    I made the decision to apply AP after I filed I485 in Dec. I would like to know what documents I need to submit and what is "class of admission" on the AP? What should I fill in?

    For class of admission we put k1. Look for the 131 form in this link and they have a version filled out that you can use as a guide:

    As far as documents, we submitted a typed signed paper stating as to why we were requesting the ap, and why it was an emergency. Since the reason my wife needed to go back was for an official business trip, we submitted a copy of the letter she got, which stated that she needed to be there in march. That's all we sent and it got approved. If you read thru the forums, others have said they have sent hospital information, or information proving that a family member was sick. And a few will say that you don't need to send anything....

    BTW, I came to USA as VWP.. Should I still put K-1 in the class of admission or I should put K-3 since I married to the US citizen last year.

  2. Listen to the people advising you to make an InfoPass appointment. As for the people basically telling you that you shouldn't have made a mistake just ignore them. I also made a minor mistake early on in my K1 process and it set us back 4 months. Sure I made the mistake but the fact that I lost 4 months while my petition collected dust on some clerks desk upset me as much as your situation is upsetting you.

    Take a deep breath, relax & make that appointment.

  3. I saw that you want to send some papers in today.

    I hope that you can just go to Local office and try to talk to IO with all the documents in hand. Tell them that you don't really know what to do and really need their help (with good attitude). They may give you a Walk-in ticket to talk to IO there.

    If you can do that before you send out the papers, it will be better and you can be for sure that all the papers sending in are correct.

    Calm down and talk to the IO in local office... They are really helpful since I talked to them many many time and I even walk-in and asked them about the RFE's.

  4. So if you know what was missing why did you not send it to them when you got the RFE? What did they ask for and what did you send to them in responce to the RFE?

    Because i found it out NOW. they said it in the deanial letter?

    made an infopass appointment at your local office.. talk to the IO there and ask them what to do.

    If you miss any documentation, it is better for you to write a personal note and let them know what are you going to do for that (for example, you have submitted a request to get a copy of W-2s, 1099s, etc). Then they will wait for that and your case will be resumed but you really need to send all the info to them.

    I need some help.

    I am going to get my SSN card. I want to know that can I use my married name on the SSN card?

    It is because I applied my AOS, EAD in my maiden name and my own country passport also in Maiden name too.

    If I apply my SSN card, and DL in married name, will I have any problem when I am travelling / doing the tax / creating more trouble?

    (I see the problem that my EAD and green card will be in my maiden name but my SSN and DL will be in my married name) :wacko:

  6. Whatif, I put 2005, 2006, 2007 as the tax years, because 2008 was not done yet.... How could we submit info for 2008 if it wasn't complete. I think copies are fine, because the instructions should specify ORIGINALS.

    Do you have the form 1040 that the accountant filled out? That's how I found out my husband had a 1099, it had another amount under his salary amount....

    My husband does all his taxes online and I believe he does not have any kind of other form which makes it quite difficult for me to go ahead with the process. The company who manages his pay stubs and so are the ones who told us we would not need any other form.

    I will get back to you guys as soon as I clear this mess out,I am going insane.

    You can try to order the transcript from the IRS now. If you really get the RFE ( I hope that you will not get that), u can just send the IRS transcript directly to them ( I heard it takes a week or so for them to send you the transcript)

    I actually have the damn RFE in my hands... :(

  8. Is the 1099 just the form that your accountant fills out with all the info from the W2 on it and sends to the IRS? Now I'm getting confused about the tax stuff. I haven't gotten an RFE but you never know it could come.

    Your accountant will base on the number on W2 and/or 1099 to file your tax. (I saw that you are from canada too. So, you know that we have T4 from your employer and we will get other slips from the bank if you had investment. So u can say that W2 equals to T4 in canada 1099 equals to the slips from the bank for us to file the tax)

    W2 is the one that from your employer. 1099 is the one that you have another income except from your salary (like stocks, etc).

    So if you don't have another income, you may not have 1099...

    Like what I said before, You can dig out your tax file and find the page which told you that you need to input all the amount from your W-2 or 1099 (you will see the number on the right hand side.. and the instruction on the left hand side).

    I didn't know how many W-2 or 1099 we need to submit until I got the RFE and look at the tax file in details....

    Thanks for the details and explaining that.... I have a sinking feeling now, I didn't submit the 1099 :crying: I just looked thru my package. My husband did have one 1099 from his bank, it's only for $106 but it's still something and I never sent it in... I only sent the 1040 and W2. I guess I'll expect an RFE someday soon.... we will see.

    Ok....now I am completely lost. I feel like a d...k. My husband doesn't have any 1099 either and as far as I understand from reading the posts he is not supposed to have them.... I am completely confused. Then,only the W2's are enough? Also, when you guys filled out I-864 form,on page 4,where it says at the bottom TAX YEAR(most recent) did you put 2007 or 2008? because I think that this is where the confussion on my paperwork comes from....

    I also noticed I only sent in copies of W2's.... I don't think anywhere in the instructions it stated original W2's are required though.

    Jillia, that is exactly what I sent,only copies not originals of W2's....

