why she wont give my wife her visa

    all she said was " sorry i cant give you visa now, your petition is not denied, but we will sent it back to uscis for review"

    my marriage relationship is legitimate and i have all the evidences with me. i travelled back home in last 4 months

    to spend some time with my wife, this is another proof of ongoing relationship if they might think other way

    i'm ready to rebut their findings but i need to khow somebody who has been through this hardship

    How long it takes for CSC to review returned spouse petition ? ours is pending since dec 12 2007

    Does CSC give any reasons after their review why DOS sent it back ?

    any help will be appreciated

  7. my wife received a white slip after her interview. the consular think our marriage is a fraud. What can i do now??? Can i apply i-130 again or do i need to appeal. I heard if i appeal it can take up to two years. I went to a lawyer and she said i can't apply i-130 again. is that true??? some people said i can re-apply but they lawyer said i can't. I dont know which is right. Can some one please help????

    you should not apply again . this is not a good solution to your case. you need to khow why the consular officer denied your visa and you should be able to rebut their findings

  8. this is ridiculus :unsure: , almost 14 months now since our i-130 petition was returned to uscis for review

    i learned from these postings that writting to office of ambudsman would not help, so i'm not going to do it

    since they can not disclose the reason for denial

    waiting is killing me, i've read through many denials, but still people got their NOR/NOD within 6-9 months maximum

    what's going on with my case? :angry:

    I am going through something similar...

    ... for me noone is telling me anything... ok so here is my case i got married in Jan 2007 and filed for my I 130 in April 2007 ( i should not have waited 3 mo to file but i thought it would be better ) and I filed I 130 spousal visa CR-1

    .... ok so finally my petition is approved from USCIS and NVC by May 2008 and they sent over the case to Bombay (wrong consulate) they reschedule our interview at the right consulate, Delhi. My husband went for his interview in July 2008, after the interview they gave him a 221g AP for more proof such as a family tree, addresses and phone numbers of all relatives, guest list, emails, phone records, voters card ok so we sent them everything to the VFS office with his passport. They sent back his passport with no visa. They said its in Administrative Processing....

    its been 7 months and still no word. I went to my Congressmans office and they gave me the same response. I call DOS and they give me the same response "221g administrative processing, etc"

    I went to a lawyer and the lawyer said theres nothing he can do for me.... I cant file for the fiance visa because they will reference this case and it will be the same problem....

    I have went to India 3 times and Im going this 4th time for 6 months... the first time i went was for 3 months second time was for 5 months and the third time was for a month and now im going to 6 months.

    what else should i do ? im soo sad....

    Does anyone know what i should do now besides wait?

    It doesn't sound like you are in the same boat. It sounds to me like you are in AP, which is pretty normal, and unfortunately there is no set time in completing this. Abed's was denied. very different.

    Abed, I know this is hard, and I sympathize with you. Ours took almost 4 months to get to from the consulate to the USCIS after his interview. Then almost 8 months before they even picked up the file. They sent us the NOIR at the end of July and I had the rebuttal sent back within the week. The reaffirmed the case within a couple of weeks after receiving the rebuttal. The interview was scheduled 2 months later and he got the visa after another month. So a total of 15 months. And this was considered fast.

    What service center did they send it to? Do you have a representative that is helping you? Have you prepared a rebuttal?

    our petition lasted 5 months between DOS and NVC before they forwarded it to uscis califournia on december 12 2007. my senator made 2 inquieries on my behalf, but the result is just standard answer

    they can't tell any reasons nor predict any time lime. i havent prepared anything yet but i guess i have enough

    evidences in my side, recently i made a visit to my wife in morocco and still exchanging emails and phone calls

    i dont khow if they can consider that visit as proof of ongoing relationship. who khowns. god only khow

  10. It's all depend on us to push for change, the new uscis director is appointed by the new administration

    if we complain upon our senators and congressman and also office of ambudsman, uscis director should answer

    questions about why his administration is not efficient enough because there is no way in the world that cases

    can be pending for years. every case should have a timely manner

    remember that uscis has worked hard last months to push for more citizenship cases beacuse of election need

    but when it come to family petition still the adminitration working slow on them

    but like i said, it's all depend on us how we can make family reunion a priority and try to push this way

    i think that the new administraion should work on these issues by making uscis more efficient with family petitions

    like they did with citizenship case

  11. I think that the immigration system in place need to be changed, most consular officers dont respect evidences

    their action is mainly based on prejugement and suspicions

    I BELIEVE THAT EVERYONE SHOULD BE ABLE TO MARRY WHO HE WANT, PICKING ON AGE DIFFERENCE IS

    DISCRIMINATION

    it's up to us as us citizen to defend our right to marry and bring our spouse or husband to this country

    otherewise this is another way to limit legal immigration

  12. The consul said that the NVC requested it back. It was not initiated by the embassy. They do not know what the reason was. At this point is it advisable to get a lawyer? Or do you guys know of something that we can do?

    NVC does not "Request" the case back, the consulate denies the case and sends it back to the NVC for transfer back to USCIS.

    Typically with this type of notation:

    Dear visa applicant

    The consulate has carefully evaluated your application for your application for an immigrant visa .The consulate is returning your petition to the U.S. Citizenship and services (CIS) via the National visa Center for review and possible revocation ,The Consulant visa section has taken this step because of the reason marked below, should you, the petitioner, or your attorey have any questions concerning your case, make a request in writing to the CIS office where your petition was originally filed.

    Sorry to hear that.

    Did they give your wife 221 (g). And what is the reason they gave.

    they should give you a paper stating the reasons why the visa was not issued

    that sould be in writting

  13. i hope with the new administration that will take place on 21 first this month do better to resolve these pending cases

    however, people with pending case should do better by contacting

    * OFFICE OF OMBUSDMAN

    * CIVIL RIGHT MOVEMENTS AND IMMIGRANT ORGANIZATIONS

    * DIRECTOR OF DHS

    * MEDIA

    * PRESIDENT OF UNITED STATE OF AMERICA

    and we should all remember that every citizen has the right to bring his spouse or husband to this country , this is a

    right protected by laws. it's up to us to find the right ways to defend our rights, therefore i will urge anyone who has

    been through this hardship to stick around, even if your spouse or husbsand made it to this country, we need to listen

    to your stories , change is coming, yes we can make a change :thumbs:

    i had an inquiery made through my congressman on may 2008, i would like to share with you

    here is their response

    " This consulate return is within the normal processing time. It was received back at the CSC on 12/12/07 from the consulate/NVC for further review. The current processing time for consulate returns is approximately 24 months from the date received back at the CSC; however, the processing time could change depending on the CSC workload. These consulate returns cannot be expedited nor may we release the reasons returned from the consulate until the review is completed"

    I did receive a notice of action I-797C form from uscis on DECEMBER 12,2007 stating this

    "This is to advise you that we have received the above petition application or petition back from the department

    of state, along with their request that it be reviewed. we will notify you of any action we take on this case "

    since that time i made so many inquieries online, by phone to uscis and through my congressman, all i got as response is this

    " The State Department/Consulate returned your case the I-130 petitions to the California Service Center (CSC) for review. USCIS received these petitions on 12/12/2007. All returned petitions are reviewed in the order in which they are received. Due to the volume of petitions returned to our office, we are unable to advise you on the processing time to complete our review nor may we release the reasons for return until the review is completed. You will be notified by mail when a decision has been made or if further evidence is requested "

    I would like to bring to your attention that we have all the evidence of our marriage relationship, including

    sworn and certified marriage certificate, weeding and visits photos, emails exchange and money transfer receipts but the consular officer ( a lady ) ignored them all and she decided to send our petition back to uscis

    i came back from morocco 3 weeks ago i did spent some time with my wife and my family now i'm back waiting for a decision on my case. 13 months passed and no answer yet