    If you go to I-864 instruction page 8, you will see this

    "If you provide a photocopy of your tax return(s), you must include a copy of each and every Form W-2 and Form 1099 that relates to your return(s). Do not include copies of theseForms if you provide an IRS transcript of your return(s) ratherthan a photocopy."

    The IO told u that not a photocopy of the W-2 or 1099. It should be the original of W-2 and/or 1099s

    You may not receive any RFE for the $106 of the 1099 as long as your husband's salary is above the line.

    well,I need a little help. I just got the letter for the RFE and I am.... stunned....

    They are asking for the most recent tax documentation in order to process my application further.

    I believe,that when we sent out the package we included IRS documents for years 2005,2006 and 2007.

    Was I supposed to also sent IRS documents for 2008? By the time we sent it we still didn't have that done,nor we didn't have the information since the most recent year was 2007(for 2008)

    I am a little confused....Am I supposed to send now IRS for 2008?

    Hmmm..were any of your previous tax returns near the "borderline" of the poverty limit? I wonder why they are asking for this! thats insane.

    Well,

    after going over all the photocopies that we made of the whole package sent, I believe that a mistake had been made although I was very clear to the person getting those tax information for us. We sent the W2's but not the 1099's. That person told us that it was not necessary.... I am going to tell him how necessary it was...my spanish blood is boiling :ranting:

    Hopefully I will get what was missing today and send it out again tomorrow.

    It's my understanding that not everyone receives a 1099. My wife nor our co-sponsor received a 1099 for the past three tax years. If you have a 1099, submit it, but if you don't, what do you do?

    you send the tax file with you, right?

    I know there is a page will let you or your accountant to input the amount from W-2 and / or 1099s.

    You can just base on that page to know how many W-2 and/or 1099s you need to send to USCIS. If you want to make sure that USCIS will not mis-read your tax file, you can write a personal notes or letter and telling them that you don't have the 1099s for the last three years.....

    I talked to the IO and he told me that is good to include some personal notes to USCIS which can help them to know what you didn't send and what you may send later if you miss any of the 1099s

  12. I am confused also. When you filed, the most recent tax year was 2007, so that is what should be sent it. I can't imagine that they are going to ask you to send in your taxes for 2008. I would think that we would all be getting RFEs for this since we filed around the same time, and that is a lot of extra paperwork for them. I don't think they can penalize us like that for choosing to file at the end of the year. Hopefully the part of your AOS package that had the tax info simply got lost or misplaced and they need the documents replaced. Good luck, keep us posted...

    I got the RFEs about the tax before... I went to the field office and confirm with the IO there. They told us that just send everything again and organize that like a package...

    Remember that if you sent a IRS transcript, you don't need to send 1099s and W-2. If you send a copy of your tax file, you need to send the ORIGINAL of all your 1099s and W-2.

    Try to follow the instruction on the RFE and understand the instruction which the RFE refers to.

  13. I know what you guys mean... this process is a true test of patience, for my husband and myself. It's been three weeks since the bio appt and we got nothing! I was hoping for a transfer but not yet... It's a good thing we all have each other to lean on, whine, and complain to... my friends & family in the real world have been listening to me whine since the K-1 process began in Nov '07 and I think they are starting to run out of patience too... good thing my VJ family loves me!     Acutally I asked to expedite for adjudication of my EAD since the end of Dec ( I asked again last week)... and I have sent a personal letter and asked my employer to give me a letter to speed up the process too...

    I think that you guys can try to do that if u guys have a job offer already...

  14. We received my husbands EAD card in the mail today!!!!!!! YAY! :dance:

    Also I just got an email from CRIS saying "Current Status: Approval notice sent."

    I noticed yesterday as well that the case had been touched on Monday the 26th.

    WOW...this is a great feeling :) Off to the SSA in the morning :):) :dance::dance:

    Hi I have a question about EAD...

    Can u start working after you know that Your EAD is approved but you don't received your EAD in mail yet?

  15. thanks for the reply. The only number on the bottom of my letter was for premium processing so I pulled the first notice out of the file to check it out went I through and automated system that gave me info I already knew and obviously there was no one to speak to at the time I called.

    Im going to wait a bit longer before I start calling on it, it hasnt been there that long I just just excited when I heard of other cases around the same time frame moving a bit but for every one case thats moving there are 2 are still waiting from what I've seen so im just gonna try and relax a bit about it. Theres enough in life to drive me crazy without worring about something I have no control over

    When was the last time you received a letter from USCIS? As I remember from the automated system, u can talk to the ppl there if you didn't receive anything from them more than 15 days or so..........

  16. well that stinks, so if i was to call and inquire if a bio appt letter has been sent does anyone know what number i should be ringing?

    You can just dail the number at the bottom of the letter from USCIS...

    I know that they can find your file since I went to the Field Office without my biometric appointment (I went there because I want to check they can make my biometric appointment earlier) and the people there can find my biometric letter too

  17. It means you omitted something or they need clarification.... They cannot continue to process until you reply.... Application is on temporary suspension pending your response
